of Frederick County, Virginia. I (we) authorize Frederick County officials to enter the
property for site inspection purposes.

the front property line at least seven days prior to the Planning Commission public hearing

THIS DEED, made and dated this 28th day of September, 2001 by and between
ALSON H. SMITH, III, party of the first part, hereinafter called the Grantor, and KRA
FOOD SERVICE, L.L.C., a Virginia Limited Liability Company, party of the second part,
hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten ($10.00) Dollars,
cash in hand paid and other good and valuable consideration, the receipt of which is hereby
acknowledged by the party of the first part, the party of the first part does hereby grant and
convey with General Warranty of Title in fee simple absolute unto the party of the second
part, all of the following tract or parcel of land described as follows:
All that certain tract or parcel of land, lying and being situate in Gainesboro
Magisterial District, Frederick County, Virginia, containing 0.4342 acres, and more
particularly described on the plat of survey drawn by Michael M. Artz, Land
Surveyor, dated August 30, 2001, attached hereto and by this reference made a part
hereof as if set out in full and being a portion of the same land conveyed to Alson H.
Smith, III by Deed of record in the Clerk's Office, Circuit Court of Frederick County
in Deed Book 779 at Page 1463.
The conveyance herein includes the non-exclusive easements granted in
deeds dated December 13, 1991, and April 3, 1992, to Alson H. Smith, et ux, predecessors
in the title of record in the aforesaid Clerk's Office in Deed Book 771 at page 580 and Deed
Book 779 at page 1459, respectively, which are incorporated herein by reference.
The tract of land conveyed hereby shall be joined with other land of KRA Food
Service, L.L.C. to form a single tract of land containing 5.649 acres as shown on the
aforesaid attached plat.

Rezoning
Owners of property adjoining the land will be notified of the Planning Commission and the Board
of Supervisors meetings. For the purpose of this application, adjoining property is any property
abutting the requested property on the side or rear or any property directly across a public
right-of-way, a private right-of-way, or a watercourse from the requested property. The
applicant is required to obtain the following information on each adjoining property including the
parcel identification number which may be obtained from the office of the Commissioner of
Revenue. The Commissioner of the Revenue is located on the 2nd floor of the Frederick County

(zero if negative): included are the one-time taxes/fees for one year only at full value.

NPV of future oper cap equip taxes paid in third column as calculated in fiscal impacts.
