Gyurisin, Deputy Director SUBJECT: Rezoning Application #004-87 of Kim Henry DATE: November 5, 1987 Attached is the application of Kim Henry that was tabled by the Board of Supervisors in May. The application is the same, but there has been a reduction in the acreage from five acres to 3.42811 acres (see application form). Also, the owner has changed to Earl W. Cline. RWW/rsa Attachment REZONING REQUEST #004-87 Kim Henry Rezone 5 acres from B-2 (Business General) and RP (Residential Performance) to B-3 (Industrial Transition) LOCATION: On the north side of Route 7, adjacent to and to the east of Regency Lake Estates MAGISTERIAL DISTRICT: Stonewall ADJACENT LAND USE AND ZONING: Vacant land, residences, and businesses zoned B-2 (Business General); vacant land zoned MH-1 (Mobile Home Community); Regency Lake Estates, vacant land, and residential land zoned RP (Residential Performance). PROPOSED USE AND IMPROVEMENTS: warehouses REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. However, prior to zoning anywhere from the state's right-of-way, the permit must be applied for and approved to conform to the VDH&T minimum requirements. Health Department - No objection as long as property is served by central sewer and water. Sanitation Authority - Water and sewer facilities are available and will have to be extended by developers to serve the parcel. Greenwood Fire Company - No comment. Shall comply with Fire Code. Planning and Zoning - The proposal is to rezone 3.5 acres from RP (Residential Performance) to B-3 (Industrial Transition) and 1.5 acres from B-2 (Business General) to B-3 (Industrial Transition). The site is located in the vicinity of the interstate interchange adjacent to a large area of land zoned B-2, Business General. Vacant land, residential uses, and business uses zoned B-2 are located to the southeast of the site. Residential uses zoned R-P are located to the southwest of the site. A strip of land zoned RP is located to the east of this site. Residential uses zoned RP are located to the east of the vacant strip. B-3 zoning would allow wholesale businesses, warehouses, launderies, veterinary hospitals, and mobile home sales instead of the retail, restaurant, and motels allowed under B-2 Zoning. Automobile dealers are allowed in both districts, although automobile sales without service is allowed only in the B-3 District. Page 2 Henry Rezoning In general, B-3 zoning involves lower rates of traffic generation than B-2 zoning. B-3 would result in traffic generation rates roughly similar to those from RP development. Businesses on the site would use the entrance road to Regency Lakes Estates for access to Route 7. This road could provide good access to the site. The proposal will not bring business traffic through residential areas. The proposal will increase the area of land zoned for business and move the boundary between business and residential zoning closer to existing residences. There does need to be concern expressed for possible impacts on surrounding RP and mobile home park land. However, B-3 Zoning would allow us to require some buffering and screening, whereas the B-2 zoning would not. The B-3 buffering requirements are somewhat vague, but say that landscaping should be provided in setback areas and that sufficient area shall be provided to adequately screen uses from adjacent residential districts. No such language exists in the B-2 District. B-3 Zoning might increase negative impacts, but may provide improved protection. The proposed B-3 area would be to the rear of the B-2 area. The B-3 Statement of Intent does not provide locational standards, but the location is in keeping with other B-3 locations. Industrial zoning is located across Route 7 from this area.
