Opequon District. (see attached map) Proposed Use and Improvements: Expansion of existing trucking firm by a trailer shop and additional offioe space. Adjoining Land Use: Single family homes and open areas. Review Evaluation: Frederick=Winchester Health Dept. -- A Health permit has been issued for the new facility. Va. Dept. of Highways and Transportation -- No objection, entrance must be improved to accommodate trailer trucks safety. Public Works Dept. -- There is no flood plain or offsite drainage problem with this proposal. Planning -- This area is planned for agricultural use, and no roadway improvements are planned for Route 277 or Route 636_ Staff Recommendation: The staff recommends that this request be denied, and only a very limited area be considered for rezoning. The reason for recommending denial is that the area is not planned for a truck terminal and the expanded terminal and other M-2 uses would have a detrimental effect on nearby homes and the County park due to air and noise pollution. Other reasons for denial are the lack of health facilities in existing buildings, and the poor soils for drainfields that dictate scattered buildings. A case can be made for a request for a portion of the land, the staff does not recommend this course either, but there are similarities between this request and recent approvals for Omp's and Shirley. This course is not recommended because this business has grown by violating their permit, rather than finding a more appropriate location where roadways and health facilities are more suitable or more easily provided. Planning Commission Recommendation: The Commission recommends approval, with Mr. Gordon and :ir. Venskoske voting no. Fulton, et ux Dear Wayne: Mr. Arthur Fulton had me review the records in the Clerk's Office with reference to the 14.626 acre tract which he bid in at the recent auction. I believe that Mr. Fulton and Mr. Charles Cash, of First Virginia Bank, were left with the impression that the land had not been properly subdivided; however, I find in Deed Book 502 at Pages 243-247 that the subdivision was put to record. My recollection is that in 1978 tracts of land exceeding 5 acres, regardless of their zoning, could be subdivided, and apparently this is what Ron Berg approved with respect to the 1.00 acre tract, the 14.626 acre tract, and the 12.190 acre tract.
