44.127 acres (Parcel A) from A-2 (Agricultural General) to RP (Residential
Performance) for single-family and townhouse residential development. This
property is located east of Route 522 South and south of Route 645 (Bufflick
Road) in the Shawnee Magisterial District.

LOCATION: East of Route 522 South and South of Route 645 (Buff lick Road)
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Vacant land and residences zoned A-2 (Agricultural
General) and residences zoned RP (Residential Performance)
PROPOSED USE AND IMPROVEMENTS_ Single-family residential, including townhouses
REVIEW EVALUATIONS:
Transportation Department - No objection to rezoning.
Health Department - No objection as long as property is served by central
water and sewer.
Sanitation Authority - Bids for the construction of water and sewer
facilities which will serve this property will be received on October 7,
1987. Provided bids are within estimates, a contract will be awarded with
completion in fall of 1988.
Greenwood Fire Company - The Greenwood Volunteer Fire Company has no problem
from the fire protection aspect of the rezoning of this property, with the
understanding that water must be available before building starts.
Inspections Department - The request for rezoning shall comply to Section
309.0, Use Group R - Residential Buildings, of the BOCA Basic National
Building Code 1984.
Planning and Zoning - The proposal is to rezone a 44 acre parcel to RP that
is included in the Upper Valley Business Park master plan, which has been
submitted for approval. The master plan will include industrial, office,
commercial, and residential uses and is, therefore, a new concept for
Frederick County. However, the staff would strongly support this kind of
master planning for multiple use areas.
REZONING REQUEST #019-87
C. Douglas Adams and Fern L. Adams
Parcel A
The parcel in question, if rezoned, would provide a residential area between
existing residential areas zoned RP and A-2 and the proposed industrial
areas. This could provide an appropriate transition of uses within the
confines of the master plan.
The proposed RP area would be located on the north and south side of
relocated Buff lick Road proposed on the master plan. The applicant has
offered the right-of-way, for the relocation, the general concept has been
approved by the County and VDOT, and design of the road is underway. Since
Bufflick Road is a collector and the relocated road will be a major
industrial access road, it would be necessary to orient residential areas
from this road and to provide buffers along the road.
Buffers will also be necessary between the industrial and residential areas.
If multi -family dwellings are proposed in this area, buffers will be required
in relation to surrounding residential areas.
The proposed site contains some areas of steep slopes along drainage ways and
some areas of prime agricultural soils. However, most of the site consists
of relatively level lands, suitable to development.
National experience shows that residential development is not appropriate
where airport noise is above certain levels. Delta Associates, P.E., Inc.,
in preparing environmental impact information in association with master
plans for airport improvements, has projected potential noise levels for
areas around the airport for the year 2007. This site is located beyond the
areas with projected critical noise levels (Ldn 65).
Sewer and water service has been provided to this site and significantly
improved access is proposed. It is obvious that these improvements make this
site suitable for urban development. RP zoning would appear to provide an
appropriate transition of uses between existing residential areas and
proposed industrial areas.
STAFF RECOMMENDATIONS: Approval.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous Approval.

the first part, hereinafter called the Grantors; C. Douglas
Adams and Fern L. Adams, his wife, of the other part,
hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum of
Ten Dollars ($10.00), cash in hand paid and other valuable
consideration, receipt whereof is hereby acknowledged, the
Grantors do grant and convey, with General Warranty and with
English Covenants of Title, unto the Grantees, as tenants by
the entirety, in fee simple, with survivorship as at common
law, together with all rights, rights of way, privileges and
appurtenances thereto belonging, the following three tracts of
land (which correspond to the three parcels of land shown on
the attached plat):

East of TRACTS TWO and THREE, about two miles
South of Winchester, in Shawnee Magisterial
District of Frederick County, Virginia; and
being the same property conveyed to Warren G.
Teates and Margaret A. Teates by R. A. Kessling
and wife by deed dated September 30, 1965 and
recorded in the Clerk's Office of the Circuit
Court of Frederick County, Virginia in Deed
Book 315, at Page 161.
TRACT TWO: All of that certain tract of
land lying on the East side of Route 522 about
1 1/2 miles South of Winchester in Shawnee
Magisterial District of Frederick County,
Virginia, fronting on said Highway a distance
of 75 feet, and extending back Eastward between
parallel lines a distance of 300 feet, and
being the same land designated as Lot No. 9 in
Block 4 on the Plat of the Lela M. Miller
Subdivision which is recorded in the aforesaid
Clerk's Office in Deed Book 174, at Page 395;
and being one of the two lots conveyed to
Warren G. Teates and Margaret A. Teates by
