Whitacre HC 3, Box 1 Cross Junction, Virginia 22620 Dear Mr. Whitacre: This letter is to confirm the Frederick County Board of Supervisors' action at their meeting of September 9, 1987: Approval of Rezoning Request #012-87 of George B. Whitacre to rezone 9.290 acres from A-1 (Agricultural Limited) to B-2 (Business General) for retail sales of groceries, fruits, and canned goods. This property is located on the northeast side of dual U.S. 522, 1/4 mile west of Cross Junction, in the Gainesboro Magisterial District. Mr. Throckmorton stated that he noted that the vote from the Planning Commission had been five to four and he wondered what the objections had been from the Planning Commission. Mr. Watkins replied that traffic and the mixing of business were the areas of concern. Mr. Henry appeared before the Board on behalf of his request. No one appeared in opposition. Upon motion made by C. William Orndoff, Jr., seconded by Thomas B. Throckmorton and passed unanimously, rezoning application number 029-87 of Kim Henry, Route 8, Box 1209, Winchester, Virginia, to rezone 27 acres, from M-1 (Industrial Limited) to B-2 (Business General) and B-3 (Industrial Transition) for business use was approved. This property is located on Baker Lane, North of Fertig Cabinets and is identified as Parcel 97-0 on Tax Map 54 in the Stonewall Magisterial District. REZONING APPLICATION #012-87 OF GEORGE B.' WHITACRE - GAINESBORO MAGISTERIAL DISTRICT - APPROVED Mr. Watkins presented this request and stated that this request had been before the Board several times for their consideration. Mr. Riley read the letter which he had received from Mr. Bob Smalley, member of the Commonwealth's Transportation Board, concerning this request. Mrs. Beverly Sherwood, area resident, appeared before the Board at this time to once again note her objections to this rezoning request and stated that if approved it would definitely be spot zoning. Mr. Stiles asked Mr. Whitacre to tell the Board exactly what he planned to do with this land. Mr. Whitacre replied a similiar use to what he had now, a fruit stand, etc., and further stated that he did not want a conditional use permit. 3n.-- t Mr. Orndoff stated that it was his understanding that Mr. Whitacre was not here to request a sign for his business but to request that nine acres of his property be rezoned. Mr. Whitacre replied that was correct. The Board discussed at great length B-1 and B-2 zoning and how it related to this area and this request. Mr. Owings stated that this request had been kicked around for sometime and he felt the Board should make up their minds one way or the other on this request. Mrs. Maddox asked Mr. Watkins to refresh her memory on other businesses in this area. Mrs. Maddox, in making the motion to approve this request, stated that she felt a precedent had been set when other businesses were approved in this area and she did not feel the Board had any reason not to approve this request. Upon motion made by Rhoda W. Maddox and seconded by Will L. Owings, rezoning application number of 012-87 of George B. Whitacre, HC-3, Box 1, Cross Junction, Virginia, to rezone 9.290 acres from A-1 (Agricultural Limited) to B-2 (Business General) was approved. This property is located on the Northeast side of dual U.S. 522, 1/4 miles West of Cross Junction and is identified as Parcel 30B on Tax Map 18 in the Gainesboro Magisterial District. The above motion was approved by the following recorded vote: Aye - Will L. Owings, Robert M. Rhodes, Rhoda W. Maddox, Thomas B. Throckmorton and C. William Orndoff, Jr. Nay - Kenneth Y. Stiles. Mr Rhodes stated that he felt the Board realized that with the construction of 522 North that the Planning Commission needed to discuss and issue strict guidelines for areas such as this in order that a similiar situation might be addressed in the future in a more expedient manner. Mr. Stiles referred to Mrs. Maddox's statement concerning approval of similiar requests for businesses in this area and stated that there is a significant difference as one was an established business and the others are ten miles from Winchester. REZONING REQUEST #012-87 George B. Whitacre Rezone 9.290 acres from A-1 (Agricultural Limited) to B-2 (Business General) Northeast side of dual U.S. 522, 1/4 mile west of Cross Junction MAGISTERIAL DISTRICT: Gainesboro District ADJACENT LAND USE AND ZONING: Vacant land, Agricultural and Residential zoned A-1 (Agricultural Limited) PROPOSED USE AND IMPROVEMENTS: Retail sales of groceries, fruits, and canned goods. REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. Health Department - No objections. Any future business/construction must be limited to no more than 450 gallons per day water usage as per permit issued 4/10/86 (SD86-113). Gainesboro Fire Company - No comment. Building Department - Any development must meet applicable codes. Planning and Zoning - The proposal is to rezone 9.290 acres of land from Agricultural Limited to Business General in the Whitacre/Cross Junction area. The site is located on Route 522 North. Business and industrial zoning currently exists in this community center area. B-1 zoning is located 1400 feet to the west of this site on old Route 522, and B-2 and M-1 zoning is located 2000 feet to the southeast of Cross Junction. There are no existing dwellings immediately adjacent to the site and no negative impacts would be expected. Under the current A-1 zoning, service stations, country general stores, and restaurants are allowed with a conditional use permit. The B-2 zoning would allow a broader range of retail uses, hotels and motels, motor vehicle sales, and offices. It may be difficult to make a case for a special community need for this rezoning because of the range of services allowed under A-1 zoning. REZONING REQUEST #012-87 George B. Whitacre This particular request raises difficult questions in relation to the spot zoning policy. The spot zoning policy states that this rezoning should only be granted if the proposed zoning is similar to surrounding zoning or if similar surrounding properties in the area should be treated in a similar manner and if all allowed B-2 uses would be appropriate on this and similar surrounding land. The site is not adjacent to existing business zoning, although it is in the general vicinity of business and industrial zoning. The difficult question in this case is how close does a site need to be to similar zoning to overcome classification as illegal spot zoning? The site is an area designated by the Comprehensive Policy Plan as a rural community center designated for further study. No final community center plans or standards have been proposed for this area. The initial study does suggest that some additional commercial development might be allowed in this area, but initial committee recommendations suggested treating this area similarly to surrounding rural areas. Standards for resolving some of the these questions are lacking at this time. Standards concerning the extent of expansion of land zoned for business in this area are also lacking. It is possible that sufficient reason has not been provided to overcome the concerns for illegal spot zoning. IN a 719.61 NOTE ; RAISE EXISTING MAN►R j Spot Zoning Adopted Policy for the Frederick County Planning Commission Now and in the future, the prime objective of the Planning Commission is to develop plans and major policy recommendations concerning the development of the County. Any activity which distracts from these objectives should be limited to the minimum consistent with effective performance of administrative functions which are secondary obligations of the Commission and its staff. Proposals for minor zoning amendments fall within this secondary category. An inordinate number of these involve spot zoning, which has the following characteristics: 1. Individuals seek to have property rezoned for their own private uses. 2. Usually the amount of land involved is small and limited to one or two ownerships. 3. The proposed rezoning would give privileges not generally extended to property similarly located in the area. 4. Applications usually show little or no Evidence of, or interest in, the effect on surrounding property, whether all uses permitted in the classification sought are appropriate in the location proposed, or conformity to a comprehensive plan or to comprehensive planning principles. The following policy is, therefore, adopted by the Planning Commission. No proposed zoning amendment will receive favorable recommendation unless: 1. The proposal will place all property similarly situated in the area in the same category, or in appropriate complementary categories. 2. There is convincing demonstration that all uses permitted under the proposed district classification would be in the general public interest and not merely in the interest of an individual or small group. 3. There is a convincing demonstration that all Uses permitted under the proposed district classification would be appropriate in the area included in the proposed change. (When a new district designation is assigned, any use permitted in the district is allowable, so long as it meets district requirements, and not merely uses which applicants state they intend to make of the property involved.) -2- i 4. There is convincing demonstration that the character of the neighborhood will not be materially and adversely affected by any use permitted in the proposed change. 5. The proposed change is in accord with the comprehensive plan and sound planning principles.
