No. 82058 Project Description The purpose of this project is the constrution of a new long-term life care facility. The site of approximately 44 acres is located off of U.S. Rt. 522 on Frederick Mall Drive. The construction will consist of three interconnected buildings, loop road and resident and staff parking. Approximately 15 acres will be disturbed during construction. Existing Site Conditions The site has irregular topography with elevations ranging from a high of 842 to a low of about 775. A majority of the site is forested with thick hardwoods. The remaining areas are grass covered with occasional isolated brushy areas within the grassy areas. Numerous rock outcrops occur in three well-defined belts that cross theJ:property in a northeasterly direction. These belts are wooded and are topographically higher than the cleared, grassy areas on either side. The site is divided into three drainage areas which eventually merge to empty into a small stream near U.S. Rt. 522. Adjacent Property Frederick Mall Subdivision borders the Subdivision borders the site to the East, to the South and private lots on Old Fort Soils site to the North, land of the Darlington Clearbrook Woolen Company borders the site Road borders the site to the West. Two general soil horizons and one major rock unit exist over the building area. Topsoil generally blankets the entire site including the proposed access roads and parking areas. The topsoil thickness averages four to eight inches and is thicker in the forested areas except when rock outcrops. The topsoil is basically a low plastic silt with a trace of clay and organics. The bedrock surface is very irregular as a result of differential weathering. The bedrock is predominantly a hard gray limestone of the Conococheague Foundation. Interestingly enough, no groundwater was encountered during soil testing proceedings. The soils engineer indicates that there can be dramatic fluctuations in the groundwater table that are directly related to the hydrological cycles and can occur rather rapidly. He has observed a groundwater rise in the Winchester area of approximately four to ten inches within 24 hours after a four inch rainfall. Critical Erosion Areas There are no critical erosion areas presently. However, there is concern that concentrated runoff from the storm drainage system could pose problems for areas offsite which lie below the project and along the natural Swale which carries runoff from the site. For this reason, a retention/detention basin has been designed to reduce runoff from the project to a point at which there will actually be less water leaving the site after development than there was before development. Erosion and Sediment Control Measures Unless otherwise indicated, all vegetative and structural erosion and sediment control measures shall be constructed and maintained according to minimum standards and specifications of the Virginia Erosion and Sediment Control Handbook. Construction shall be sequenced so that grading operation may begin and end as quickly as possible. 2. The sediment trapping measures shall be installed as a first step in grading. 3. Permanent seeding shall follow finish grading as immediately as possible. See plan for seed mixture. 4. Areas that will not be disturbed shall be flagged clearly. >_ 5. The contractor shall be responsible for installing and maintaining all erosion and sediment control measures. 0 Stormwater Management Calculation of stormwater runoff before and after development indicates that there will be an increase in peak runoff in the major natural channel leaving the site as a result of the development (see attached calculation, page 18). State and local criteria require pre -development runoff from a 10-year storm not be exceeded after construction. This concern, plus the additional request from local authorities to retain runoff from a 5-year storm, led to the design of a retention/detention basin. The most critical situation, with respect to occurrence of a 5-year storm and a 10-year storm drainage calculations (pages 19-31) explain the storm overflow spillway. Maintenance basin volume, would be the back to back. Construction shall be sequenced so that grading operation may begin and end as quickly as possible. 2. The sediment trapping measures shall be installed as a first step in grading. 3. Permanent seeding shall follow finish grading as immediately as possible. See plan for seed mixture. 4. Areas that will not be disturbed shall be flagged clearly. 5. The contractor shall be responsible for installing and maintaining all erosion and sediment control measures. Stormwater Management Calculation of runoff before and after development indicates that there will be an increase in runoff peak as a result of the addition of roof and paved areas to the site. (See attached runoff calculations). As a result of this and other offsite considerations, the stormwater shall be detained and piped to the stream previously mentioned. Maintenance All erosion and sediment control measures shall be checked weekly and after each significant rainfill according to recommendations of the Virginia Erosion and Sediment Control Handbook. NARRATIVE Westminster Canterbury of Winchester Comm. No. 82058 Project Oescription The purpose of this project is the construction of a new long-term life care facility. The site of approximately 44 acres is located off of U.S. Rt. 522 on Frederick Mall Drive. The construction will consist of three interconnected buildings, loop road and resident and staff parking. Approximately 15 acres will be disturbed during construction. Existinq Site Conditions The site has irregular topography with elevations ranging from a high of 842 to a low of about 775. A majority of the site is forested with thick hardwoods. The remaining areas are grass covered with occasional isolated brushy areas within the grassy areas. Numerous rock outcrops occur in three well-defined belts that cross the property in a northeasterly direction. These belts are wooded and are topographically higher than the cleared, grassy areas on either side. The site is divided into three drainage areas which eventually merge to empty into a small stream near U.S. Rt. 522. Adjacent Property Frederick Mall Subdivision borders the site to the North, land of the Darlington Subdivision borders the site to the East, Clearbrook Woolen Company. borders the site to the South and private lots on 01d Fort Road borders the site to the West. Soils Two general soil horizons and one major rock unit exist over the building area. Topsoil generally blankets the entire site including the proposed access roads and parking areas. The topsoil thickness averages four to eight inches and is thicker in the forested areas except when rock outcrops. The topsoil is basically a low plastic silt with a trace of clay and organics. The bedrock surface is very irregular as a result of differential weathering. The bedrock is predominantly a hard gray limestone of the Conococheague Foundation. Interestingly enough, no groundwater was encountered -during soil testing proceedings. The soils engineer indicates that there can be dramatic fluctuations in the groundwater table that are directly related to the hydrological cycles and can occur rather rapidly. The Life Care Concept It is planned that the services and amenities of the Westminster/Canterbury/ Winchester facility will be offered in a life care program, that is, a retirement facility which provides a full continuum of residential living and health care options and a variety of ancillary services on one site. The concept of the multi -level care retirement community has evolved in response to the changing service needs of individuals as they become older. Persons generally enter a retirement community at some time after their 65th birthday. Current entry ages at similar retirement facilities average approximately 75 to 78 years. Admission policies typically require that entrants enjoy good physical and mental health and are able to live in an independent setting with the support services available in the facility. Such services offered by most retirement communities include congregate meals, housekeeping and linen service, transportation, preventative health services, counseling, and opportunities for social interaction. When individuals are no longer able to maintain themselves independently in their apartments, making use of the available residential services, they may be transferred to the health care unit where they are provided with 2 additional services such as personal care or intermediate or skilled nursing care. Care is provided to a resident of a continuing care facility throughout the resident's lifetime. Program of Resident Services A program of services will be included in the basic fee structure paid by each resident. These services include the following program elements: e three meals served daily in the central dining room, with.provision for credit given to persons who desire only one or two meals daily • housekeeping services provided on a bi-weekly basis • all utilities, including local telephone service • common area and living unit maintenance and repair • services to ensure the safety and security of the residents • a social program to include such regularly scheduled activities as educational programs, entertainment, special events, creative arts activities, woodworking, group trips, etc. counseling, spiritual assistance and worship services available at the facility • transportation on a regularly scheduled basis • central switchboard to take messages for residents • 24-hour response to emergency telephone calls 3 • emergency medical services • on -site clinic to provide such health care services as health screening, preventative care, appointments with health professionals, etc. • lifetime personal care and nursing care in semi -private accommodations In addition, several other program elements could be offered on a fee -for -service basis in order to offer residents of WCW a wider range of services to meet their varied needs, but still enable those with limited incomes, or who do not wish to receive such assistance, to pay for only those services which they would utilize. Such service options include: • additional housecleaning services as required • linen and towel service • covered parking • beauty and barber appointments • appointments with health care professionals and medical services on site • pharmaceutical services • laboratory testing • physical therapy and other types of rehabilitative services • private nursing care accommodations • other special services such as private parties, catering, etc. L' 4 Safetv and Securit The design and operation of Westminster/Canterbury/Winchester will be planned to ensure the safety and security of the residents. The plan proposed as part of the retirement community design will require that special attention be paid to security in the residential buildings as well as the other structures planned for the facility. A "front desk" will be incorporated into the design .of the main lobby of the central services building and the health care center. Both the front desk in the central services building and the health care unit desk will function 24 hours a day, seven days each week, while the desk in the central services core will be manned daily during regular business hours. A telephone communication system will enable staff to respond to telephone calls on a 24-hour basis and provide emergency assistance to the residents ' will be planned. Further, each resident apartment, personal care accommondation, and nurisng care room will have a call system device which can be used to signal staff in the event of an emergency. Within the ' apartments, these devices will be located in the bathroom within easy reach of the tub/shower and toilet, in the bedroom(s), and possibly in the kitchen. 1 On the personal care floor and nursing care floors, emergency call devices will be provided in each resident room, in all baths, and in the central bathing rooms. The use of a portable call system will be investigated prior to finalizing the safety and security provisions for the new facility. ' Main entrances to the central services building and health care center will be locked during evening hours. Exterior doors to the multi -story ' residential buildings will remain locked at all times. For security purposes, a two-way communication system will be provided at the main ' entrance to the central services.building to enable residents in their apartments to speak with visitors or delivery persons at the locked doors to the building and to permit only desired individuals access to the building. The activities program is envisioned to include a variety of programs offered on the retirement facility campus, and afford residents opportunities to share in activities and programs available in the community as well. Transportation Transportation will be made available for those residents who do not own their own vehicles or those desiring to take advantage of this service. The facility will operate one vehicle. Emergency medical transportation will be provided by community rescue squards. Emergency Medical and Clinic Service Supervision of medications, support as needed for individuals with chronic ailments which require awareness of the condition and occasional attention, health screening, and the provision of emergency medical assistance will be available for all residents through the health clinic proposed for the facility. Other assistance which might be provided by the clinic on a fee -for -service basis could include pharmacy services, laboratory tests, and provision of personal care to apartment residents who need assistance during temporary illnesses or incapacities. In addition, arrangements with such specialists as podiatrists, dentists, and physical and occupational therapists would also be scheduled during clinic hours, with residents paying for such services as needed, less the portion of the fee defrayed by the individual's Medicare coverage, where applicable. Overview of the Master Plan for Westminster/Canterbury/Winchester The Master Plan for Westminster/Canterbury/Winchester will provide for the development of the multi -level care facility in two phases in order to enable the facility to meet the potential demand for the proposed services and amenities in -an orderly, planned and cost-effective manner. In order to address the potential demand for residential living accommodations in the future, up to 180 additional apartments could be added to the site in building(s) of multi -story construction. Consideration may also be given to expansion of the Health Care Center to provide additional personal care and/or nursing care accommodations, adult day-care, respite care beds, or other health related spaces. To provide access to the property from Route 522, Westminster/Canterbury/Winchester will purchase a 2.9 + acre tract of land at the north end of the property of Frederick Mall Subdivision. Will W/C/W have any affect on local sewer and water? W/C/W plans to tie into an existing 8" sanitary line located in a 20' utility ' easement of the Frederick County Sanitation Authority. Mr. Wellington Jones, of the Frederick County Sanitation Authority, has advised that more than adequate capacity exists, and W/C/W will not create any adverse affect on the system. W/C/W plans to utilize both the City and County's water supply. W/C/W will tie into existing water lines located in Frederick Mall Drive and Old Fort Road. See Schematic Utility Plan, Sheet No. S3.2. Utilizing both water supplies will be more efficient and will facilitate in fire protection. There will not be any adverse effect on either water supply system. 10. What are the fuel sources for W/C/W? Natural gas will be the primary fuel source for heating and other uses for W/C/W. Electricity will be a secondary source. Underground fuel oil storage tanks will be utilized for the emergency generators required for this facility. l 11. How will solid waste disposal be conducted? A private firm shall be contracted with to remove solid waste from the site. Small individual dumpsters will be utilized by the residents and employees. The waste will be removed to the joint City/County landfill. 12 12. Is there an entrance sign planned? The entrance sign will be located appropriately near the entrance to enable motorists to easily locate the site. It will be of a design that complements the Westminster/Canterbury/ Winchester site, and will be lighted for nightime visibility. The sign will be sized to conform to the zoning ordinance. 13. How will W/C/W affect Frederick County's and the City of Winchester's population? It is estimated that the number of increased residents for the City and County from W/C/W will not be significant. The W/C/W population will be approximately 483 persons, and it is anticipated that 75-80% of these residents presently live within 25-30 miles of the site. There will not be a significant increase in population from professional employees moving to the area. 14. Will W/C/W have an affect on schools? W/C/W will not have an affect on area schools. There will not be any children living in this facility. Professional employees moving to the area may have children, but this will not have a significant affect on schools. 15. What affect does W/C/W have on Public Services? W/C/W shall have its own security personnel, therefore relieving local police of some of this responsibility. W/C/W will depend on the local Fire Department for any event that requires their aid. A private firm will be contracted with for solid waste removal to the County landfill. Emergency transportation by rescue squads may be required when emergencies occur. 16. How will ?C W W affect the Count 's economy? // y y W/C/W is a non-profit, tax-exempt organization. W/C/W will provide approximately 104 additional jobs for the community, and increase services I I 13 required, such as groceries and entertainment. (W/C/W desires financing through the local Industrial Development Authority as a "Light Clean Industry".) 17. Will the project lead to a significant increase in air pollution? Operations conducted on the W/C/W site will not generate a significant increase in air pollution. All buildings use efficient, clean sources of energy, therefore, no production of pollutants shall occur. The small amount of traffic increase for the project will not significantly increase air pollution. 18. Will the project lead to a significant increase in water pollution? What is the ability of waste water system to meet demand without degrading water quality? How will water supply be affected? There will not be a significant increase in water pollution. The water supply will be furnished by the City and County. The waste water will be handled by the Frederick County Sanitation Authority. Therefore, water quality and tsupply will not be affected. ' 19. Would the project lead to a significant increase in the ambient noise level for a substantial number of people? Activities on the W C/W site will not generate unusual or significant levels / 9 9 I of noise. In addition, buffer zones of vegetation shall be maintained in and around the site to assist in reducing noise levels created on and off the site. 20. Will the project lead to poor incompatible land use, soil erosion or soil pollution? ' W/C/W is a very compatible land use for this site. Much of the site shall be maintained as naturalistic or upgraded. Soil erosion will be insignificant, ' as the site shall be designed to meet criteria set forth in the Virginia Erosion and Sediment Control Manual. 14 21. Will the project destroy or derogate from an important recreation area? The W/C/W project will not destroy or derogate any recreational areas. W/C/W with its naturalistic and landscaped areas will create a park -like atmosphere. 22. Would the project alter the pattern of behavior of wildlife or interfere with important breeding, nesting, or feeding grounds? The W/C/W project will not significantly interfere with wildlife behavior. In actuality, wildlife will be encouraged to live on the site. This is accomplished by maintaining naturalistic and landscaped areas. 23. Would the project disturb the ecological balance of land or water area, or impact critical areas such as flood plains, unstable soils, steep slopes and aquifer recharge areas? The W/C/W project will not upset the ecological balance of the land. The site is not located in a 100 year flood plain, nor will it contribute to a flood plain. There are not any steep banks on the site to contend with. There will not be any significant affect on the aquifer recharge area. 24. Would the project have significant effect upon areas of historical, archaeological, cultural, or educational scientific significance? The W/C/W site will not have any impact upon areas of historical, archaeological, cultural or educational scientific significance. 25. Will the project have an adverse aesthetic or visual effect? How is common space considered? W/C/W will be carefully designed and site planned to provide a project that is sensitive to the surrounding area, the site itself, and to the future residents and neighbors. P')J Page 2 Westminster -Canterbury Site Plan Planning and Zoning - This site plan is the proposed Phase I for construction of this facility which includes: 120 residential units and a 5-story structure, a 2-story 34,450 square foot central services structure, a 2-story 80 bed health care structure, and required parking. Access is off Frederick Mall Drive from Route 522. All structural, on -site access, and parking facilities meet the requirements of the zoning ordinance. Two major issues were identified at the rezoning hearings and are proposed to be addressed as follows: 1) ACCESS FROM ROUTE 522 A crossover on Route 522 is needed at the intersection with Frederick Mall Drive. Enclosed is a letter from Westminster -Canterbury stating that their intention is to construct this crossover prior to occupancy of the structures. VDH&T has approved this construction and final design will be done at a later date. Frederick Mall Drive is not now in the system and VDH&T has stated the need for upgrading of the surface on that road prior to acceptance. Enclosed is a letter from VDH&T. Westminster -Canterbury and the Frederick Mall Land Trust are now in negotiations on the cost sharing of this proposal. Both the above access improvements will be done as a condition of occupancy. 2) OFF -SITE DRAINAGE There are some residences downstream from this site which have had problems in the past with surface and groundwater from this site and from all other other areas of this drainage basin. Westminster -Canterbury and the staff have discussed a number of proposals to insure that runoff from this site does not exacerbate this problem and these proposals have been discussed with the residents at two meetings. Those measures discussed have been on -site detention with outflow over land at predevelopment rates; on -site detention with outflow into a concrete pipe and piping the outflow at predevelopment rates to a point beyond the downstream residents; and on -site detention and retention with minimal outflow at far below predevelopment rates. Westminster -Canterbury proposes and the staff recommends a structure that would entail on -site retention of a 5-year storm with a minimum outflow through an approximate 4" pipe and detention of a 10-year storm with outflow at predevelopment rates through an 18" diameter standpipe. The minimum 4" outflow should have no perceptible affect on downstream residents and will prevent stagnation of the water in the retention basin. At no time will outflow from a 10-year storm exceed predevelopment rates and outflow from the 4" pipe should be far below predevelopment rates. i Page 3 Westminster -Canterbury Site Plan The plan now shows a major system of storm sewers and drop inlets to collect site stormwater and transfer of this water to a detention basin. The staff recommends that this detention basin design be amended to show a detention -retention design as discussed above. The City of Winchester has approved this site plan with no changes in site design. STAFF RECOMMENDATIONS: Approval, with amendments to the detention basin to incorporate the detention -retention design as proposed above; and with notes to be placed on the site plan stating that a crossover will be contstructed on Route 522 and that Frederick Mall Drive will be upgraded to meet VDH&T standards prior to occupancy of any residential structures. However, without a collective agreement between all the residents, we are unable to meet the intent of the Commission's resolution dealing with the storm drain pipeline. Our specific request will be that the Commission amend its original resolution of June 5, 1985 on Site Plan #011- 85 to delete the portion that deals with the construction on an 18" pipeline and improvements to the two culverts downstream from the pipeline outflow. We felt that signifi- cant progressin a positive direction was obtained. Further- more, we appreciate your comments on ttie easement/agreement draft that had been previously forwarded to everyone. The pipeline does have inherent problems such as the routing, the permanent easement size, and the blastinz. All of which are as much a concern of ours as they are of yours.. We felt the basic and most important topic of our discussion revolved around the blastin- issue and the liability issues associated with that procedure. It has been difficult at best for us to define to the satisfaction of everyone what and when a hold harmless provision would be requested. It is difficult to specify partial liability ever. if such a provision exists under the law. We have wrestled with this problem and frankly have not been able to obtain a reason- able solution. We were pleased to hear the suggestion introduced that we, as a group, might be able to reconsider the construction of the pipeline. We are encouraged by this and have felt all along that the pipeline would or could add to the water problems that currently exist. On the other hand, we realize our responsibility to address your concerns and respond to the direction charted by the Planning Commission. While both alternates (pipeline or no pipeline) have their own inherent problems, we still support the idea of no pipeline for numerous reasons: o No construction on your land o No easement or right-of-way will be necessary o No disturbance of your land including septic lines or secondary drain lines. o No blasting on your property o No entry on your property to maintain/repair line P.O. As you remember, we discussed at our meeting the possibility of trying the originally proposed retention/detention system for a while and if it did not work then install a pipeline. At first glance this appears to be the best approach to take. However, our research indicated that there are less than reliable methods for testing that would con- clude for both parties when, where and who would do what. We can appreciate your position that reserving the right to construct the pipeline be at your disposal but the path to that decision is difficult or non-existent. I realize that this all sounds cumbersome and would appear to be an attempt to get out of what we are being asked to do. I assure you that we are not attempting to avoid any of our obligations. We had hoped that the suggestion to build the retention/detention now and defer the pipeline until later could provide us both an answer to our concerns. But, it appears that it may be impossible. We would be appreciative if you would reevaluate the proposal to retain and detain storm water. This pro�yve�vear al, as you remember, would retain a five-year storm and detain a i&o storm. Water in detention would be discharged from the po a large fanned rock 'rip rap' to spread and dissipate the flow. Utilization of this procedure will provide for you: o No construction or disturbance of your land including blasting o No easements o A suitable and safe method to handle storm water runoff o Reduce potential flooding associated with pipeline if, after your analysis, this plan is unacceptable, we will have to address the pipeline issues head on. We are currently seeking to contact the additional land owners you brought to our attention. As you are aware, these two individuals will need to approve of and agree to a pipeline if it is finally decided to go in that direction. (PHR&A) is pleased to submit this contract for providing construction monitoring and materials testing services on the upcoming Westminster Canterbury of Winchester project. It is our understanding that the Frederick County Depart- ment of inspections and permits will require the services of a third party inspection agency to assure compliance with all State and local code requirements. This will require full-time, daily inspection services at the site, observing all elements of the work in progress, verifying that materials delivered to the site and used in the work comply with the approved plans and specifications, com- pleting daily reports and materials testing and notifying the construction representative of current status on any problems that may have developed. Based on our experience with similar projects in the area, we have assumed that the foundations will be shallow spread footings, structures will be steel columns and trusses, and pre -stress members, earthwork will include significant rock (limestone/dolomite) excavation and compacted fill. We have also assumed that the construction monitoring/testing services will include the following elements: • 0 Patton Harris Rust and Associates - Soil compaction structural fill, floor slabs. Fred Allen July 16, 1985 Page 2 test of all trenches, parking areas, roadway and under all concrete - Concrete testing, consisting of the making, curing and testing of concrete cylinders, air test, unit weight and slump test. - Visual inspection of all footings, floor slab areas, parking areas prior to concrete placement or asphalt paving. - Inspection of structural steel, including both visual observation and checking of all bolted connections with calibrated torque wrench. - Inspection and testing of all underground and concealed plumbing systems for compliance with the Virginia Uniform Statewide Building Code and the approved plans and specs. - Attending progress meetings, county inspection meetings, etc., as may be required. - From visual observations and contractors records, maintan set of as -built drawings for submission to architect at completion of project. To ensure a smooth operation and avoid costly time delays we propose to establish an onsite materials laboratory. It will be equipped to conduct proctor test, nuclear density testing, torque testing, and the making, capping, curing and testing of concrete test specimens. PHR&A proposes to assign Mr. Carroll R. Brown, Jr., C.P.C.A. as our project manager. He will be responsible for all aspects of our quality control effort and will report directly to you or your designated representative. If requested, he will serve as liaison between Westminster Canterbury, S.F.C.S. and County officials. We believe this involvement as a liaison will be very helpful in ensuring a smooth project, especially since he was the building official for the County and knows all the appropriate peoples, codes, procedures and regulations pertinent to the project. Such services would be billed at prevailing hourly rates. We will assign a resident project inspector, who initially will be on the site on a full time basis. This approach has proved very useful to'project managers, in that it provided them a capsulized summary of field construction problems, quality assurance, test results, etc. We propose to use this approach on Westminster Canterbury. As compensation for these services we propose the following fee schedule. If payment is not received within thirty (30) days of the billing date, one and one-half percent (1.5%) of the billed amount will be added for each 30 days that the bill is outstanding from the original invoice date. If any invoice is not paid within sixty (60) days of the original date, PHR&A will be entitled to stop work under this agreement until satisfactory arrangements for payment have been made. If this proposal is accepted within 60 days, the fees outlined in this proposal shall be valid until August 1, 1986. After that time, all unbilled fees will be increased to compensate for rising pay scales and other costs. Such increase shall be based on "cost of living" indexes published by the Bureau of Labor Statistics. Acceptance of this proposal will serve as PHR&A's notice to proceed with the Scope of Work described above. Upon written notification by the Client, PHR&A will immediately stop work on any phase or item of work which the Client may wish to suspend. No. 82058 Dear John: Enclosed please find revised Sheet No. 1 depicting three routes investigated for the off -site storm drainage line from the WCW site. Plan 'A' - We feel that Plan 'A' represents the absolute best route for the 18" storm drain. This route bypasses two culverts and discharges at an endwall below the last residence in the drainage swale. With the detention basin and the discharge point below the residences WCW feels that this solution best reduces any concern the residents have with regard to development of the WCW site and the runoff produced. Plan 'B' - This routing of the storm drainage line is a viable alternative but would require addition of pipe culverts adjacent to the two sets of existing culverts. Plan 'C' - This route for the storm drainage line is quite impract- ical for several reasons. The line does not follow the terrain and would result in deeper trenches and 'flatter' slopes on the pipe in locations. The presence of rock and trees would drastically increase the cost of installation. Blasting the rock is a major concern and although the other routes will encounter rock it will be less than this route. In summary, we contend that Plan 'A' offers the best solution to the line location, Plan 'B' is a feasible alternative and Plan 'C' is not feasible. We have also determined that an open paved ditch or on -grade pipe for any of the solutions is not feasible. If Plan 'A' or 'B' is not acceptable to the residents, then we would desire to request that Frederick County consider allowing WCW to discharge directly from the detention basin to grade. Comm. Westminster -Canterbury of Winchester Frederick Mall Drive Frederick County As requested in your letter dated July 10, 1985 a review of the aboved reference has been made and our comments, recommendations and requirements are as follows. We do not feel the information submitted by you applies in this case. It seems to us the traffic projections you are showing are for peak hours only, which would apply in a traffic light, turning movement situation; however, pavement designs are based on total 24-hour traffic. We do feel we can give some relief as after reviewing all the literature on this subdivision, we find we have overlooked the fact the 120 residences involved were really a retirement community and as such have a drastically different traffic flow than a normal subdivision. We have recomputed the design accordingly. According to the National Cooperative Highway Research Program, Report No. 187, a health care unit generates 2.7 vpd per bed a retirement community generates 3.5 vpd per dwelling. Using these figures and adding the traffic generated on the original design results in a Thickness Index requirement of 12.3. The original design had a Thickness Index of 8.8, so the additional Thickness Index requires in this case would be 3.5 which translates to two (2) inches Bituminous Concrete, Type S-10. It is understood that all depresents now existing must be patched out and all irregularities corrected before placing this two (2) inches bituminous concrete to prevent a failing pavement condition. NARRATIVE Westmi nster Canterbury of Winchester Comm. No. 82058 Protect Oescri ati on The purpose of this project is the construction of a new long-term life care facility. The site of approximately 44 acres is located off of U.S. Rt. 522 on Frederick Mall Drive. The construction will consist of three interconnected buildings, loop road and resident and staff parking. Approximately 15 acres will be disturbed during construction. Existinq Site Conditions The site has irregular topography with elevations ranging from a high of 842 to a low of about 775. A majority of the site is forested with thick hard000ds. The remaining areas are grass covered with occasional isolated brushy areas within the grassy areas. Numerous rock outcrops occur in three well-defined belts that cross the property in a northeasterly direction. These belts are wooded and are topographically higher than the cleared, grassy areas on either side. The site is divided into three drainage areas which eventually merge to empty into a small stream near U.S. Rt. 522.. Adjacent Property Frederick Mall Subdivision borders the site to the North, land of the Darlington Subdivision borders the site to the East, Clearbrook Woolen Company borders the site to the South and private lots on Old Fort Road borders the site to the blest. Soils Two general soil horizons and one major rock unit exist over the building area. Topsoil generally blankets the entire site including the proposed access roads and parking areas. The topsoil thickness averages four to eight inches and is thicker in the forested areas except when rock outcrops. The topsoil is basically a low plastic silt with a trace of clay and organics. The bedrock surface is very irregular as a result of differential weathering. The bedrock is predominantly a hard gray limestone of the Conococheague Foundation. Interestingly enough, no groundwater was encountered during soil testing proceedings. The soils engineer indicates that there can be dramatic fluctuations in the groundwater table that are directly related to the hydrological cycles and can occur rather rapidly. NOW THEREFORE, WITNESSETH: That for and in considera- Lion of the sum of Ten Dollars ($10.00} cash in hand paid, and further in consideration of the covenants and conditions hereinafter set forth, the parties of the first part do hereby grant and convey unto the party of the second part a permanent easement twenty (20) feet in width, together with temporary construction easements ten (10) feet in width adjacent thereto on both sides, from the property currently owned by The Clearbrook Woolen Company, incorporated (to be conveyed to the party of the second part), said property being more particularly described on that certain plat and survey made by Lee A. Ebert, C,L.S., dated April 27, 1984, attached hereto and by reference made a part hereof as containing 14.742 acres. The easement conveyed -hereby shall be across the property of the parties of the first part acquired -by deeds of record in the Office of the Clerk of the -Circuit Court of Frederick County, Virginia, in tie following deed books and page numbers: (a) Geed Book 336 at Page 39; (b) Geed Book 311 at Wage 304; (c) Geed Book 336 at Page 183; (d) Geed Book 311 at rage 296; (e) Geed Book 311 at Page 360; and If) Geed Book 306 at Page 365. The twenty (20) foot wide permanent easement-fer-ei-n conveyed grants to the party of the second part, its successors and assigns, the .perpetual risht to instal.. lay a.nd maintain surface water drainpipes, including the right to go on, over and upon the said permanent easement for the purpose of installing, Maintaining, repairing and replacing the same as needed, and the said temporary construction easements grant to the party of the second part the right to enter upon them to the extent necessary for and during the original construction, installation and laying of the said drainpipes, said temporary easements to expire upon completion of construction of the said drain lines. -2- The parties of the first part shall retain the right to use their land which is subject to the easements acquired herein in any manner which shall not interfere with the use and enjoyment of said rights by the party of the second part, The parties of the first part shall, at all times, have the right to cross over and upon the said easements and to use the surface of the easements in such manner as will neither iniure nor interfere with the construction, operation or maintenance of the drainpipes, except that no building or other structure shall be erected over said twenty (20) foot wide permanent easement unless by mutual consent of the parties or their successors. Whenever the enjoyment of its rights hereunder require the party of the second part to disturb the surface of the ground, it shall be the obligation of the party of the second part to restore the same to its condition prior to being so disturbed at its expehses. The parties hereto further agree as follows: ( I ) The easements herein granted shall be used solely for the installation, maintenance and use of a system limited to the handling or transmission of surface water runoff. (2) The system shall be located below ground level with no installation above ground except for manholes, maintenance access areas at approximately 300 foot intervals. Westminster —Canterbury, its successors, and assigns shall have the duty of maintenance for the system.
