Taylor Subdivision and Lot 9 in Block 2 of the Lela M. Miller Subdivision, fronting on the North and South sides of the Buffalo Lick Road and more particularly described by plats hereto attached and as a part of this Petition, hereby respectfully request the members of the Planning Commission of Frederick County, Virginia, to zone said lots as Business -General (B-2). Said lots are presently proposed to be zoned Residential (R-1). This request is made as the property as it presently exists on both sides of the Buffalo Lick Road extending East from its ititersection with U.S. Highway No. 522 is heavily business and your petitioners believe and so allege that the property fronting on the Buffalo Lick Road will grow more as a business development than as residential. Respectfully Submitted, James Edward Wisecarver and Peggy Ann Wisecarver By: Counsel ' September_, 1966. September 2, 1966 Frederick County Planning Commission Frederick County Courthouse Winchester, Virginia Gentlemen: The undersigned wishes to make application to the Frederick County Planning Commission with respect to the planned zoning of land near Ninevah where the undersigned owns certain real estate. I am the owner of a 70-acre tract of land situate about one and one -eighth miles West of Ninevah on the Refuge Church Road, Opequon Magisterial District, Frederick County, Virginia. This land was purchased in 1964 for $15,000.00 from P. H. Johns and R. E. Lee Speaks and is being used for an automobile junkyard. It is my understanding that the area in which this land is located is zoned agricultural, and it is my wish to request that the Planning Commission consider the propriety of zoning the area in which this 70-acre tract is located from an agricultural to a business district which would permit the continuance of the business for which the land is now used by me. If the Planning Commission would wish me to appear before it in further support of this request for a change in the planned zone, I would be pleased to do so. matter. Thank you very much for your consideration in this Very truly yours, Richard D. McComas L. c, q Winchester,ta. Aw ust 13,1966. We know that the value of our homes will decrease. The loading of cars and the Dressing of old car bodys will cause considerable noise, and there is also a vermin problem. But, just as impo3tant, if not more so, is the beauty of F!redericl. County. On Route 11 alone there is a traffic count of & vehicles per/ Sy / c/L+C. We realize ttie County needs junk yards and also means of disposing of old cars, but we feel if the beauty of Ii'rederick County is to be preserved, this type of business must be out of sight of our main highways, I have del- with the Zuckermans for a ntirnber of years. I have found them to be honest and civic minded, and I certainly AZope they will abide by the vrislaes of the Citizens in the Stone- wall District and try to wort- out a new location for the business. -2- We feel the Land use Plan is a good one as it is set up now. They have mapped our area as residential and farming. But for the unfortunate illness of our Commonwealth Attorney, NO. Massie, and Chairman of the Planning Commission, Mr. Golliday, we feel the Zoning Ordinance would be :such further along, if not completed. Again, Gentlemen, I would like to remind you of the damage financially to our homes and health of our families. I would also like to ask you if you have ever seen an attractive junk yard. We have presented to the Board of Supervisors a petition from the Citizens of Frederick County with the signatures of 343_ citizens opposing the relocation of Zuckerman Company, Inc., in this particular area. Petitioners are owners of a certain tract or parcel of land situate in Stonewall Magisterial District, Frederick County, Virginia, fronting on the East side of U. S. Charles A. Pine, Sr. believes that the aforesaid !and is zoned residential, said land failing within Zone B. Your Petitioners believe and therefore allege that the development of the land in the neighborhood of the subject property during the years since enactment of the Zoning Ordinances, and particularly the influence and impact of construction of U. AIA HUBERT T. STRATTON. AIA Enclosed please find a report on the above project together with suggested preliminary plans. In order to establish a budget figure which you might use to deter- mine the feasibility of the project, it was necessary to prepare preliminary sketches for take -offs of labor, materials, etc. These could no doubt be improved upon, both economically and plan -wise -- in the interest of time and fee we restrained them to one study only. The cost figures should be ample --most are based on national costs and are those we use regularly in our practice. As a next step, you might wish to review this information with a builder. If we can consult further or prepare additional information please advise us. Perhaps, it would be helpful to review this survey together. Very truly yours, ti Keith Williams KW/bk Enclosures LEE N.
