THIS DEED made and dated this 1st day of July, 1987,
-by and between GILBERT T. BROWN, widower, party of the first
part, hereinafter called the Grantor, and EASTERN FREDERICK
'DEVELOPMENT CO., a Virginia Partnership, party of the second
part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum
of Ten ($10.00) Dollars, cash in hand paid, and other good and
valuable consideration, the receipt of which is hereby acknowl-
edged, the Grantor does hereby grant and convey with general
warranty of title unto the Grantee, in fee simple, as specific
partnership property, pursuant to Title 50, Code of Virginia,
1950, as amended, all of that certain lot or parcel of land,
together with the improvements thereon and the appurtenances
thereunto belonging, lying and being situate on the North and
South side of Road No. 659, about 1 1/4 miles East of
Winchester, in Shawnee Magisterial District, Frederick County,
Virginia, containing 131.368 Acres, and more particularly
described by plat and survey drawn by H. Bruce Edens, C.L.S.,
dated June 22, 1987, attached hereto and by this reference
made a part hereof as if set out in full; and being the major
portion of the same property conveyed to Gilbert T. Brown and
Margaret L. Brown, his wife, by deed dated June 28, 1943, from
Tillie Brown, widow, et al, of record in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia in
Deed Book 187 at Page 319; the said Margaret L. Brown died
intestate, without issue, on March 8, 1971, survived by
Gilbert T. Brown, the Grantor herein, as her sole heir at law.
Reference is made to the aforesaid plat and deed for a more
particular description of the property herein conveyed.

This conveyance is made subject to all easements,
rights of way and restrictions of record affecting the subject
property.
The Grantor hereby covenants that he has the right to
convey to the Grantee, that the Grantee shall have quiet and
peaceable possession of the said property, free from all liens
and encumbrances, and he will grant such further assurances of
title as may be requisite.

The accompanying plat represents a boundary survey of a
portion of the land conveyed to Gilbert T. Brown and
Margaret L. Brown, his wife, by deed dated June 28, 1943,
and recorded in the Office of the Clerk of the Circuit
Court of Frederick.County, Virginia in Deed Book 187 at
Page 319, the said Margaret L. Brown having subsequently
died intestate on March 8, 19.h, survived by Gilbert T.
Brown who was her sole heir at law. The said Gilbert T.
Brown has since transferred the said land in his name by
affidavit which is recorded among the land records of the
aforesaid county and state in Deed Book 507 at Page 352.
The said portion of land fronts both sides of Virginia
Secondary Route 659 near its intersection with Route 656 in
Shawnee District, Frederick County, Virginia, and is more
particularly described by metes and bounds as follows:
TRACT ONE: Beginning at (1) an iron pin set in the
northerly right of way line of Route 659, a corner to the
Stultz land; thence with the easterly line of the said
Stultz land, N17043'38"E - 732.42 feet (passing through a
post at a fence corner at 3.52 feet) to (2) a 40" hickory
tree in the southerly line of Wilkins Development Company

(Agricultural General)
PROPOSED USE AND IMPROVEMENTS: Residential dwellings
REVIEW EVALUATIONS:
Department of Transportation ^ No objection to rezoning, however, prior to
doing any work on the State right-of-way a Commercial Entrance permit must be
applied for and approved.
Sanitation Authority •- Sewer will be available to site when the Opequon plant
is in operation. Water facilities are available in the vicinity of the
intersection of Greenwood and Valley Mill Roads.
Greenwood Fire Company - No objection. If municipal water supply is
provided for this area, we can go along with the rezoning request of this
plot.
Inspections Department - No comment.
Planning and Zoning ^ The following issues should be considered:
1. Conformance with the Comprehensive Plan r The site is located east of
Winchester in the Abrams Creek drainage area. It is just beyond but in
the vicinity of areas shown as urban development areas in the
Comprehensive Plan. The site contains two tracts on either side of Route
659. Tract One is located on the north side of Route 659, across from the
Abrams Creek interceptor to the regional wastewater facility. Tract Two
is on the south side of Route 659, and the Abrams Creek interceptor
crosses this tract. The site does not contain significant prime
agricultural soils.

2. Impacts and Site Suitability - The site does contain drainage areas and some
steep slopes. Floodplain areas are located along Abrams Creek on Tract Two.
However, the site also contains substantial areas of relatively level land that
are suitable for development. Using a typical gross density for single-family
developments in RP of three units per acre, this rezoning could result in over
390 dwellings. Using standard sources, such a single family development could
generate over 3500 average daily trips when fully developed.
Route 659 is not classified as a collector road. This and other developments
would probably result in the need to upgrade Route 659. It will also increase
the need to improve the Route 656 and Route 659 intersection. Improvements on
that portion of Route 656 are included in the six year improvement program.
3. Conclusions s Because of the location on the site in relation to existing sewer
and water facilities, suburban residential development would appear to be the
most appropriate use for the site.
