MAGISTERIAL DISTRICT: Stonewall ADJACENT LAND USE AND ZONING: Vacant land and residential uses zoned A-2 (Agricultural General) PROPOSED USE AND IMPROVEMENTS: Single-family residences REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. If and when this land is developed, plans must be submitted and permits applied for before doing any work on the State's right-of-way. Health Department - No objection. Roundhill Fire Company - No comment. Inspections Department - No comments at this time. Planning and Zoning - The following issues should be considered: Location and the Comprehensive Plan - The site is located within 4,000 feet of Route 37, an elementary school and high school, and the generalized urban development area. It also is next to a large area platted into five -acre lots (Spring Valley) and 100,000 square foot lots (Fox Lair). However, according to the soil conservation service, it also contains large areas of prime agricultural soils and soils of statewide significance. The site is not served by public sewer and water. The site is currently in agricultural use. Site Characteristics and the RP Requirements - Under the RP requirements, only single-family, detached traditional dwellings on lots at least 100,000 Page 2 Scully Rezoning square feet in size are allowed when sewerage and public water are not available. Such a development would have to meet the environmental protection, open space, buffer, and homeowners association provisions of the ordinance. It would also have to follow the RP Master Plan procedures. Approximately fifty (50) lots could be divided under the RP requirements. The site is relatively level and physically well suited for development. Access to the site is relatively good. The parcel has over 3,000 feet of frontage on Route 739, a rural collector. Under RP zoning, full street and drainage requirements will have to be met. Potential Impacts - Under A-2 Zoning, this land could be divided into 26 five -acre lots with substandard streets and drainage facilities. Because of the low residential densities and the relatively high existing traffic on Route 739 (2,365 ADT), traffic impacts of the rezoning will be relatively slight. Some concern should be expressed for potential, long term cumulative impacts of increasing numbers and densities of septic drainfields in the area. However, the Health Department has no objections to the rezoning. Impacts on existing residential areas abutting to the south will be minimal. It is possible that a substantial portion of the woodlands in the southern portion of the site would be protected under RP. Conclusions - The adopted Frederick County Comprehensive Plan contains policies concerning maintaining agriculture, with a strategy of preserving significant agricultural land through a combination of several methods. It also contains a policy concerning maintaining the rural character of areas of the County in which urban development is not proposed. If granted, this rezoning would extend more intensive residential development into one of the County's more agriculturally significant limestone valleys. At the same time, the current A-2 zoning will not necessarily maintain the agricultural use of the site and may result in lesser quality development. Under RP Zoning, residential development necessitates dedicated streets and provisions for environmental protection. Under A-2 Zoning, five -acre lot subdivisions are possible with substandard streets and no provisions for environmental protection. An important question is whether the County wishes to extend higher density development in this direction and how far in this direction such development should extend. Granting the rezoning might result in additional rezoning requests in this area. We can draw a circle with a one mile radius around the Routes 522/37 interchange and find Albin, the school complex, RP, M-2, and B-2 Zoning, and significant residential subdivisions within that radius. The proposed rezoning is within this radius, but a policy is needed concerning whether more intensive development should be expanded beyond this general area. STAFF RECOMMENDATION: Approval.
