Riley, Secretary, Planning Commission SUBJECT: FREDERICK MALL LAND TRUST - Rezoning Application #010-80 This request died due to a tie vote on December 10, 1980. The Board of Supervisors' policy is that the request may be reheard within thirty days of the initial action. The applicant requested on January 14, 1981 that the action be tabled until February 11, 1981 due to previous commitments. Attached are the recommendations from staff and Planning Commission for your review and action. JRR:bjs Attachments 703/662-4532 Rezoning Application #010-80 Frederick Mall Land Trust B-2 to R-6 9.63 Acres Location: East of Fox Drive, approximately 2,000 feet south of Route 522 North in the Gainesboro Magisterial District. (Please see attached location map.) Adjacent Land Use & Zoning: Commercial and residential zoning and residential and vacant land use. Proposed Use & Improvements:. Construct 96 apartment units with 195 parking spaces at a density of approximately 10 units per acre. Review Evaluations:.., Va. Dept. of Highways and Transportation - No objection to rezoning. Sanitation Authority - Water and sewer capacity is available at present. The lines are sufficiently close to enable the applicant to extend facilities to serve his proposed development. Department of Public Works - O.K. Topo and streets satisfactory except for Fox Drive access. This may need some improvement for this traffic load. Department of Inspections - Must conform to use group R-2 Section 209, Article I of the Virginia Uniform Statewide Building Code. Specific requirements will be noted on plans. Zoning - No objection. Planning - This is a satisfactory site for multi -family housing. Public facilities such as water and sewer are available. The proposal is in close proximity to public transit, schools and proposed shopping areas. Traffic is 'internalized on the site and should pose minimal disruption to existing traffic flow. Internal traffic flow is not clearly defined on the preliminary sketch, with the exception of a proposed 25 ft. right-of-way at the end of the proposed cul-de- sac. Design of this particular access will have to be extensively reviewed to determine if conflicts will exist between commercial and residential traffic patterns. h Frederick Mall Land Trust Page 2 This proposal does seem consistent with the planning goals and objectives of Frederick County. Staff Recommendation: Approval, with the understanding that a site plan will -be submitted and reviewed by the Frederick County Planning Commission prior to receiving the appropriate permits. Planning Commission Recommendations: The Planning Commission, by a majority vote, recommends approval of this rezoning request, #010-80, to the Board of Supervisors.
