MAGISTERIAL DISTRICT: Opequon Magisterial District. ADJACENT LAND USE AND ZONING: Sinqle family residential and commercial zoning and land use. PROPOSED USE AND IMPROVEMENTS: Rezone 5.8 acres zoned B-1 which will expand the commercial area out to the proposed right-of-way to facilitate future commercial use and planning. R-6 areas will be used to construct 59 townhouses for sale on 10.1 acres. REVIEW EVALUATIONS: Va. Department of Highways and Transportation/Public Works - No objection to rezoning. Frederick Countv Sanitation Authority - The Authority does not favorably approve either R-6 or R-3 zoning next to a wastewater treatment plant. Section 23.01.02.a of the Commonwealth of Virginia Sewage regulations requires all new treatment plants of the type proposed for Stephens City to have a six hundred foot buffer zone. The buffer zone is an area of controlled or limited use. Within buffer zones, residential uses or high density human activities or activites involving food preparation are prohibited. The purpose of this zone is to eliminate problems associated with airborne bacteria which may be emitted from a treatment plant. Although the Stephens City Plant is existing and the buffer requirement may not be imposed, the problem associated with airborne bacteria may still exist. It should be pointed out that the need for a buffer zone is not necessarily agreed with by all engineers. The Authority prefers that, if the land is to be developed, commercial development would be the most desirable. Department of Inspections - No comment. Department of Planning and Zoning - The Department of Planning and Zoning agrees with the Sanitation Authority comments. As a result of these comments, the applicant was contacted and a meeting arranged with the Authority, Department of Planning and Zoning, and the applicant. Upon the discussion of these criteria, the Authority advised that the buffer requirement could be reduced to three hundred feet provided that extensive screening was placed around the plant and also provided by the developer. The three hundred foot requirement would be sufficient for an adequate buffer zone between the plant and the proposed residential use. The applicant has agreed to this and is in the process of rearranging the buildings on the site to meet the three hundred foot requirement and to show the adequate screening as required by the Sanitation Authority. The Comprehensive Plan indicates medium density residential for the use in this area. The proposed construction of the fifty nine townhouses breaks down to approximately six units per acre. The Zoning Ordinance for medium density residential or R-3 indicates that approximately four dwelling units would be permitted per acre. It is the opinion of the staff that the single family attached townhouses for sale as proposed would not conflict with the intent of the Comprehensive Plan and would still be considered as a medium density residential development. The applicant has also presented an overall plan to the Planning Commission which indicates a mix or variety of uses in the area. As noted, the developer has already completed section one of a single family detached subdivision and is in the process of constructing the second section for single family detached. The third phase of his overall development plan indicates the construction of the townhouse units as proposed and the final phase of commercial development out to the service road Route 1012. The applicant in his overall plan has minimized traffic conflicts by internalizing the flow of traffic and posing minimum conflicts to the existing traffic flow on Route 277. It is felt that the proposal, as presented in the application, is in line with the goals and objectives of Frederick County. STAFF RECOMMENDATIONS: Approval. PLANNING C014MISSION RECOMMENDATIONS: The Planning Commission unanimously recommends approval of this request based on the fact that the overall density will not exceed three units per acre and is in conformance with the Comprehensive Plan. Section 23.01.02.a of the Commonwealth of Virginia Sewage Regulations requires all new treatment plants of the type proposed for Stephens City to have a 600' buffer zone. The bu fer zone is an area of controlled or limited use. Within buffer zones,'residental uses or high density human activities or activities involving food preparation are prohibited. The purpose of this zone is to eleminate problems associates with airborne bacteria which may be omitted from a treatment (OVER) Signature Date 12-15-80 703/662-4532 plant. Although the Stephens City plant is existing and the buffer requirement may not be imposed, the problem associated with airborne bacteria may still exist. It should be pointed out that the need for a buffer zone is not necessarily agreed with by all engineers.
