MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Residential and vacant land zoned A-2 (Agricultural
General); nonconforming business uses
PROPOSED USE AND IMPROVEMENTS: Retail sales of truck caps and related items.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to rezoning. However,
prior to opening of a business, a commercial entrance permit must be applied
for and approved, providing there is adequate sight distance in both
directions.
Health Department - No objection. Septic tank system should be adequate as
presently installed.
Stephens City Fire Company - No comment.
Planning and Zoning - The following issues should be considered:
Location and Allowed Uses - The Comprehensive Plan designates this area as a
rural development area. The proposed rezoning includes the former Homa
(Jo -Lynn Manufacturing) site, which is now vacant, and the adjoining Shelly
Truck Cap site. The truck cap business is a nonconforming use, as was
Jo -Lynn Manufacturing. The truck cap business would be nonconforming in
relation to B-2 requirements for screening motor vehicle parts or equipment
and for other site planning standards if the rezoning is granted. Truck tops
are stored over much of the property. A site plan would be required to
expand the use to the Homa property. Past enforcement activities have been
concerned with the illegal expansion of the nonconforming truck cap business
to the Homa parcel. If the rezoning is granted, the full range of retail,
office, restaurant, and motel uses would be allowed.

Shelly Rezoning
Existing Uses in the Area - As the enclosed map shows, this area is named
Ridgeway Heights and has a subdivision pattern of extremely small lots which
were subdivided prior to subdivision control. There is a mixture of
residential and commercial uses in this area. The enclosed map shows
nonconforming commercial uses. All other parcels are residential or vacant.
There is currently no business or industrial zoning in this part of the
County. All non-residential uses in Ridgeway Heights are limited by the
nonconforming use section of the Zoning Ordinance.
Spot Zoning Policy - The Planning Commission and staff reviewed a proposal to
rezone the Homa property from A-2 to M-1 in 1985. The staff recommended
denial, largely on the basis of the spot zoning policy, the Planning
Commission made no recommendation due to a tie vote, and the application was
withdrawn. Staff continues to contend that the proposal constitutes an
inappropriate spot zoning under that policy, because it singles out a small
area to be zoned differently from similar properties in the area without a
demonstration of any overriding public benefit. The possible effects on
adjoining residential properties need to be considered. In considering
whether to bring nonconforming uses into conformity by rezoning in this area,
there is a need to consider all of the nonconforming uses, not just one.
This is true because additional rezoning requests would probably result from
this rezoning. There is a need to consider the whole neighborhood before
granting a rezoning.
STAFF RECOMMENDATIONS: Denial.
PLANNING COMMISSION RECOMMENDATIONS: Denied, by the following majority vote:

The following is a summary of the Planning Commission's discussion on the Shelly
rezoning.
In the discussion of the Shelly rezoning, the staff noted their belief that the
rezoning would constitute an inappropriate spot zoning because it singled out an
individual property for rezoning without considering other similar nonconforming
uses. The staff was also concerned about the residences in the area. It was
noted that the outdoor storage of truck tops could not be legally expanded to the
Homa property, although the use of the Jo —Lynn building would constitute a legal
nonconforming use.
Mr. Stiles noted that these properties were overlooked at the time of the
comprehensive rezoning when the goal was to bring zoning in line with existing
uses.
Mr. Golladay suggested that all nonconforming business uses in this area be
rezoned on a comprehensive basis.
Col. Myers said that Route 522 provided for a good business location and that the
existing commercial uses would be better zoned for business.
Mr. Wilson said that he was not in favor of piecemeal rezoning, but would rather
rezone the entire area.
Mr. Watkins noted that the staff believed that this area should be included as a
Rural Community Center. He also noted the need to consider the needs of the
residences in the area.

Dear Mr. Watkins:
This letter is in reference and in reply to Mr.
Shelley's request to re -zone property located next to my
property.
Neither I, present property owner, nor my father,
Walter Franz who was previous property owner, ever agreed to
Mr. Shelley establishing such a business next to and nearby
our residence. We never have believed Mr. Shelley has had
proper zoning either for his sprawling "truck cap" business
or for the pile of gunk cars and rusted farm machinery on
the lot next to my South property line.
In addition, Mr. Shelley has ignored requests by my
father and, I believe, requests by Frederick County
officials to clean up the lot in question. Given the two
points I have established, I believe Mr. Shelley will do as
he pleases if given the B-2 zoning regardless of my
interests. His behavior on the land has lowered the value
of my property and muddled the residential nature of the
area. The two most important questions I view are as follows:
1. Should Mr. Shelley be allowed to operate such a
business in a long established residential area to
the financial detriment of that area?
2. Is Mr. Shelley able to stay within the bounds of
any kind of zoning, B-2 or otherwise, given the
record of his past behavior?
The answer is no to both. I oppose a re -zoning of any
property around me and request the lot next to me be cleaned
up as is proper.
