Planning & Zoning: 1) Site History The original Frederick County Zoning Map (U.S.G.S. Gore Quadrangle) depicts parcels 28-A- 75 and 28-A-82 as being split zoned MI -I (Mobile Home) District and A-] (Agricultural Limited) District and parcel 28-A-76 as entirely zoned MI -I (Mobile Home) District. The County's agricultural zoning districts were subsequently Combined to form the RA (Rural Areas) District upon adoption of an amendment to the Frederick County Zoning Ordinance on May 10, 1989. Each of the properties contains one residential dwelling unit each. Parcel 28-A- 75(151 Sinking Spring Lane) has one mobile ]ionic, parcel 28-A-76 (175 Sinking Spring Lane) contains one mobile home and 28-A-82 (171 Sinking Spring Lane) has one manufactured home. 2) Comprehensive Policy Plan The Frederick County 2030 Comprehensive Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. Land Use The properties are located outside the Urban Development Area (UDA) and the Sewer and Water Service Area (SWSA). It is not within the limits of any small area land use plan. The properties are located in an area that is designated as a rural area. The rural areas of Frederick County are anticipated to promote agricultural and large lot residential uses without public water and sewer. Goals for the rural areas include maintaining the rural character of areas outside the Urban Development Area and protecting the rural environment. Therefore removal of the historical mobile home zoning from the three properties is consistent with the goals of the 2030 Comprehensive Plan. 3) Potential Impacts: No impacts are anticipated. This is a positive rezoning request that minimizes potential future impacts and addresses the Comprehensive Plan. Due to the scope of this rezoning request a detailed impact statement was not required. A proffer statement was not provided with this rezoning request. My great grandmother owned the property and passed away. My grandmother and aunt sold it to me. We purchased the home by going thru Bank of Clarke County. The loan went thru with no problem. We then a few years later went back to Bank of Clarke County to redo our loan. Now the nightmare begins: What we did not know is that the appraiser failed to find that the property was zoned MH1. The second appraiser found this and the Bank of Clarke County did a complete turn around and wanted nothing to do with our property. We then had to search for someone to finance the home or lose it. No one would touch it. We finally found Capon Valley Bank in Gore. They took some time but worked with us and we are so thankful that they would take our loan. Only problem being. —the loan cannot be sold because of the MH1 therefore the loan is kept in- house and double the interest rate. Next we wanted to add on to our home. Frederick county would not let us because again the property is zoned MH1. So we had to change our plans. Then there were issues with the flood zone. We pay a fortune to have that done. Our house sits on a knoll therefore it is not in a flood zone. So now all of this is complete. Next, we finally get someone at the county to help us get the zoning fixed so we quit having so many issues with this property. After all of these issues we get frustrated and just want to sell the property but, we can't, because no one will be able to get a loan for it. Keep in mind this is over a couple years. Currently, we finally think that the property is rezoned and it is resolved. We applied for a regular loan for which all is going well and we are ready to close and guess what..... Yet another problem. The appraiser now finds the zoning is fixed in some screens or places in the county but not all. So here we go again. We have tried to do everything we can to work with the county and the banks and do whatever we needed to do for our property to be zoned correctly. We are confused as to why this so difficult and are hoping for a quick resolution. The county does not want it zoned MH1 and we don't want it zoned MH1 so we would just like for this to be over.
