This application seeks to rezone 1.56 acres of a 3.68-acre property from the B2 (General Business) District with proffers to the B3 (Industrial Transition) District with proffers. The review is generally based upon the application and proffer statement received on May 22, 2019. Prior to formal submission to the County, please ensure that these comments and all review agency comments are adequately addressed. At a minimum, a letter describing how each of the agencies and their comments have been addressed should be included as part of the submission. 1. Northeast Land Use Plan. The 2035 Comprehensive Plan and Northeast Land Use Plan provide guidance on the future development of the property. The 2035 Comprehensive Plan identifies this property with an industrial land use designation. The proposed B3 Zoning is consistent with the Plan as it relates to this area. 2. Updated Rezoning Signed Application. Please note that the rezoning application and special limited power attorney forms have been updated. Please utilize the new forms for the final submission. 3. Proffer Statement. Proffer 1 should be removed as it is a County requirement, the proffer from the rezoning pertaining to signage should be contained in this statement (shared signage — Martinsburg Pike), it is noted that new rezonings have accounted for their impacts on fire and rescue ($0.10/building sf). 4. Agency Comments. Please provide appropriate agency comments from the following agencies: Virginia Department of Transportation, Frederick County Department of Page 2 ORI Rezoning May 30, 2019 Public Works, Frederick County Fire Marshall, Frederick Water, City of Winchester (utilities), and the County Attorney. 5. Fees. Based on the fees adopted by the Board of Supervisors on April 23, 2008, the rezoning fee for this application would be $5,156 based upon acreage of 1.56 acres. All of the above comments and reviewing agency comments should be appropriately addressed before Staff can accept this rezoning application. Please feel free to contact me with questions regarding this application. Sincerely, ell Candice E. Lawrence Executive Director Thank you for the opportunity to offer review comments on the Off Road Innovations rezoning application package, with a draft proffer statement dated May 2019 and Impact Analysis Statement dated May 2019. Frederick Water offers comments limited to the anticipated impact/effect upon Frederick Water's public water and sanitary sewer system and the demands thereon. The project parcels are located inside of the County's Sewer and Water Service Area (SWSA), but through previous approvals the City of Winchester's water and sewer services have been extended and constructed on the parent tract and could be accessible for the proposed subdivision and rezoning parcel. On March 21, 2019, the Frederick Water Board of Directors granted an exception to enable the utilization of the City's water and sewer services (see attached letter of March 21, 2019). Lawrence Executive Director RE: Request for Exception to Enable Utilization of City Water and Sewer - ORI Building SE Corner of Martinsburg Pike and Park Center Drive (Full House Drive) Tax Map Number 54A-1-A Dear Joe, On March 19, 2019, the Frederick Water Board of Directors granted your request for an exception to enable the utilization of City of Winchester Water and Sewer for your client's property on Full House Drive. This approval affirmed that the previously installed water and sewer infrastructure on Tax Map Numbers 54A-1-A and 54A-1-A2 may be used for the City's water and sewer service. The approval also recognizes the city's comment (dated February 15, 2019, attached) that the City will accept the sewerage conveyed to it through the existing private pump station and sewer line; no upgrades to the private pump station is permitted. This action enables your client to work with the City of Winchester to facilitate the water and sewer connection. The Board did want the property owner and its tenants to be aware that by utilizing City water and sewer services, the City will provide the services at rates established by City of Winchester City Council. More importantly, neither Frederick Water nor the Frederick County Board of Supervisors have a role in the water and sewer rates that may be charged by the City, and therefore the property owner and tenant will have limited if any representation in the event of future water and sewer rate increases. I have reviewed the Proffer Statement and it is my opinion that the Proffer Statement would be in a form to meet the requirements of the Frederick County Zoning Ordinance and the Code of Virginia, and would be legally sufficient as a proffer statement, subject to the following comments: 1. Owner and date identification — Because the County Code requires a proffer statement for a rezoning to be recorded in the land records upon approval of the rezoning, the Proffer Statement will need to include in its heading the names of the owners of the Property. As well, for best clarity, the heading should also indicate the full date (day, month, and year) of the version of the Proffer Statement. 2. Signature requirements/reference to "owners" — Because a rezoning and a proffer statement restrict the use of a property, the owners of the Property at the time of rezoning, and not the "developer", will need to sign Proffer Statement and the rezoning application. This same requirement will also apply to any powers of attorney being submitted, if you or anyone other than the owners will be responsible for the presentation of the rezoning to County officials. Along similar lines, throughout the Proffer Statement, the terin "developer" should be changed to "owners". 107 North Kent Street o Winchester, Virginia 22601 • Mr. Kevin J. Knechtel May 31, 2019 Page 2 Proffer Statement, "Preliminary Matters" — In the reference to the 2016 subdivision plat in the last paragraph, the "Parent Tract" is parcel A and not parcel Al on that plat. 4. Proffer Statement, Site Plan Elements, Landscaping — This provision does not actually state an additional obligation and is therefore unnecessary and should be deleted. Proffer Statement, Site Plan Elements, Street Connections — Subsequent to the subdivision proposed in cormection with the rezoning, the rezoned area will not have direct access to Martinsburg Pike. The 2016 subdivision plat references a reciprocal ingress/egress easement between Parcel Numbers 54A-1-A and 54A-1-A1, but access to Martinsburg Pike through Parcel Number 54A-1-A may require an easement over the remainder of Parcel Number 54A-I-A for the benefit of the rezoned area. Likewise, the 2016 subdivision plat references a shared parking easement between the two properties, but an easement over the remainder of Parcel Number 54A-I-A for the benefit of the rezoned area may be necessary in order to ensure adequate parking for the use on the rezoned area. 6. Proffer Statement, Maximum Building Size — Staff will want to confirm that the traffic estimate in the impact statement is consistent with this building size (12,000 square feet), as the impact statement appears to assume a specific use — auto service — but the only limitation in the Proffer Statement is on building size and not a limitation on specific uses. I have not reviewed the substance of the proffers as to whether the proffers are suitable and appropriate for this specific development, as it is my understanding that review will be done by staff and the Planning Commission. Thank you for the opportunity to offer review comments on the Berlin Steel rezoning application. Sincerely, Cyl i t 9 Eric R. Please provide appropriate agency comments from the following agencies: Virginia Department of Transportation, Frederick County Department of 4a Page 2 ORI Rezoning May 30, 2019 Public Works, Frederick County Fire Marshall, Frederick Water, City of Winchester (utilities), and the County Attorney. 5. Fees. Based on the fees adopted by the Board of Supervisors on April 23, 2008, the rezoning fee for this application would be $5,156 based upon acreage of 1.56 acres. All of the above comments and reviewing agency comments should be appropriately addressed before Staff can accept this rezoning application. The 2035 Comprehensive Plan and Northeast Land Use Plan provide guidance on the future development of the property. The 2035 Comprehensive Plan identifies this property with an industrial land use designation. The proposed B3 Zoning is consistent with the Plan as it relates to this area. Response: Noted. Response: The agency comments are attached. All but the County Attorney (see below) had no comment or approved. Comment 5: Fees. Based on the fees adopted by the Board of Supervisors on April 23, 2008, the rezoning fee for this application would be $5,156 based upon acreage of 1.56 acres. Response: Noted. May 31, 2019 Comments, Roderick B. Williams, County Attorney Comment 1: Owner and date identification - Because the County Code requires a proffer statement for a rezoning to be recorded in the land records upon approval of the rezoning, the Proffer Statement will need to include in its heading the names of the owners of the Property. As well, for best clarity, the heading should also indicate the full date (day, month, and year) of the version of the Proffer Statement. Response: Proffer Statement has been revised to include in its heading the names of the owners of the Property and the date. Comment 2: Signature requirements/reference to "owners " - Because a rezoning and a proffer statement restrict the use of a property, the owners of the Property at the time of rezoning, and not the "developer". will need to sign Proffer Statement and the rezoning application. This same requirement will also apply to any powers of attorney being submitted, ifyou or anyone other than the owners will be responsible for the presentation of the rezoning to County officials. Along similar lines, throughout the Proffer Statement, the term "developer" should be changed to "owners ". Response: The Proffer Statement has been revised to show Owner instead of Developer and will be signed by the owner. The owner will also sign the rezoning application. Comment 3: Proffer Statement, `Preliminary Matteis" -In the reference to the 2016subdivision plat in the last paragraph, the "Parent Tract" is parcel A and not parcel AI on that plat. Response: Revised as noted. AiRTESTA Ms. Candice E. Perkins June 24, 2019 Page 3 Comment 4: Proffer Statement, Site Plan Elements, Landscaping - This provision does not actually state an additional obligation and is therefore unnecessary and should be deleted. Response: Landscaping proffer has been removed. Comment 5: Proffer Statement, Site Plan Elements, Street Connections - Subsequent to the subdivision proposed in connection with the rezoning, the rezoned area will not have direct access to Martinsburg Pike. The 2016 subdivision plat references a reciprocal ingress/egress easement between Parcel Numbers 54A-1 A and 54A-1- A1, but access to Martinsburg Pike through Parcel Number 54A-1-A may require an easement over the remainder of Parcel Number 54A-1-A for the benefit of the rezoned area. Likewise, the 2016 subdivision plat references a shared parking easement between the two properties, but an easement over the remainder of Parcel Number 54A-1-A for the benefit of the rezoned area may be necessary in order to ensure adequate parking for the use on the rezoned area. Response: After discussion with the County Attorney, it was determined that the Street Connections proffer will stay since the property does have access at the Park Center Drive entrance (a shared easement is currently on the property) and the Martinsburg Pike entrance can be resolved during the subdivision process. Also, it was decided in our discussions to add a Parking proffer. Comment 6: Proffer Statement, Maximum Building Size - Staff will want to confirm that the traffic estimate in the impact statement is consistent with this building size (12, 000 square feet), as the impact statement appears to assume a specific use - auto service - but the only limitation in the Proffer Statement is on building size and not a limitation on specific uses. Response: After discussions with you and the Attorney, it was decided to refer back to the previous rezoning proffer #04-03 on combined building size for the whole development. APPENDIX A Community Impact Statement, OR I, Park Center Drive (0103-19-0034), May 2019 COMMUNITY IMPACT STATEMENT Qf f Road Innovation Park Cewter Road - CominL'rcial Site Plan Frederick County, Virginia BACKGROUND The project is located at the southeast corner of the intersection of Park Center Drive and US Route 11, north of the City ol Winchester at TM54A-(I)-A. The overall parcel is 3.6 acres and is adjacent to the Backscat Restaurant. Off Road Innovations (ORI) is proposing to construct a 10,000 square foot "auto -service" building on a subdivided portion, approximately 1.6 acres, ofthis 3.6-acre lot. The business is not a "I'cpalr garage" but will install off road accessories to vehicles, so it falls under Auto Service use. They expect five employees and possibly five customers daily. Public utilities, water, and sewer services will be provided by the City of Winchester. Stormwater management will be provided for the site through an existing on -site detention pond and additional water quality best management practices. A. Suitability of the Site The site has already been developed for commercial use with paved, curb and gutter parking lot and building pads, as well utilities, gas, electric, water, and sewer. The site is not located within a flood plain (zone AE) according to FEMA FIRM Map #51069CO209D, effective September 2, 2009. There are no known wetlands, nor steep slopes (over 15%), mature woodlands, and prime agricultural soils. Soil or bedrock conditions which would create construction difficulties or hazards will be minimal since most utilities and Stormwater management are in place at the site and the building will be a concrete slab on grade with shallow footers. B. Surrounding Properties The adjoining properties are Commercial/Industrial use. Shade Equipment and Winchester Metals are located across US Route 11 and Park Center Drive, respectively. Shendendoah Sand & Gravel is located on the opposite corner across US Route 11. The immediate adjacent lot the east is occupied by Simkovich Trucking with fueling stations, and the subject site shares parking lot with Backseat Bar & Grill. No residential lots adjoin this property. The closest residential lot is approximately 280 feet south along US Route 11. The business on not a "repair garage" but will install off road accessories to vehicles and assumes five employees and possibly five customers daily. The potential for impacts on surrounding properties associated with noise, glare, fumes, pollution, odors, or other nuisance factors are minimal. Community Impact Statement, OR I, Park Center Drive (0103-19-0034), May 2019 Page I • C. Traffic The project site will use the existing approved Virginia Department of Transportation commercial entrances onto US Route 1 i and Park Center Drive. The estimated vehicle trips per peak hour day are 13 VPI-I for AM, and 18 VPI-I for PM, per the ITC Trip Generation Manual, 7"' edition. D. Sewage and Water Availability The 3.6-acre parcel has City of Winchester Water and Sewei- mains located within the parcel boundaries. A manhole is located on the proposed subdivided parcel and will be approximately 12 feet fi-om the proposed building. An existing water line and fire hydrant are also located oil the parcel. The City of Winchester Public Services Department has issued a Utility Availability Letter ("ORi bldg. Utility Availability" — attached) stating they would be willing to serve this development and its proposed water and sewage capacities. The Frederick Water Board of Directors then granted an exception to enable the utilization of City of Winclicstcr Water and Sewer for this parcel. E. Drainage The site's drainage will flow to the existing storm sewer and to the detention pond on the parcel. The new development will ineet the requirements of the current stormwater regulations. F. Solid Waste Disposal Facilities Solid waste for this development will be stored in metal containers for pick up by a local solid waste collector. It is anticipated that collections will occur weekly. G. Impact on Community Facilities G1. Law Enforcement The Frederick County Sheriff's Department response time, under ideal conditions, would be less than 10 minutes. The existing service demand for this property is currently low and is anticipated to remain at this level with the addition of this facility. Natural terrain will not inhibit response due to the established road network. This project is located away from areas of significant residential populations. G2. Fire and Rescue Services The closest fire station and/or rescue squad is Friendship Fire Company approximately 1.5 miles from the site, and Rouss Fire Department, approximately 2 miles from the site. Response time for a safety emergency on this property should be less than 10 minutes. The existing service demand for this 1n-01)erty is currently low and is anticipated to remain at this level with the addition of this facility. Natural terrain will not inhibit response due to the established road network. Community Impact Statement, ORI, Park Center Drive (0103-19-0034), May 2019 Page 2 G3.
