their meeting of August 26, 1987:
Approval of Rezoning Request #013-87 of George W. Glaize to rezone 37.205 acres
from A-2 (Agricultural General) to RP (Residential Performance) for residential
development. This property is located on Route 659 (Valley Mill Road) in the
Shawnee Magisterial District.

MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Residences, vacant and agricultural land zoned A-2
(Agricultural General).
PROPOSED USE AND IMPROVEMENTS: Residential dwelling
REVIEW EVALUATIONS:
Department of Transportation - No objection to rezoning; however, an entrance
permit must be applied for and approved before doing any work on the State's
right-of-way.
Sanitation Authority - Sewer will be available to the site when the Opequon
plant is in operation. Water facilities are available in the vicinity of the
intersection of Greenwood Road and Valley Mill Road.
Greenwood Fire Company - No objection. If a municipal water supply is
provided for this area, we can go along with the rezoning request of this
plot.
Inspections Department - No comment.
Planning and Zoning The following issues should be considered:
1. Conformance with the Comprehensive Plan - The site is located east of
Winchester in the Abrams Creek drainage area. It is just beyond, but in
the vicinity of, areas shown as urban development areas in the
Comprehensive Plan. The site is located across Route 659 from the major
Abrams Creek interceptor, above the regional wastewater facility. The
site does not contain prime agricultural soils.

2. Impacts and Site Suitability - The site does contain drainage areas and
some steep slopes. However, it also contains substantial areas of
relatively level lands that are suitable for development.
Using a typical gross density for single-family in the RP District of
three units per acre, this rezoning could result in over 110 dwellings.
Using standard sources, such a single-family development could generate
over 1,000 average daily trips when fully developed.
Route 659 is not classified as a collector road. This and other
developments would probably result in the need to upgrade Route 659. It
could also result in the need to upgrade intersections with Route 7 and
Route 656.
3. Conclusion - Because of the location of the site in relation to existing
sewer and water facilities, suburban residential development would appear
to be the most appropriate use for this site.

Dear 'George:
This will confirm our conversation concerning the referenced
water line. The contractorstopped the line approximately
fifteen feet short of ybur•property line. When you desire to extend
the water line to serve a development on your property, the
Authority'will bear the cost of installing that line between the
end of the present line and your property line. This -provision
shall become a part of the c6ntract between the Authority and
yourself dated April 10, 1986..

THIS CONTRACT, made this loth day of April, 1986, by and
between the FREDERICK COUNTY SANITATION AUTHORITY, a Virginia
corporation organized and existing under the provisions of the
Virginia Water and Sewer Authorities Act (Sec. 15.-1-1239, et
seq., Code of Vilrginia, 1950, as amended), of the one part,
hereinafter called the Authority and GEORGE W. GLAIZE, JR., of
the other part, hereinafter called the Developer.
WHEREAS, the Authority owns and operates a water and sewer
system in the County of Frederick; and
WHEREAS, the Authority has let a contract to extend a
water line to the Oak Hill and Blue Ridge Mobile Home Parks,
and
WHEREAS, the Developer owns a parcel of land adjacent to
said Parks and desires the Authority extend the water line to
his property.
NOW, THEREFORE, for and in consideration of the following
terms, conditions and covenants, the parties agree:
(1) That the Authority will extend an eight -inch water
line from Route 7 to the Developer's property by 1
September 1986.
(2) That the Developer will will pay a total of nine
thousand six hundred twenty dollars ($9620.00) to the
Authority upon execution of this contract by the Developer.
(3) That in the event connections are realized due to
the construction of said eight -inch line during the first
ten years following the date of this contract, the
Authority will pay to the Developer twenty percent (20%) of
the availability fees collected until a total of four
thousand eight hundred ten dollars ($4810) has been
reimbursed or the contract expires, whichever occurs first.
Said payments shall be made annually during the month of
April and shall include connections as of April loth.
(4) This contract shall remain in effect until April 10,
�a 1996 and may be amended in writing with the mutual consent
of both parties.
(5) This contract shall be assignable to any person,
firm or corporation who succeeds the Developer herein as
owner of the real estate to which this agreement applies.
IN WITNESS WHEREOF, the following duly authorized
signatures of the respective parties hereto affixed upon
duplicate copies hereof, on the date first mentioned above.
