their meeting on May 25, 2016. The above -referenced application was approved to rezone
2.10 acres 1rom the RA (Rural Areas) District to the B2 (General Business) District with
Proffers. The property is located at 231 Cross .function Road less than 0.3 miles from the
intersection with US Route 522 North (North Frederick Pike) in the Gainesboro Magisterial

on the property. The site is within the limits of the Cross Junction Rural Community Center. Rural
Community Centers typically consist of small lot residences and commercial uses typical of a village.
There are currently no public utility services within this community center. The requested B2
designation is limited and considering parcels SUrrOLlnding this parcel are zoned B2 and MI, this
request appears to be consistent with the goals of the 2030 Comprehensive Plan.
With this rezoning, the Applicant has proffered to limit the use Of the renovated building and parcel to
office uses and has proffered to limit the maximum number of employees to 25 (could be reduced to
health system constraints on the parcel). The Applicant has also proffered $500 for Fire and Rescue.
The Planning Commission did not identify any issues or concerns with the request and
recommended approval of the application at their May 4, 2016 meeting.

Public Works Department: Paragraph F Drainage of the Impact Analysis should be revised to
indicate that the design Of the Future stormwater management facilities shall meet the requirements Of
Chapter 143 at Frederick County Code & Ordinances.
Frederick County Sanitation Authority: No Comments.
Frederick County Attorney: Please see attached letterfi•nm Roderick B. i41illiams, County Attorney,
dated February 8, 2016.
Frederick County Inspections Department: Change of Use of Residential to Business Use requires a
building permit. Change of use for the facility shall comply with Virginia Existing Building Code.
Other codes that apply are ICC/Ansi A 1 17.1-2009 Accessible and Usable Building and Facilities 2012
Virginia Existing Building Code, and Virginia Energy Code, 2012.
Building shall maintain height and area as allowed under T503 for allowable uses. New occupancy shall
comply with Virginia Mechanical Code. Building structure, including floor loads/spans shall be
evaluated for loading under new use.
Van Accessible parking and unloading shall be required per ANSI A117.1.09. Van signage shall
comply with USBC 1106.8. Accessible route shall be provided to tenant's main entrance. Maximum
slope for accessible route is 1:20 (5%).
Asbestos inspection required for buildings built prior to 1985 that are undergoing renovations.
20% ANSI Rule applies.
Additional comments shall be made at submittal of site plan.
Frederick -Winchester Health Department: The Health Department has no objection as long as a
proper sewage disposal system and well can be found for the office building. The current sewage
disposal system and well are not approved for commercial use.
Frederick County Department of Parks & Recreation: Parks and Recreation has no comments to
add regarding this rezoning request.

The original Frederick County Zoning Map (U.S.G.S. GOI-C Quadrangle) depicts parcel 18-A-41
as being zoned A-1 (Agricultural Limited) District. The County's agricultural zoning districts
were SLlbsegLlClltly combined to form the RA (Rural Areas) District upon adoption Of an
amendment to the Frcderick COL111ty Zoning Ordinance On May 10, 1989. This property
contains one existing residential dwelling.
2) Comprehensive Policy Plan:
The Frederick County 2030 Comprehensive Plan is an Official public document that serves as
the COnlnlunity's guide for making decisions regarding development, preservation, public
facilities and other key components of community life. The primary goal of this plan is to
protect and improve the living environment within Frederick County. It is in essence a
composition Of policies used to plan for tile future physical development of Frederick County.

Staff reported this application is to rezone a total of 2.10 acres from the RA (Rural Areas) District to the
B2 (General Business) District with Proffers, to accommodate office uses within an existing structure
on the property. Staff continued the property is within the limits of the Cross Junction Rural
Community Center which typically consist of small lot residences and commercial uses similar to a

village. Staff dirceted the Planning Commission mclllbcrS to the slap OLltlilllllg the property and tile
surrounding area. Staff reported within the proffer statement there is a limitation On the use of the
renovated building and the rezoned parcel to office uses as shown On the GDP; there is a limit on the
maximum number of employees for the office to 25. Staff noted the proffer also stated this number
could be reduced if the health system approved for the property requires a reduction in that number.
Staff mentioned there is a proffer of $500 to Fire and Rescue payable upon the first building permit.
Staff presented the GDP for the property. Staff concluded the requested B2 designation is limited and
considering parcels surrounding this parcel are zoned B2 and M 1, this request appears to be consistent
with the goals of the 2030 Comprehensive Plan.
Mr. John Lcwis with Painter -Lewis, PLC represented the application. He stated that there was a need
for additional office space to support tfle Cannery located across Cross Junction Road from this site.
Mr. Lewis further stated the existing 11OUSC Oil the property will be renovated once the rezoning is
approved. A Commission Member inquired if the existing drain field will accommodate this use. Mr.
Lewis stated that it would at this time and if there is further expansion it will need to be reviewed again.

Dear John:
I have had the opportunity to review the draft rezoning application for the Shawnee Canning
Company property. This application seeks to rezone 2.103 acres from the RA (Rural Areas)
District to the B2 (Business General) District with proffers. Staff's review comments are listed
below for your consideration:
1. Cross Junction Rural Community Center/2030 Comprehensive Plan. The site is within the
limits of the Cross Junction Rural Community Center. Rural Community Centers typically
consist of small lot residences and commercial uses typical of a village. There are
currently no public utility services within this community center. The requested B2
Designation is limited and considering parcels surrounding this parcel are zoned B2 and
M1, this requested appears to be consistent with the goals of the 2030 Comprehensive
Plan.
2. Proposed Use. The impact statement from the application states that the applicant
"proposes to renovate an existing house to office space to support the client's canning
operations". The proffer does not commit to this use; the proffer should limit the use to
office uses.
3. Proffer Statement. The proposed proffer statement limits the number of employees on
site to 25; clarify what this number is based on. Once the health system has been
approved for this site, the number of permissible employees may be reduced based on
the maximum capacity of the system. The proffer should be modified to state 25 or fewer
if mandated by the approved health system.
4. Access and GDP. The application should include a GDP and limitations on the number of
entrances onto Cross Junction Road.

5. Zoning Violations. Please note that any existing zoning violations on the property must be
alleviated before the rezoning can be scheduled for review by the Planning Commission.
6. Zoning Districts. Update the Impact Analysis to show the RA District as "Rural Areas".
7. Agency Comments. Please provide appropriate agency comments from the following
agencies: Virginia Department of Transportation, Frederick County Department of Public
Works, Frederick County Inspections Department, Frederick County Fire Marshall,
Frederick -Winchester Health Department, the County Attorney and the local Fire and
Rescue Company.
8. Special Limited Power of Attorney. Please have the property owners complete the
special limited power of attorney form which authorizes you to represent them during the
application process. The owner's information on the POA submitted was blank.
9. Fees. The rezoning fee for this application includes a $10,000.00 base fee plus $100.00
per acre. This is based on fees as of April 28, 2008. Fees may change.

PROFFER S TATEMENT
Shawnee Canning Company Office Building-TM#18-A-41
Pursuant to the applicable provisions of the Frederick County Zoning Ordinance, the
undersigned applicant proffers that in the event that the Board of Supervisors of
Frederick County shall approve Rezoning Application # for the rezoning of
parcel TM# 18-A-41 from RA to B2 with proffers, the use and development of the
subject property shall be in strict conformance with the following conditions set forth in
,this proffer except to the extent that such conditions may be subsequently amended or
revised by the owner and such are approved by the Board of Supervisors in accordance
with the Code of Virginia and the Frederick County Zoning Ordinance. These proffers
shall be binding on the owner and their legal successors or assigns.
1.) Limit to Office Lise
The owner proffers to limit the use of the renovated building and rezoned parcel to office
uses as generally shown on the attached General Development Plan.
2.) Limit to Number of Employees
The owner proffers to limit the maximum number of office employees to twenty-five (25)
who can be located on the premises to be constructed on this parcel. This number is
based on the projected needs of the owner. The number of employees could be
reduced if mandated by the approved health system.
3.) Monetary Contribution to Frederick County Service Organizations
The owner will donate or will cause to be paid to the Treasurer of Frederick County the
sum of $500.00 to offset impacts to capital facilities for fire and rescue services. This
sum ' will be paid upon receipt of the first building permit issued subsequent to the
approval of this rezoning for any existing or proposed structure.
The conditions proffered above shall be binding on the heirs, executors, administrators,

L INTRODUCTION
Shawnee Canning Company, Inc. proposes to renovate an existing house to office
space to support the client's canning operations, which are located on the adjacent
properties. The site is located at 231 Cross Junction Road. The parcel contains
approximately 2.103 acres with a two story frame structure on a basement that served
as a residence in the past. The current zoning of the parcel is RA, Rural Areas. The
associated Property Identification number is 18-A-41. The intended purpose of the
rezoning is to obtain a B2 General Business District zoning to enable the applicant to
obtain site plan approval to renovate the existing building to office space and allow for
limited, future expansion. The location of the parcel is shown on the map below.

A. SITE SUITABILITY
DEVELOPMENT OVERVIEW
The site has about 400 feet of frontage on Cross Junction Road. Cross Junction Road
is a local road. It is a spur off of U.S. Route 522 North, a Principal Arterial Road in
Frederick County, VA. Access to the parcel is from Cross Junction Road.
The parcel is bordered on the north by a parcels zoned RA, Rural Areas, on the west
and south by parcels zoned B2, General Business District, and across Cross Junction
Road by a parcel zoned M1, Light Industrial District. All these parcels with the
exception of the RA parcels to the north, are owned by the applicant, Shawnee Canning
Company, Inc.
The owner is applying for a rezoning to B2, General Business District. In accordance
with the description for B2 in the Frederick County Zoning Ordinance §165-603.01, the
intent of this district is to provide large areas for a variety of business, office and service
uses. General business areas should have direct access to major thoroughfares and

should be properly separated from residential areas. Adequate frontage and depth
should be provided. Nuisance factors are to be avoided.
The development of this parcel is limited by the lack of public water and sewer services.
The attached Proffer Statement limits the number of employees associated with the
proposed office use on this parcel to 25. Therefore, limited office use in support of the
existing operations at Shawnee Canning, Co. will not negatively impact the nearby
residential properties.
COORDINATION WITH FREDERICK COUNTY LONG RANGE PLANS
The site is within the rural areas of Frederick County. Additionally, Cross Junction is an
established residential development or Rural Community Center. These centers consist
of small lot residences and commercial uses typical of a village, as found in the
Frederick County 2030 Comprehensive Plan. It is the stated intent of the
Comprehensive Plan to support the agricultural economy in Frederick County. A
rezoning designation of B2 will be in conformance with the existing Rural Community
Center rural area description and objectives, and therefore the 2030 Comprehensive
Plan.
100 YEAR FLOOD PLAIN
FIRM Community Panel Number 51069C0100D shows the subject area to be outside of
any special flood hazard area.
STEEP SLOPES
Steep slopes are defined by the Frederick County Zoning Ordinance as land areas
where the slope exceeds 50%. There are no steep slopes that have been identified on
the site.
LAKES AND PONDS
There are no ponds or lakes on the site.
WETLANDS
There are no wetlands on this site.
SOILS
According to the Soil Survey of Frederick County, the site contains the following soil
types:
• Weikert-Berks Channery Silt Loams: This soil is shallow, 15 to 25 percent slope,
and well drained. It is found on ridges areas and consists of residuum weathered from
shale and siltstone and/or fine grained sandstone.
These soils are typically not prime farmland.

B. SURROUNDING PROPERTIES
The parcel to be rezoned is located in the Gainesboro District of Frederick County. This
is an area that is generally rural in character. The parcel is bordered on the north by a
parcel zoned RA, Rural Areas, on the west and south by parcels zoned B2, General
Business District, and across Cross Junction Road by a parcel zoned M1, Light
Industrial District. All these parcels with the exception of the RA parcel to the north, are
owned by the applicant, Shawnee Canning Company, Inc. Gainesboro District is
considered an established residential development or Rural Community Center.
C. TRAFFIC
The subject property is located on Cross Junction Road. This road consists of about
4,000 feet of a two lane rural road that intersects Route 522 at both ends. Cross
Junction Road has the route number designation of 34-770. Recent traffic counts for the
road show about 120 trips per day as determined by VDOT. The

D. SEWAGE CONVEYANCE AND TREATMENT
This site is outside of the Frederick County Sewer and Water Service Area. The current
use for the site is single family residential. The proposed use is office space. A review
of the existing septic system to serve the new use will be conducted, and an on -site
septic system will be provided by the applicant to satisfy the proposed sewage
demands, and to meet all required County and Virginia Department of Health
regulations. Sewage demand will be limited to 1,000 gallons per day, or about 35
gallons per day per employee with a maximum of 25 employees.
E. WATER SUPPLY
The site is outside the limits of the Frederick County Sewer and Water Service Area. An
existing well will be used for water supply.

F. DRAINAGE
After review of the Frederick County GIS map, it can be determined that this site has
gentle to moderate slopes. The majority of slopes range from 1 percent to 15 percent.
Storm water runoff flows from north to south toward Cross Junction Road along natural
ridge. Upon the site plan development of this site a storm water management plan
would be implemented to control any added flow created by the renovation of this single
family home into an office space and any increased impervious areas. Design of the
future stormwater management facilities shall meet the requirements of Chapter 143 of
Frederick County Code & Ordinances.
G. SOLID WASTE DISPOSAL FACILITIES
The nearest citizens' convenience center facility is Gainesboro Recycling Facility at
5633 N. Frederick Pike, approximately 2.17 miles south. The collection of solid waste
from the proposed office use will be accomplished by a private hauler.
H. COMMUNITY FACILITIES
SCHOOLS
Public schools which are located in proximity to the site include Gainesboro Elementary
School, Indian Hollow Elementary School, and James Wood High School. The
proposed rezoning will not contribute any students to the K-12 school system.
DEVELOPMENT IMPACT MODE.
The Frederick County Development Impact Model (D.I.M.) is utilized to determine the
fiscal impacts of residential rezoning requests. This rezoning requests does not contain
any new residential development, thus there are no capital fiscal impacts which need to
be mitigated.
EMERGENCY SERVICES
Police protection is provided by the Frederick County Sheriffs Department. The nearest
fire and rescue facility is the Gainesboro Volunteer Fire & Rescue Company located at
221 Gainesboro Road.
PARKS AND RECREATION
There will be no additional parks and recreation facilities required to serve this site.
GENERAL GOVERNMENT FACILITES
There will be no additional general government facilities needed to serve this
development.
LIBRARY
There will be no additional library facilities needed to serve this development.

District to the B2 (Business General) District with proffers. Staff's review comments are listed
below for your consideration:
1. Cross Junction Rural Community Center/2030 Comprehensive Plan. The site is within the
limits of the Cross Junction Rural Community Center. Rural Community Centers typically
consist of small lot residences and commercial uses typical of a village. There are
currently no public utility services within this community center. The requested B2
Designation is limited and considering parcels surrounding this parcel are zoned B2 and
M1, this requested appears to be consistent with the goals of the 2030 Comprehensive
Plan.
2. Proposed Use. The impact statement from the application states that the applicant
"proposes to renovate an existing house to office space to support the client's canning
operations". The proffer does not commit to this use; the proffer should limit the use to
office uses.
3. Proffer Statement. The proposed proffer statement limits the number of employees on
site to 25; clarify what this number is based on. Once the health system has been
approved for this site, the number of permissible employees may be reduced based on
the maximum capacity of the system. The proffer should be modified to state 25 or fewer
if mandated by the approved health system.
4. Access and GDP. The application should include a GDP and limitations on the number of
entrances onto Cross Junction Road.

Pursuant to the applicable provisions of the Frederick County Zoning Ordinance, the
undersigned applicant proffers that in the event that the Board of Supervisors of
Frederick County shall approve Rezoning Application # for the rezoning of
parcel TM# 18-A-41 from RA to B2 with proffers, the use and development of the
subject property shall be in strict conformance with the following conditions set forth in
this proffer except to the extent that such conditions may be subsequently amended or

Shawnee Canning Company, Inc. proposes to renovate an existing house to office
space to support the client's canning operations, which are located on the adjacent
properties. The site is located at 231 Cross Junction Road. The parcel contains
approximately 2.103 acres with a two story frame structure on a basement that served
as a residence in the past. The current zoning of the parcel is RA, Rural Areas. The
associated Property Identification number is 18-A-41. The intended purpose of the
rezoning is to obtain a B2 General Business District zoning to enable the applicant to
obtain site plan approval to renovate the existing building to office space and allow for
limited, future expansion. The location of the parcel is shown on the map below.

DEVELOPMENT OVERVIEW
The site has about 400 feet of frontage on Cross Junction Road. Cross Junction Road
is a local road. It is a spur off of U.S. Route 522 North, a Principal Arterial Road in
Frederick County, VA. Access to the parcel is from Cross Junction Road.
The parcel is bordered on the north by a parcels zoned RA, Rural Areas, on the west
and south by parcels zoned B2, General Business District, and across Cross Junction
Road by a parcel zoned M1, Light Industrial District. All these parcels with the

The site is within the rural areas of Frederick County. Additionally, Cross Junction is an
established residential development or Rural Community Center. These centers consist
of small lot residences and commercial uses typical of a village, as found in the
Frederick County 2030 Comprehensive Plan. It is the stated intent of the
Comprehensive Plan to support the agricultural economy in Frederick County. A
rezoning designation of B2 will be in conformance with the existing Rural Community
Center rural area description and objectives, and therefore the 2030 Comprehensive
Plan.

According to the Soil Survey of Frederick County, the site contains the following soil

and well drained. It is found on ridges areas and consists of residuum weathered from
shale and siltstone and/or fine grained sandstone.
These soils are typically not prime farmland.

D. SURROUNDING PROPERTIES
The parcel to be rezoned is located in the Gainesboro District of Frederick County. This
is an area that is generally rural in character. The parcel is bordered on the north by a
parcel zoned RA, Rural Areas, on the west and south by parcels zoned B2, General
Business District, and across Cross Junction Road by a parcel zoned M1, Light
Industrial District. All these parcels with the exception of the RA parcel to the north, are
owned by the applicant, Shawnee Canning Company, Inc. Gainesboro District is
considered an established residential development or Rural Community Center.
C. TRAFFIC
The subject property is located on Cross Junction Road. This road consists of about
4,000 feet of a two lane rural road that intersects Route 522 at both ends. Cross
Junction Road has the route number designation of 34-770. Recent traffic counts for the
road show about 120 trips per day as determined by VDOT. The

D. SEWAGE CONVEYANCE AND TREATMENT
This site is outside of the Frederick County Sewer and Water Service Area. The current
use for the site is single family residential. The proposed use is office space. A review
of the existing septic system to serve the new use will be conducted, and an on -site
septic system will be provided by the applicant to satisfy the proposed sewage
demands, and to meet all required County and Virginia Department of Health
regulations. Sewage demand will be limited to 1,000 gallons per day, or about 35
gallons per day per employee with a maximum of 25 employees.
E. WATER SUPPLY
The site is outside the limits of the Frederick County Sewer and Water Service Area. An
existing well will be used for water supply.

F. DRAINAGE
After review of the Frederick County GIS map, it can be determined that this site has
gentle to moderate slopes. The majority of slopes range from 1 percent to 15 percent.
Storm water runoff flows from north to south toward Cross Junction Road along natural
ridge. Upon the site plan development of this site a storm water management plan
would be implemented to control any added flow created by the renovation of this single
family home into an office space and any increased impervious areas. Design of the
future stormwater management facilities shall meet the requirements of Chapter 143 of
Frederick County Code & Ordinances.
G. SOLID WASTE DISPOSAL FACILITIES
The nearest citizens' convenience center facility is Gainesboro Recycling Facility at
5633 N. Frederick Pike, approximately 2.17 miles south. The collection of solid waste
from the proposed office use will be accomplished by a private hauler.
H. COMMUNITY FACILITIES
SCHOOLS
Public schools which are located in proximity to the site include Gainesboro Elementary
School, Indian Hollow Elementary School, and James Wood High School. The
proposed rezoning will not contribute any students to the K-12 school system.
DEVELOPMENT IMPACT MODEL
The Frederick County Development Impact Model (D.I.M.) is utilized to determine the
fiscal impacts of residential rezoning requests. This rezoning requests does not contain
any new residential development, thus there are no capital fiscal impacts which need to
be mitigated.
EMERGENCY SERVICES
Police protection is provided by the Frederick County Sheriffs Department. The nearest
fire and rescue facility is the Gainesboro Volunteer Fire & Rescue Company located at
221 Gainesboro Road.
PARKS AND RECREATION
There will be no additional parks and recreation facilities required to serve this site.

REZONING #03-16 SHAWNEE CANNING COMPANY, INC.
WHEREAS, Rezoning 403-16 of Shawnee Canning Company, Inc., submitted by Painter -Lewis, Inc.,
to rezone 2.10 acres from RA (Rural Areas) District to B2 (General Business) District with Proffers, final
revision date of March 1, 2016 was considered. The property is located at 231 Cross Junction Road, less
than 0.3 miles from the intersection with US Route 522 North (North Frederick Pike). The property is
further identified with PIN 18-A-41 in the Gainesboro Magisterial District; and
WHEREAS, the Planning Commission held a public hearing on this rezoning on May 4, 2016 and
recommended approval; and
WHEREAS, the Board of Supervisors held a public hearing on this rezoning on May 25, 2016;
and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be
in the best interest of the public health, safety, welfare, and in conformance with the Comprehensive
Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors, that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map to
rezone 2.10 acres from the RA (Rural Areas) District to the B2 (General Business) District with

the Proffer Statement would be in a form to meet the requirements of the Frederick County

1. Proffer 1* Staff should be awaic that ;.while the materials submitted for the proposed
rezoning application indicate that the property owner intends to renovate'an existing

written, would only limit the number of office employees who could be located in a
premises to be constructed on the Property, as opposed to any existing premises on
the Property. Likewise, as written, the Proffer would not limit other by right uses of

Change of Use of Residential to Business Use requires a building permit.
Change of use for the facility shall comply with Virginia Existing Building Code. Other codes that apply
are ICC/ ANSI Al 17.1-2009 Accessible and Usable Buildings and Facilities, 2012 Virginia Existing
Building Code, and Virginia Energy Code, 2012.
Building shall maintain height and area as allowed under T503 for allowable uses. New occupancy shall

i. INTRODUCTION
Shawnee Canning Company, Inc. proposes to renovate an existing house to office
space to support the client's canning operations, which are located on the adjacent
properties. The site is located at 231 Cross Junction Road. The parcel contains
approximately 2.103 acres with a two story frame structure on a basement that served
as a residence in the past. The current zoning of the parcel is RA, Rural Areas. The
associated Property Identification number is 18-A-41. The intended purpose of the
rezoning is to obtain a B2 General Business District zoning to enable the applicant to
obtain site plan approval to renovate the existing building to office space and allow for
limited, future expansion. The location of the parcel is shown on the map below.

A. SITE SUITABILITY
DEVELOPMENT OVERVIEW
The site has about 400 feet of frontage on Cross Junction Road. Cross Junction Road
is a local road. It is a spur off of U.S. Route 522 North, a Principal Arterial Road in
Frederick County, VA. Access to the parcel is from Cross Junction Road.
The parcel is bordered on the north by a parcels zoned RA, Rural Areas, on the west
and south by parcels zoned B2, General Business District, and across Cross Junction
Road by a parcel zoned M1, Light Industrial District. All these parcels with the
exception of the RA parcels to the north, are owned by the applicant, Shawnee Canning
Company, Inc.
The owner is applying for a rezoning to B2, General Business District. In accordance
with the description for B2 in the Frederick County Zoning Ordinance §165-603.01, the
intent of this district is to provide large areas for a variety of business, office and service
uses. General business areas should have direct access to major thoroughfares and

should be properly separated from residential areas. Adequate frontage and depth
should be provided. Nuisance factors are to be avoided.
The development of this parcel is limited by the lack of public water and sewer services.
The attached Proffer Statement limits the number of employees associated with the
proposed office use on this parcel to 25. Therefore, limited office use in support of the
existing operations at Shawnee Canning, Co. will not negatively impact the nearby
residential properties.
COORDINATION WITH FREDERICK COUNTY LONG RANGE PLANS
The site is within the rural areas of Frederick County. Additionally, Cross Junction is an
established residential development or Rural Community Center. These centers consist
of small lot residences and commercial uses typical of a village, as found in the
Frederick County 2030 Comprehensive Plan. It is the stated intent of the
Comprehensive Plan to support the agricultural economy in Frederick County. A
rezoning designation of B2 will be in conformance with the existing Rural Community
Center rural area description and objectives, and therefore the 2030 Comprehensive
Plan.
100 YEAR FLOOD PLAIN
FIRM Community Panel Number 51069CO100D shows the subject area to be outside of
any special flood hazard area.
STEEP SLOPES
Steep slopes are defined by the Frederick County Zoning Ordinance as land areas
where the slope exceeds 50%. There are no steep slopes that have been identified on
the site.
LAKES AND PONDS
There are no ponds or lakes on the site.
WETLANDS
There are no wetlands on this site.
SOILS
According to the Soil Survey of Frederick County, the site contains the following soil
types:
• Weikert-Berks Channery Silt Loams: This soil is shallow, 15 to 25 percent slope,
and well drained. It is found on ridges areas and consists of residuum weathered from
shale and siltstone and/or fine grained sandstone.
These soils are typically not prime farmland.

B. SURROUNDING PROPERTIES
The parcel to be rezoned is located in the Gainesboro District of Frederick County. This
is an area that is generally rural in character. The parcel is bordered on the north by a
parcel zoned RA, Rural Areas, on the west and south by parcels zoned B2, General
Business District, and across Cross Junction Road by a parcel zoned M1, Light
Industrial District. All these parcels with the exception of the RA parcel to the north, are
owned by the applicant, Shawnee Canning Company, Inc. Gainesboro District is
considered an established residential development or Rural Community Center.
C. TRAFFIC
The subject property is located on Cross Junction Road. This road consists of about
4,000 feet of a two lane rural road that intersects Route 522 at both ends. Cross
Junction Road has the route number designation of 34-770. Recent traffic counts for the
road show about 120 trips per day as determined by VDOT. The

D. SEWAGE CONVEYANCE AND TREATMENT
This site is outside of the Frederick County Sewer and Water Service Area. The current
use for the site is single family residential. The proposed use is office space. A review
of the existing septic system to serve the new use will be conducted, and an on -site
septic system will be provided by the applicant to satisfy the proposed sewage
demands, and to meet all required County and Virginia Department of Health
regulations. Sewage demand will be limited to 1,000 gallons per day, or about 35
gallons per day per employee with a maximum of 25 employees.
E. WATER SUPPLY
The site is outside the limits of the Frederick County Sewer and Water Service Area. An
existing well will be used for water supply.

F. DRAINAGE
After review of the Frederick County GIS map, it can be determined that this site has
gentle to moderate slopes. The majority of slopes range from 1 percent to 15 percent.
Storm water runoff flows from north to south toward Cross Junction Road along natural
ridge. Upon the site plan development of this site a storm water management plan
would be implemented to control any added flow created by the renovation of this single
family home into an office space and any increased impervious areas. Design of the
future stormwater management facilities shall meet the requirements of Chapter 143 of
Frederick County Code & Ordinances.
G. SOLID WASTE DISPOSAL FACILITIES
The nearest citizens' convenience center facility is Gainesboro Recycling Facility at
5633 N. Frederick Pike, approximately 2.17 miles south. The collection of solid waste
from the proposed office use will be accomplished by a private hauler.
H. COMMUNITY FACILITIES
SCHOOLS
Public schools which are located in proximity to the site include Gainesboro Elementary
School, Indian Hollow Elementary School, and James Wood High School. The
proposed rezoning will not contribute any students to the K-12 school system.
DEVELOPMENT IMPACT MODEL
The Frederick County Development Impact Model (D.I.M.) is utilized to determine the
fiscal impacts of residential rezoning requests. This rezoning requests does not contain
any new residential development, thus there are no capital fiscal impacts which need to
be mitigated.
EMERGENCY SERVICES
Police protection is provided by the Frederick County Sheriffs Department. The nearest
fire and rescue facility is the Gainesboro Volunteer Fire & Rescue Company located at
221 Gainesboro Road.
PARKS AND RECREATION
There will be no additional parks and recreation facilities required to serve this site.
GENERAL GOVERNMENT FACILITES
There will be no additional general government facilities needed to serve this
development.

Dear John:
I have had the opportunity to review the draft rezoning application for the Shawnee Canning
Company property. This application seeks to rezone 2.103 acres from the RA (Rural Areas)
District to the B2 (Business General) District with proffers. Staff's review comments are listed
below for your consideration:
1. Cross Junction Rural Community Center/2030 Comprehensive Plan. The site is within the
limits of the Cross Junction Rural Community Center. Rural Community Centers typically
consist of small lot residences and commercial uses typical of a village. There are
currently no public utility services within this community center. The requested B2
Designation is limited and considering parcels surrounding this parcel are zoned B2 and
M1, this requested appears to be consistent with the goals of the 2030 Comprehensive
Plan.
2. Proposed Use. The impact statement from the application states that the applicant
'proposes to renovate an existing house to office space to support the client's canning
operations". The proffer does not commit to this use; the proffer should limit the use to
office uses.
3. Proffer Statement. The proposed proffer statement limits the number of employees on
site to 25; clarify what this number is based on. Once the health system has been
approved for this site, the number of permissible employees may be reduced based on
the maximum capacity of the system. The proffer should be modified to state 25 or fewer
if mandated by the approved health system.
4. Access and GDP. The application should include a GDP and limitations on the number of
entrances onto Cross Junction Road.
