THIS AGREEMENT made this 24 day of

party, parties of the first part; and the County of Frederick, Virginia,
a body corporate, party of the second part;
WHEREAS, in consideration of the approval by the party of the second
part of the Land Disturbing permit for the project located at
Route 7 East
the party, parties of the first part, their heirs and/or assigns, agree
to comply in full with the following provisions:
1. To provide for the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures which
will be implemented during all phases of clearing, grading and
construction as required by the Frederick County Erosion and
Sedimentation Control Ordinance and shown in the approved Erosion
and Sedimentation Control Plan..
2. It is agreed and understood that final approval of completed work
can only be given by the County Engineer or Public Works Director
of Frederick County, or, in their absence, the Frederick County
Administrator.
3. To provide all necessary performance bonds as required by the
Frederick County Code and as set forth in the Bond for Land
Disturbing Permit of which this agreement is a part.
In witness whereof, the party, parties of the first part has, have,
hereunto set his, their hands and seal this 24 day of November ,

BOND FOR LAND DISTURBING PERMIT
KNOW ALL MEN BY THESE PRESENTS, That Orpha G. Martin
hereinafter called the Principal , and Lawrence Ambrogi, Escrow Agent or
Frederick County and Orpha G. Martin (F & M Bank, #051401399-230678)
hereinafter called the Surety, are held and firmly bound unto Frederick
County, Virginia, hereinafter called the County in the full and just sum
of Five hundred and no/100------------------------------ Dollars ($ 500.00 )
law u money o the United States, to which payment will and truly to be
made, the Principal and Surety bind themselves and their heirs, personal
representatives, assigns, and other successors in interest, jointly and
severally, firmly by these presents:
WHEREAS, Principal has executed the foregoing agreement of which this
bond is a part thereof; and,
WHEREAS, Both Principal and Surety desire to guarantee to the County
performance of all of the provisions of the foregoing agreement;
NOW, THEREFORE, The condition of this obligation and bond is such that
if the Principal and/or Surety shall perform all of the provisions of the
foregoing agreement which is incorporated herein by this reference, then
the obligation of this bond is to be void and of no effect; otherwise, it
is to remain in full force and effect.
It is expressly understood that this bond may be cancelled by the Surety at
the expiration of sixty (60) days from the date which the Surety shall have
lodged with the County of Frederick written notice to so cancel, but such
notice may not be lodged earlier than the end of the time period specified
in the agreement or the date of completion of construction and approval
by the County, or in the event that the Principal elects not to complete
the project, until the County gives approval of construction by the
Principal of whatever measures are deemed necessary by the County to
ensure erosion control at the site. This provision, however, shall not
operate to relieve, release or discharge the Surety from any liability
already accrued, or which shall accrue, on erosion and sedimentation
control bonds before the expiration 6f sixty (60) day period.
The Surety and the Principal hereby certify that they will within thirty
(30) days of expiration of the agreement for which this bond is executed,
and is a part thereof, execute a new bond and agreement for a period not
to exceed six (6) months in an amount to be determined by the County to
cover the work remaining and to reflect inflation costs, should the
Principal not be able to complete the bonded work within thirty (30)
days prior to the agreement expiration date.
The Principal and Surety further certify that they will continue to execute
additional new bonds and agreements in amounts to be determined by the
County for subsequent periods of time not to exceed six (6) months until
such time as the work has been completed and approved by the County or
until the County releases the Surety and Principal, whichever is earlier.
Should the Principal and Surety not meet the requirements of all of
the above, it is expressly agreed that the County may elect to execute
the bond for the full amount of the bond and utilize the proceeds as
seen fit by the County in the furtherance of the project which this
Bond and agreement cover.
Provided, that in no event shall the liability of the Surety hereunder
exceed the penal sum of this bond; and,
Further provided that the Surety, by execution hereof, expressly waives
any right he, they or it may have to review and approve any revisions
to the plans, profiles, and specifications referred to in the agreement.

EROSION & SEDIMENTATION CONTROL PLAN
1. Baled straw sedimentation barriers to be placed around topsoil stockpile.
Establish temporary cover by seeding and/or mulching stockpiled material.
2. Baled straw sedimentation barriers, properly staked and tied, to be placed
in all ditch lines and at toe of all fill areas.
3. Erosion control stone (VDH-EC-1) to be placed at culvert as shown.
4. All disturbed soil areas not paved to be hydroseeded within 30 days of
final grading with Kentucky 31 Tall Fesque @ 100 lbs./acre and fertilized
10-10-10 @ 500 lbs./acre. Seeding dates March 15 to April 15 and
August 15 to September 15.
5. Stabilize all streets and parking areas within 30 days of final grading
with base course crushed stone.
6. All work shall be done in accordance with Virginia Erosion & Sedimentation
Control Handbook.
SURFACE DRAIN
Surface water will drain to Abrams Creek through a storm sewer system.
