Approval of Rezoning Request #015-85 of Winchester Rendering Company for 5.207
acres zoned A-1 (Agricultural Limited) to be rezoned to M-2 (Industrial General)
to construct an addition to current office building, a separate truck maintenance
facility, and a light manufacturing facility, off of Route 679, in the Gainesboro

. THIS DEED, made and dated this 5th day of February,
1976, by and between Robert J. Smith and Sara Y. Smith, his wife;
Gerald F. Smith and Dolores S. Smith, his wife; Vivian S. Royston
divorced; Wayne P. Smith, single; Leo J. Smith and Sandra K.
Smith, his wife; and Myrna S. Shirley and P. Stephen Shirley,
her husband, being the remaining heirs with an interest in the
hereinafter described real estate of Clyde A. Smith, deceased,
hereinafter called the Grantors, and Winchester Rendering Company
Inc., party of the second part hereinafter called the Grantee.
WHEREAS, the hereinafter described realty being a
portion of a larger tract or parcel of land, was conveyed to
Clyde A. Smi t.h,. and Grace M. Smith, his wife, with right of
survivorship, by deed of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, in Deed Book 329
at Page 264 in two tracts, the first containing 102 acres, and,
the second containing 50 acres, more or less; and,
WHEREAS, Grace M. Smith died testate, and by her
last will and testament of record in the said Clerk's Office in
Will Book 60, at Page 231, she devised all of her right, title
and interest in the hereinafter described property to her
husband, Clyde A. Smith; and,
WHEREAS, Clyde A. Smith died testate after his wife,
and by his last will and testament of record in the said Clerk's
Office in Will Boo),Z , at Page , he devised said real estate
in equal shares to his children, Leo Smith, Wayne Smith, Myrna
Smith Stinnett, now Myrna Smith Shirley, Vivian Smith Royston,
Loretta Smith Minghini, Robert J. Smith and Gerald F. Smith; and,
WHEREAS, by deed dated January 12, 1973, Loretta
Smith Minghini and her husband conveyed all of their right,

title and interest in the aforesaid two tracts of land to
Dolores S. Smith, wife of Gerald F.•.Smith, by deed of record in
said Clerk's Office in Deed Book 403, at Page 1111 and,
WHEREAS, a partition suit was instituted by Vivian
Smith Royston, and the parties have arrived at a settlement of
the same.
NOW, THEREFORE, THIS DEED WITNESSETH: That for and
in consideration of the sum of Ten Dollars ($10.00) cash in hand
paid and other good and valuable considerations, receipt of all
of which is hereby acknowledged, the Grantors do hereby grant,
bargain, sell and convey, unto the Winchester Rendering Company,
Inc., a Virginia corporation, in fee simple, and with general
warranty of title, all of their right, title and interest in and
to the hereinafter described property, to -wit:
All of that certain tract or parcel of land
lying and being situate on the Northern side
of Indian Hollow Road, Gainesboro District,
otherwise designated as Virginia Secondary Route
No. 679, Frederick County, Virginia, and con-
taining 165.155 acres according to the plat and
survey of J. R. Nicely, C.L.S. dated January 27,
1976, which plat and survey description is
attached hereto and made a part hereof for a
more perfect description of the land herein
conveyed. Reference is made to the aforesaid
deeds and the references therein contained, and
the wills and the references therein contained
for a more particular description of the land
herein conveyed.
The Grantors covenant that they have the right to
convey the within described property; that the Grantee shall have
quiet possession of said land free from all encumbrances, and
that the Grantors will warrant generally and defend the title
thereto.
