Spangler to rezone 5 acres from A-1 (Agricultural —Limited) to B-2 (Business General) for a convenience store, gas station, and snack bar. This property is designated as Parcel 47 on Tax Map 11 and is located 18 miles north of Winchester on the west side of Route 522 in the Gainesboro Magisterial District. Spangler 5 acres zoned A-1 (Agricultural General) to be rezoned to B-2 (Business General) (application was amended by applicant to rezone from B-1 to B-2) LOCATION: 18 miles north of Winchester on the west side of Route 522. MAGISTERIAL DISTRICT: Gainesboro ADJACENT LAND USE AND ZONING: Agricultural land and scattered residences zoned A-1 (Agricultural Limited) PROPOSED USE AND IMPROVEMENTS: Convenience store, gas station, and snack bar. REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. However, the entrance must be brought to the VDH&T minimum commercial entrance standards. Health Department - No objections. Existing drainfield appears to be adequate for present useage. The applicant will have to contact this department again before any new construction can take place. Reynolds Store Fire Company - No comment. Inspections Department - Proposed construction to be in accordance with the Virginia Uniform Statewide Building Code and applicable adopted standards. Planning and Zoning (March 5, 1986) - Comprehensive Plan - The Comprehensive Plan designates the area in question for rural development. On page 17 of the Plan, the policy to "maintain the rural character of these areas of the County in which urban development is not proposed" is listed. This would suggest that in this area, outside of an identified Rural Community Center, only the types of business allowed under the Agricultural Zoning Districts should occur. The current non -conforming use could be made conforming and could be expanded with a conditional use Page 2 Spangler Rezoning permit as a country general store. However, the rezoning would be necessary to establish a restaurant. This rezoning could set a precedent for similar rezonings along Route 522 which might be undesirable or hazardous. It also could lead to continued undesirable strip development patterns and add to the deficiency of the highway. Spot Zoning and Legal Issues - Spot Zoning is not just a policy adopted by the Planning Commission, but is also a legal doctrine that has been adopted by Virginia courts. The primary test that has been adopted by the courts is that spot zonings are illegal if they solely serve the private interests of the applicant, but are legal if the purpose of the zoning is to further the welfare of the entire County. In general, Virginia courts have presumed spot zonings to be legal if they are based on some rational or consistent policy or plan for the entire County. No overall justification has yet been provided in this case to overide the concern for illegal spot zoning. The fact that it is a non -conforming use should not be used by itself to justify the rezoning. There are many other non -conforming uses which the County may not wish to rezone. There might be some policy which provides broad grounds to overcome concerns about illegal spot zoning, but that has not yet been made clear in this case. It is particularly important to remember that rezonings are unconditional. Once a rezoning to B-2 is granted, the applicant and subsequent owners have a right to undertake any of the uses allowed in that district. In this case, the B-2 zoning would allow motels, restaurants, and motor vehicle sales. The basic idea behind the spot zoning policy is that such spot zonings should not be granted unless all of the allowed uses would be appropriate and unless the uses would be appropriate on other similarly situated properties. Therefore, the question of whether this would constitute illegal spot zoning remains to be answered. Traffic Safety - The site is located immediately to the east of a rise in Route 522. This means that the sight distances are poor from the site looking west and for vehicles approaching the site from the west. Increases in traffic entering and exiting the site should not be encouraged. STAFF RECOMMENDATIONS FOR MARCH 5, 1986: Denial. This recommendation is based on the following factors: 1. Substantial business use can continue on the site as a non -conforming use or with a conditional use permit. 2. No general justifications have been given to overcome the concerns of the adopted policy on spot zoning. Will it be desirable to rezone other similar sites along Route 522? 3. The more intensive uses of the B-2 category for this site may result in more vehicular trips and turning movements, increasing traffic hazards. Roi Spot Zoning Adopted Policy for the Frederick County Planning Commission Now and in the future, the prime objective of the Planning Commission is to develop plans and major policy recommendations concerning the development of the County. Any activity which distracts from these objectives should be limited to the minimum consistent with effective performance of administrative functions which are secondary obligations of the Commission and its staff. Proposals for minor zoning amendments fall within this secondary category. An inordinate number of these involve spot zoning, which has the following characteristics: 1. Individuals seek to have property rezoned for their own private uses. 2. Usually the amount of land involved is small and limited to one or two ownerships. 3. The proposed rezoning would give privileges not generally extended to property similarly located in the area. 4. Applications usually show little or no evidence of, or interest in, the effect on surrounding property, whether all uses permitted in the classification sought are appropriate in the location proposed, or conformity to a comprehensive plan or to comprehensive planning principles. The following policy is, therefore, adopted by the Planning Commission. No proposed zoning amendment will receive favorable recommendation unless: 1. The proposal will place all property similarly situated in the area in the same category, or in appropriate complementary categories. 2. There is convincing demonstration that all uses permitted under the proposed district classification would be in the general public interest and not merely in the interest of an individual or small group. 3. There is a convincing demonstration that all uses permitted under the proposed district classification would be appropriate in the area included in the proposed change. (When a new district designation is assigned, any use permitted in the district is allowable, so long as it meets district requirements, and not merely uses which applicants state they intend to make of the property involved.) -2- 4. There is convincing demonstration that the character of the neighborhood will not be materially and adversely affected by any use permitted in the proposed change. 5. The proposed change is in accord with the comprehensive plan and sound planning principles.
