Health Department - No objection as long as property is served by central water and sewer. Sanitation Authority - Bids for the construction of water and sewer facilities which will serve this property will be received on October 7, 1987. Provided bids are within estimates, a contract will be awarded with completion in fall of 1988. Greenwood Fire Company - No problem from the fire protection aspect of the rezoning of this property, with the understanding that water must be available before building starts. Inspections Department - This request for rezoning shall comply to the sections of the BOCA Basic Buildings Code when Use Groups are determined and building plans have been submitted. Planning and Zoning - The proposal is to rezone two parcels in the Upper Valley Business Park. Parcel B (10.5 acres) is to be zoned from A-2 to B-2 and Parcel D (7.2 acres) is to be rezoned from M-1 to B-2. REZONING REQUEST #020-87 C. Douglas Adams and Fern L. Adams Parcels B & D The Upper Valley Business Park master plan, which has been submitted for approval, will include industrial, office, commercial, and residential uses and is, therefore, a new concept for Frederick County. However, the staff would strongly support this kind of master planning for multiple use areas. Both parcels in question will have frontage on the proposed relocated Bufflick Road. The applicant has offered the right-of-way for the relocation, the general concept has been approved by the County and VDOT, and design of the road is underway. Proposed commercial areas will probably generate more traffic on a per acre basis than industrial areas. However, much of this traffic will probably be generated within the industrial and airport areas. Parcel D will be adjacent to the airport terminal and will probably provide commercial services in relation to airport activities. Under the proposed plan, the rezoning of this parcel will have little impact on existing residences because of the location of the parcel in relation to residences and because access will not be through residential areas. Parcel B is immediately adjacent to a row of dwellings along Old Bufflick Road. The B-2 regulations do not require buffers or screening in relation to adjacent residential areas. If the intention is to provide for office uses on this parcel, B-3 or M-1 zoning might be more appropriate because of the buffer and screening requirements in those districts. It would appear to be appropriate to include some commercial areas in a residential/industrial plan of this size. There is a need to take measures to avoid impacts on the residences located to the rear of Parcel B. STAFF RECOMMENDATIONS: Approval of Parcel D. Denial of Parcel B.
