MAGISTERIAL DISTRICT: Gainesboro ADJACENT LAND USE AND ZONING: Bus garage and commercial garage zoned M-2 (Industrial General) and vacant and residential land zoned A-2 (Agricultural General). PROPOSED USE AND IMPROVEMENTS: Automobile sales and service REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. Before doing any work on the State's right-of-way and before the business is opened, a commercial entrance permit must be applied for and constructed to meet the VDH&T's minimum commercial entrance standards. Health Department - Based on a maximum of 30 office employees and no warehouse employees, the Health Department has no objection to the proposal. The existing kennel on this property is to be removed. Inspections Department - Proposed office building and warehouses must be designed and built in accordance with the Virginia Uniform Statewide Building Code and applicable referenced standards. Please note that sprinkler systems are required for moderate hazard storage buildings in excess of 12,000 square feet unless separated by firewalls, complying with Article 14 of BOCA 1984. Planning and Zoning - The proposal is to rezone five acres of land located at Albin, adjacent to the Frederick County Bus Garage to B-3. Land on either side (the bus garage and Omps Garage) is zoned M-2 (Industrial General). Rezoning this site for business will obviously increase traffic in this area. It is difficult to estimate the amount of traffic that would be generated. Car dealerships generate relatively low volumes of traffic. However, warehouses are allowed in B-3 and could generate over 300 average daily trip ends from this site. However, it is likely that lesser rates of traffic generation would result on this site. Generally, B-3 zoning involves lower rates of traffic generation than B-2 zoning. Page 2 Kern Rezoning The parcel of land has frontage on Routes 522 and 679. However, it has only 53 feet of frontage on Route 522. VDH&T tells us that this provides insufficient room for a commercial entrance, unless they can obtain permission to encroach on the frontage of the School Board or Omps Garage land. In any case, access via Route 679 is more desirable than access directly onto Route 522. Residential uses are located in the vicinity of this site along Route 679. However, the only adjacent dwelling is on land owned by the applicant. A limited amount of buffering and screening could be required in certain situations. In general, B-3 zoning on this site would appear to be appropriate in relation to surrounding uses. STAFF RECOMMENDATIONS: Approval.
