Approval of Rezoning Application #003-86 of Robert T. and Barbara G. Ganse to
rezone 1.680 acres from RP (Residential Performance) to B-2 (Business General)
for an existing restaurant and additional parking. This property is designated
as Parcel 112—C on Tax Map 54 and is located at 1 Colonial Heights, 1/4 mile east
of Winchester and south of Route 7 in the Stonewall Magisterial District.

to be rezoned to B-2 (Business General)
LOCATION: 1/4 mile east of Winchester and south of Route 7
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Residential Land Use and RP (Residential
Performance) Zoning.
PROPOSED USE AND IMPROVEMENTS: An existing restaurant facility and additional
parking.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objections to rezoning. This
street is not in our Secondary System; however, if it should be added, a
commercial entrance permit would be required prior to adding this street to
the Secondary System.
Sanitation Authority - Agency has no comments.
Greenwood Fire Company - We do not have any problem with the rezoning of this
property at this time.
Inspections Department - Proposed construction to be designed and built in
accordance with the Virginia Uniform Statewide Building Code and applicable
referenced standards.
Planning and Zoning - It is the opinion of the staff that there was an
intention at some level that at least part of this property be rezoned to
B-2, as a part of the Comprehensive Rezoning. Also, a site plan was approved
for a B-2 use on this site. In addition, the following considerations have
been examined:
1) COMPREHENSIVE PLAN AND DEVELOPMENT PATTERNS
The proposed B-2 site is located on a major arterial, at an interstate
interchange, and in an area designated for urban development. The site
contains a major nonconforming business in the vicinity of extensive
commercial areas.

2) IMPACTS ON SURROUNDING PROPERTIES
The site does abut properties with existing dwellings. Expansion of B-2
uses on the site might have some negative impact on surrounding
residential properties.
3) SITE PLANNING
The rezoning includes lands currently used for parking and the restaurant.
The land is suitable for those uses.
STAFF RECOMMENDATION: Approval, for the following reasons:
1) There apparently was some intent to rezone this property at the time of the
Comprehensive Rezoning.
2) A site plan was approved for the current use as required in any business zone.
2) The site is located in an urban area, in the vicinity of existing commercial
areas, serving an interstate interchange, and on an arterial highway.

THIS QUITCLAIM DEED made and dated this _� day
Of 1984. by and between ORPHA G. MARTIN, Widow,
and NORMAN W. GARRISON, parties of the first part, ROBERT T.
GANSE and BARBARA G. GANSE, his wife, parties of the second
part, and SHASTA B. GARRISON, party of the third part.
WHEREAS, by deed of Orpha G. Martin, Widow, dated
January 5, 1962, recorded in the Clerk's Office of the Circuit
Court of Frederick County, Virginia, in Deed Book 544, at Page
118. she conveyed to Robert T. Ganse and Barbara G. Ganse as
tenants in common a certain tract of land containing 1.660
acres, more or less, and a 25-foot right-of-way across lands
retained by her in Stonewall Magisterial District, Frederick
County, Virginia; and
WHEREAS, in the aforesaid deed Orpha G. Martin
reserved unto herself during her lifetime and unto Norman W.
Garrison upon her death the right to repurchase the property
under certain circumstances; and
WHEREAS, parties of the second part have requested
parties of the first part to release and quitclaim any right
they'may have to repurchase said property; and
WHEREAS, they have agreed to release and quitclaim
any such right to repurchase said property.
NOW, THEREFORE, in consideration of the sum of Ten
Dollars ($10.00) and other good and valuation consideration.
the.receipt of all ofwhich is hereby acknowledged, the
parties of the first part hereby remise, release forever and
quitclaim unto parties of the second part, their heirs, suc-
nessors and assigns. all of their rights to repurchase the
property described in that certain deed dated'January 5, 1982,
recorded in the Clerk's Office of the Circuit Court of Fred-
erick County. Virginia,,in Deed Book 544, a,t Page 118.
