SUBJECT: Apple Tractor Site Plan
The Board of Supervisors, at their regularly scheduled meeting of
August 27, 1980, determined that tractor sales is a permitted
use in a B-2, Business -General Zone.
The responsibility of the Planning Commission regarding the
Apple Tractor Site Plan will be to review the technical merits
of the plan.
Since the Board has determined that it is a permitted use in a
B-2 Zone, discussion should only be directed to the matter dealing
with the site.
If you have any questions regarding this matter prior to the
Planning Commission meeting, please do not hesitate to contact me.

Heathcraft Homes in the Back Creek Magisterial
District. (Please see attached map.)
Adjacent Land
Use & Zoning: Commercial and vacant land use, and commercial and
residential zoning.
Proposed Use &
Improvements: Construct 8400 square foot shop and office for retail
sales, 19 paved parking spaces and entrance.
Review Evaluations:
Frederick -Winchester Health Department - Satisfactory
Va. Dept. of Highways and Transportation - Location
of entrance as shown is marginal: Recommend shifting
the entrance as far north as possible to improve sight
distance because of poor vertical and horizontal curves
in that area.
Department of Public Works - Satisfactory.
Department of Inspections - Structure must comply
with mixed use occupancy requirements. Specific items
will be noted on the plans. Advise owner to contact
Department of Inspections to arrange for pre -construction
meeting.
Zoning - Satisfactory. Applicant should understand
that no outside repair or major motor or body repair
is permitted in this zone.
Planning - Satisfactory.
Staff Recommendations:
Staff recommends approval provided applicant meets requirements
of the Virginia Department of Highways and Transportation.

Re: Farm Tractor Dealership as a Permitted Use in Business,
General District B-2 Zone
Dear John:
Considering the language in the Statement of Intent of Section
21-108, of Article XI of the Frederick County Zoning Ordinance
and also that Section 21-109 (b) of said Ordinance specifically
provides that motor vehicle sales and service is a permitted
use in Business, General District B-2, it would be my opinion
that a farm tractor dealership, which appears to be less offensive
than most of the other permitted uses in this category, would
clearly be a permitted use within this particular zone.
If you desire any further clarification of this opinion or have
any questions, please do not hesitate to contact me.

by and between Apple Tractor Co.
party, parties of the first part; and the County of Frederick, Virginia,
a body corporate, party of the second part;
WHEREAS, in consideration of the approval by the party of the second
part of the Land Disturbing permit for the project located at
Route 642, approximately one mile south of the Interstate 81
and Route 37 interchange.

to comply in full with the following provisions:
1. To provide for the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures which
will be implemented during all phases of clearing, grading and
construction as required by the Frederick County Erosion and
Sedimentation Control Ordinance and shown in the approved Erosion.

2. It is agreed and understood that final approval of completed work
can only be given by the County Engineer or Public Works Director
of Frederick County, or, in their absence, the Frederick County
Administrator.
3. To provide all necessary performance bonds as required by the
Frederick County Code and as set forth in the Bond for Land
Disturbing Permit of which this agreement is a part.

BOND FOR LAND DISTURBING PERMIT
KNOW ALL MEN BY THESE PRESENTS, That Apple Tractor Company
hereinafter called the Principal, and Lawrence Ambrogi, Escrow Agent for
Frederick County and Apple Tractor Co. (C & S Bank, CD#16594
hereinafter called the Surety, are held and firmly bound unto Frederick
County, Virginia, hereinafter called the County in the full and just sum
of One thousand and no/100---------------------- Dollars ($ 1,000.00 ),
law u money o the United States, to which payment will and tru y to be
made, the Principal and Surety bind themselves and their heirs, personal
representatives, assigns, and other successors in interest, jointly and
severally, firmly by these presents:
WHEREAS, Principal has executed the foregoing agreement of which this
bond is a part thereof; and,
WHEREAS, Both Principal and Surety desire to guarantee to the County
performance of all of the provisions of the foregoing agreement;
NOW, THEREFORE, The condition of this obligation and bond is such that
if the Principal and/or Surety shall perform all of the provisions of the
foregoing agreement which is incorporated herein by this reference, then
the obligation of this bond is to be void and of no eff ect; otherwise, it
is to remain in full force and effect.
It is expressly understood that this bond may be cancelled by the Surety at
the expiration of sixty (60) days from the date which the Surety shall have
lodged with the County of Frederick written notice to so cancel, but such
notice may not be lodged earlier than the end of the time period specified
in the agreement or the date of completion of construction and approval
by the County, or in the event that the Principal elects not to complete
the project, until the County gives approval of construction by the
Principal of whatever measures are deemed necessary by the County to
ensure erosion control at the site. This provision, however, shall not
operate to relieve, release or discharge the Surety from any liability
already accrued, or which shall accrue, on erosion and sedimentation
control bonds before the expiration of sixty (60) day period_
The Surety and the Principal hereby certify that they will within thirty
(30) days of expiration of the agreement for which this bond is executed,
and is a part thereof, execute a new bond and agreement for a period not
to exceed six (6) months in an amount to be determined by the County to
cover the work remaining and to reflect inflation costs, should the
Principal not be able to complete the bonded work within thirty (30)
days prior to the agreement.expiration date.
The Principal and Surety further certify that. they will continue to execute
additional new bonds and agreements in amounts to be determined by the
County for subsequent periods of time not to exceed six (6) months until
such time as the work has been completed and approved by the County or
until the County releases the Surety and Principal, whichever is earlier.
Should the Principal and Surety not meet the requirements of all of
the' -above, it is expressly agreed that the County may elect to execute
the bond for the full amount of the bond and utilize the proceeds as
seen fit by the County in the furtherance of the project which. this
Bond and agreement cover.
Provided, that in no event shall the liability of the Surety hereunder
exceed the penal sum of this bond; and,
Further provided that the Surety, by execution hereof, expressly waives
any right he, they or it may have to review and approve any revisions
to the plans, profiles, and specifications referred to in the agreement_
