LOCATION: Route 11 South of Winchester, across from DMV
MAGISTERIAL DISTRICT: Back Creek District
ADJACENT LAND USE AND ZONING: Vacant land and businesses, zoned B-3 (Business
Transition) and B-2 (Business General)
PROPOSED USE AND IMPROVEMENTS: Office building for a State Farm Insurance
adjustor office and other B-2 usage.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to proposed lots.
Before any work is done on the State's right-of-way, a commercial entrance
will be required. Also, adequate space must be allowed to accomodate a
secondary lot connection between Lots 6 and 7 for the proposed street.
Sanitation Authority - see attached letter.
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code as a minimum.
Building Department - Development shall meet all applicable codes.
Planning and Zoning - The proposal is to rezone 6.79 acres of land zoned B-3
to B-2, Business General. The land has over 500 feet of frontage on Route 11
South. It is adjacent to a large area of land currently zoned B-2.
The change in zoning would allow general retail uses instead of the wholesale
and trucking uses allowed in B-3. This might result in some increase in
traffic generation on a per acre basis.
The rezoning can be considered to be a redrawing of boundaries between areas
of land zoned B-2 and B-3 with 6.8 acre increase in B-2 land. This seems
appropriate given patterns of development in this area.
STAFF RECOMMENDATIONS: Approval.

Master Plan Revised 10 April 1987
Dear Richard:
The referenced master plan does not show how the parcels 5-8
are served with water and sewer. Therefore I have drawn lines in
red on the plan to show what I believe is a possible solution.
Basically the eight (8) inch water line along Route 11 must be
extended and tied into the line on the northern most street. I have
assumed the sewer will be provided by an easement across the back
of the lots.
It would help if all existing and proposed lines and easements
were shown. That eliminates a lot of guess work and assumptions
on my part.

1985, by and between FIRST AMERICAN BANK OF VIRGINIA (Successor
in interest to Shenandoah Valley National Bank), EXECUTOR AND
TRUSTEE OF THE ESTATE OF VIRGINIA M. SHACKELFORD, DECEASED, and
KATHLEEN A. SHACKELFORD, Widow, Individually, and as EXECUTRIX OF
THE ESTATE OF EARL W. SHACKELFORD, DECEASED, parties of the first
part, hereinafter called the Grantors, and BATTLEFIELD PARTNER-
SHIP, a Virginia Partnership, party of the second part, herein-
after called the Grantee.
WITNESSETH: That for and in consideration of the sum of
Ten ($10.00) Dollars, cash in hand paid and other good and valu-
able consideration, the receipt of which is hereby acknowledged,
the Grantors do hereby grant and convey with Special Warranty of
title, with respect to Parcel 1, and quitclaim, with respect to
Parcel 2, unto the Grantee, in fee simple, as specific partner-
ship property, pursuant to Title 50, Code of Virginia, 1950, as
amended, all of that certain lot or parcel of land, together with
the improvements thereon and the appurtenances thereunto belong-

C.L.S., dated October 17, 1984, attached hereto anq,by this
reference made a part hereof as if set out in full; and being the
same land conveyed to Virginia M. Shackelford, by deed dated
December 31, 1962, from S. L. Shackelford, widower, et al, of
record in the Office of the Clerk of the Circuit Court of
Frederick County, Virginia in Deed Book 284 at Page 670, of which
the said Virginia M. Shackelford died seized and possessed; -the

ind Testament, of record in the aforesaid Clerk's Office in Will
3ook 81 at Page 19, devised a one-half interest in the said prop -
arty to Earl W. Shackelford and his wife, Kathleen A. Shackelford,
and the remaining one-half interest in said property was devised,
in trust, to the Shenandoah Valley National Bank with full power
to sell as Executor and Trustee. The Shenandoah Valley National
Bank was merged into the First American Bank of Virginia on the
1st day of January, 1984. Earl W. Shackelford subsequently died
on March 12, 1982 and devised all of his right, title and
interest in and to the subject property to his widow, Kathleen A.
Shackelford, who is also his Executrix. Reference is made to the
aforesaid plat, deed, and will for a more particular description
of the property herein conveyed.
This conveyance is made subject to all easements, rights
of way and restrictions of record affecting the subject property.
