Smith Rezone 2.80 acres from B-2 (Business General) to RP (Residential Performance) LOCATION: North side of Route 7, approximately one mile east of Winchester. MAGISTERIAL DISTRICT: Stonewall ADJACENT LAND USE AND ZONING: Residences zoned RP and small businesses zoned B-2. PROPOSED USE AND IMPROVEMENTS: A Group Adult Retirement Home REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. Health Department - No objections. Greenwood Fire Company - No objection. Inspections Department - Existing building to be brought into compliance with requirements for Use Group 1-1 and Certificate of Occupancy issued before building is occupied. Planning and Zoning - The applicant wishes to rezone the front 400 feet of the property to RP, so that the whole property will be zoned RP and so that the applicant can establish a licensed group adult retirement home. The B-2 zoning was last established in 1982 as a result of a rezoning request by Gary A. and Rebecca H. Dolphin. After considerable discussion at that time, it was concluded that a mistake had been made during the Comprehensive Rezoning in not rezoning this property to B-2. The staff recommended denial partially because of the severe sight distance problems present at the entrance on Route 7. There is a mixture of RP and B-2 zoning at this location. Parcels on each side of the B-2 portion of this lot are zoned RP. Whether this area should all be rezoned to B-2 or RP or whether mixed zoning should continue, remains unclear at this time. A strip of small business lots at this location is not, necessarily the most desirable pattern due to traffic safety concerns. The staff has no objection to the rezoning. If the rezoning is granted, the applicant will need a conditional use permit to establish the intended use. STAFF RECOMMENDATION: Approval. PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval.
