Approval of Rezoning Application #011-86 of George W. Glaize, Jr. et ux and
Zetta P. Garber to rezone 146.829 acres from A-2 (Agricultural General) to
M-1 (Industrial Limited) located at the corner of State Road 50 East and
State Road 728 (Victory Lane), 1 1/2 miles east of Winchester in the Shawnee
Magisterial District.

To Be Rezoned From A-2 (Agricultural General) to M-1 (Industrial Limited)
LOCATION: Corner of State Road 50 East and State Road 728 (Victory Lane), 1 1/2
miles east of Winchester
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Forest, agricultural, vacant land, and scattered
residences zoned A-2 (Agricultural General); industrial and vacant land zoned M-1
(Industrial Limited) across Route 728.
PROPOSED USE AND IMPROVEMENTS: Light Industrial and Warehouses
REVIEW EVALUATIONS:
VA Dept of Highways & Transportation - No objection to rezoning, however, a
commercial entrance permit must be applied for and approved prior to starting
a business.
Sanitation Authority - Central water and sewer service is not available to
the property.
Greenwood Fire Company - We recommend that this be denied until provisions
for a water supply for fire protection of that area are verified.
Inspections Department - No comments at this time. Specific comments to be
made at time of individual site plans.
Planning and Zoning - In reviewing the application, the following issues
should be considered:
1. Location and Proposed Use - The site is located just beyond the edge of
the proposed urban area in the adopted Comprehensive Plan. The County is
proceding with plans to install sewer and water to serve this area within
the next year and a half to two years. Therefore, this site appears to
be a logical location for urban expansion.

Information prepared by Henningson, Durham, and Richardson in the airport
master plan on land use compatibility and noise sensitivity suggests that
this site would not be appropriate for residential use, but would be
better used for commercial or industrial use. (Most of the site is
designated as Zone III on the attached maps and table.) Adjacent land is
in open space with only a handful of scattered residences. The site
provides sufficient, relatively level land to provide a number of
industrial or office uses in a well -planned setting. In addition, the
vicinity of the airport to this site provides this location with an
advantage in attracting industrial and office uses to this site.
It is the staff's opinion that with the provision of water and sewer
facilities, urban development becomes inevitable and appropriate at this
site. It is also the staff's opinion that commercial or industrial uses
are the most appropriate urban uses on this site.
2. Access and Traffic - Standard sources suggest that this site, when fully
developed for industrial use, could generate as many as 7,000 average,
daily vehicle trip -ends entering and leaving the site (approximately 50
trip ends per acre). This would represent a significant traffic increase
in relation to the approximately 1,000 average daily trips on Route 728
and the approximately 10,000 average daily trips on Route 50.
In addition, the traffic generated will have an impact on Bufflick Road
and the intersection of Bufflick Road and Route 522 South, of unknown
intensity. It would contribute to increasing traffic on the unimproved
section of Bufflick Road between the airport entrance and Route 522 and
through the residential area. The Highway Department agrees that there
are sight distance problems at the Bufflick Road/Route 522 intersection
and that increased traffic will necessitate improvements to that
intersection.
Nevertheless, the site has excellent access to Route 50. It has access to
Route 50, via Route 728, which has been improved using industrial access
funds. In addition, it can have good direct access to Route 50 at an
existing cross -over to the east of the Route 728 intersection. Direct
access to Route 50 should be limited to just the one location at the
existing cross -over.
3. Conclusions - With the installation of sewer and water facilities, it is
the staff's opinion that industrial use is the most appropriate use for
this site. The site has excellent access to Route 50 and will have
negligible impacts on surrounding properties.
STAFF RECOMMENDATIONS: Approval.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous Approval.

Frederick County is undertaking a project to install water and
sewer mains in the vicinity of the Airport. In order to provide
sufficient funds for the capital costs of the project, those property
owners who desire service are being asked to pay availability charges
of $400 per acre of land served. The amount of this charge is
contingent upon success in obtaining a State Grant.
Propertv owners paying the availability charges will not be
charged for an additional facilities fee of $900 per equivalent
residential connection. Committments on the part of participating
property owners are now needed to apply for the Grant. If you desire
service and wish to participate in this project you must return a
letter of committment similar to the attached Eorm by April 7.

1986, between FERMAN W. PERRY and KATHRYN M. PERRY, his wife, of
the one part, hereinafter called the Grantors; and, GEORGE W.
GLAIZE, JR., and CAROLYN G. GLAIZE, his wife, of the other part,
hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum
of Ten ($10.00) Dollars and other valuable consideration, receipt
whereof is hereby acknowledged, the Grantors do hereby grant and
convey with General Warranty and English covenants of title,
unto the Grantees, in fee simple, jointly, as tenants by the
entirety with right of survivorship as at common law, all that
certain parcel of land, together with the rights, rights of way
and appurtenances thereunto belonging, lying and being situate

THIS AGREEMENT made and dated this 13th day of December,
1985, by and between ZETTA P. GARBER, widow, party of the first
part, and GEORGE W. GLAIZE, JR., individually, and as Trustee,
party of the second part.
WHEREAS, the party of the first part has this day sold
certain real estate located in Frederick County, Virginia on the
Southeast side of Route 728 to the party of the second Dart; and,
WHEREAS, it is the intention of the party of the second
part to rezone the property to Commercial Use from its now

existing zoning; and,
11EF REAS, in order to avoid a question of spot zoning,

NOW, THEREFORE, WITNF.SSETH: That for and in considera-
tion of the mutual benefits to be derived therefrom, the parties
agree as follows:
1. That at such time as the party of the second part
applies to the Frederick County Zoning officials for the rezoning
of the land from its existing zoning, the party of the first part
agrees to join in such petition to rezone the 5.001 Acres
retained herein to the same zoning category in order that the
enr-.ire tract of land previously owned by Zetta P. Garber and the
5.001 Acre tract retained by Zetta P. Garber shall be zoned the
same.
2. This Agreement shall be binding upon the heirs,
successors and assigns of each of the respective parties hereto.

and further being a portion of the same land conveyed to Lee Garber (being
one and the same as Omer Lee Garber) by deed dated May 21, 195r, from
James M. Ford, et al, of record in the Clerk's Office of the Circuit Court
of Frederick County, Virginia in Deed Book 237, at Page 77.
This conveyance is made subject to all easements, rights of way and
restrictions of record affecting the subject property.
The 3rantor does hereby covenant that she has the right to convey to
the Grantees; that the Grantees shall have quiet and peaceable possession
