MAGISTERIAL DISTRIC`i': Stonewall Magisterial District ADJACENT LAND USE AND ZONING: Residential and industrial zoning and residential and vacant land use. PROPOSED USE AND I14PROVELNIENTS: Construct 100 apartment units on 6+ acres now zoned R-3 (Single Family Residential). The apartment unit proposal will consist of elderly housing units. This request is contingent upon receiving the appropriate funding from the Virginia Housing and Development Authority. REVIEW EVALUATIONS: Virginia Dept. of Highways and Transportation - No objection to the rezoning. Sanitation Authority - Water and sewer are presently available for the proposed area. Adequate capacity is available for the proposed development. Water lines will have to be extended by the developer. Department of Inspections - Must comply with the requirements of the Virginia Uniform Statewide Building Code concerning use group R-1. Specific code requirements will be noted on the construction plans. Planning and Zoning - The use, as proposed, does conform to the policies as outlined in the Comprehensive Plan and 1990 Land Use Plan for Frederick County. In previous discussions with the Planning Commission, the applicant has demonstrated a need for this housing type. Facility design and 'Location have been integrated with the location of existing public and private services. Impact on surrounding land uses should be minimal. Disruptions to area traffic are not anticipated due to the lack of dependency on private mode of transportation. It is also anticipated that the impact on delivery of services should be minimal. r Page Two Darlington STAFF RECOHMENDATIONS The following issues should be considered in reaching a decision on this case: 1. Does the use as proposed conform to the Comprehensive Plan for Frederick County? 2. Is there a demonstrated need for this housing type? 3. Will the impact on the delivery of services be substantial? 4. Does the use as proposed conform with surrounding land uses? 5. Darlington 6+ Ares, Zoned R-3 (Single Family Residential) Be Rezoned to R-6 (Multi -Family) LOCATION: West side of Baker Lane, adjacent to the City of Winchester. MAGISTERIAL DISTRICT: Stonewall Magisterial District ADJACENT LAND USE AND ZONING: Residential and industrial zoning and residential and vacant land use. PROPOSED USE AND IMPROVEMENTS: Construct 100 apartment units on 6+ acres now zoned R-3 (Single Family Residential). The apartment unit proposal will consist of elderly housing units. This request is contingent upon receiving the appropriate funding from the Virginia Housing and Development Authority. REVIEW EVALUATIONS: Virginia Dept. of Highways and Transportation - No objection to the rezoning. Sanitation Authority - Water and sewer are presently available for the proposed area. Adequate capacity is available for the proposed development. Water lines will have to be extended by the developer. Department of Inspections - Must comply with the requirements of the Virginia Uniform Statewide Building Code concerning use group R-1. Specific code requirements will be noted on the construction plans. Planning and Zoning - The use, as proposed, does conform to the policies as outlined in the Comprehensive Plan and 1990 Land Use Plan for Frederick County. In previous discussions with the Planning Commission, the applicant has demonstrated a need for this housing type. Facility design and location have been integrated with the location of existing public and private services. Impact on surrounding land uses should be minimal. Disruptions to area traffic are not anticipated due to the lack of dependency on private mode of transportation. It is also anticipated that the impact on delivery of services should be minimal. Does the use as proposed conform to the Comprehensive Plan for Frederick County? 2. Is there a demonstrated need for this housing type? 3.
