Foltz 5 acres zoned M-2 (Industrial General) to be rezoned to B-3 (Industrial Transition) LOCATION: 1/4 mile east of I-81, right side of Route 50, behind the K-Mart store and motorcycle dealer. MAGISTERIAL DISTRICT: Shawnee ADJACENT LAND USE AND ZONING: Retail and other business use and open land zoned B-2 (Business General) and truck terminal zoned M-2 (Industrial General) PROPOSED USE AND IMPROVEMENTS: Truck leasing company, sales and service, forklift and small equipment sales and service, garage for small cars and trucks. REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. However, if there is to be a new entrance onto Route 50, a commercial entrance permit must be applied for and approved before business is started. Health Department - No objection; less employees than previously. Greenwood Fire Company - OK, if fire hydrants are included in future plans. Inspections Department - No comments since no new buildings are proposed. Planning and Zoning - In 1983, an 11-acre parcel, including this and an adjoining parcel, were rezoned from B-2 (Business General) to M-2 (Industrial General). The staff recommended the rezoning to industrial, but recognized that the intermixing of industrial and business zoning may not be desirable. The positive recommendation was made in order to bring existing uses into conformance. We are not sure that we would today give such a positive recommendation for such a small-scale industrial rezoning because of the potential impacts on surrounding B-2 uses. The proposed B-3 zoning would lessen the potential impacts by greatly limiting the range and intensity of possible uses. However, the rezoning will leave a smaller, 6-acre M-2 area. The B-3 zoning might be viewed to be providing a transition or buffer between the businesses on the highway and industrial area to the rear. 0 Page 2 Foltz Rezoning It should also be noted that the County should avoid regular rezonings in order to accomodate changing specific uses on a particular parcel. Instead, rezonings should follow an orderly, consistent pattern. Nevertheless, B-3 zoning would be consistent with existing and proposed uses, and it would limit possible uses and provide some more orderly transition. STAFF RECOMMENDATION: Approval.
