REZONING REQUEST #010-86 C. Douglas Adams and Fern L. Adams 257.461 acres zoned A-2 (Agricultural General) to be rezoned to M-1 (Industrial Limited) LOCATION: South side of Buff lick Road, approximately 2,000' west of the intersection of Route 645 with Route 728. MAGISTERIAL DISTRICT: Shawnee ADJACENT LAND USE AND ZONING: Agricultural, woodland, and residential land use and RP and A-2 Zoning PROPOSED USE AND IMPROVEMENTS: Industrial Park REVIEW EVALUATIONS: VA Dept. of Highways & Transportation - No objection to rezoning. Health Department - No objection as long as property is served by central sewer prior to any construction or occupancy. Central water is also recommended prior to any construction or occupancy. Greenwood Fire Company - We do not feel this is feasible from the fire protection standpoint until water and sewer are available. Inspections Department - No comments at this time. Planning and Zoning - In reviewing this application, it is recommended that the Planning Commission consider the following issues: 1. Location and Proposed Use - The site is located just beyond the edge of the proposed urban area in the adopted Comprehensive Plan. The County is procedin g with plans to install sewer and water to serve this area within the next year and a half to two years. Therefore, this site appears to be a logical site for urban expansion. Information prepared by Henningson, Durham, and Richardson in the airport master plan on land use compatibility and noise sensitivity suggests that this site would not be appropriate for residential use, but would be Page 2 Adams Rezoning better used for commercial or industrial use. (Most of the site is designated as Zone III on the attached maps and table.) The site provides sufficient, relatively level land to provide a number of industrial or office uses in a well -planned setting. In addition, the vicinity of the airport to this site provides this location with an advantage in attracting industrial and office uses. It is the staff's opinion that with the provision of water and sewer facilities, urban development becomes inevitable and appropriate at this site. It is also the staff's opinion that industrial uses are the most appropriate urban uses on this site. 2. Impacts on Surrounding Properties - The site abuts existing residential properties zoned RP. It also abuts a small residential area zoned Agricultural General on Bufflick Road. Under the M-1 District requirements, no structure can be erected less than seventy-five (75) feet from the boundary of an existing residential area or from any Residential Zoning District. Similarly, parking and loading areas must be located at least fifty (50) feet from residential areas. Landscaping and screening can be required to protect surrounding properties from adverse effects. In the RP District, larger protective buffers are required between single-family and multi -family. In such cases, active buffers of 200 feet (areas without structures, but with parking and other activities) and inactive (landscaped) buffers of 150 feet are required. Under the RP requirements, these yards can be reduced if complete screening is provided. Similar protection would probably be appropriate when industrial areas abut residential areas. The Buffalo Lick Run drainageway, along the southern side of the Adam's property, provides a boundary of wooded land, which is not highly suited for development, between most of the parcel in question and the residential areas to the southeast. The drainageway contains steep slopes and floodplain land. In order to protect existing residential areas and to fit the zoning better to the natural land patterns, it might be better to have the southern boundary of the Industrial District follow Buffalo Lick Run from west to east and run parallel to the boundary with Buff lick Heights at a distance of two hundered feet. This would leave a buffer zone of A-2 land that would be connected with A-2 land to the south. The use of this buffer could be any use allowed in the A-2 District. For instance, the forested areas could be legally clear cut. However, it would provide some additional separation and protection for existing residential areas. Other nearby properties would be protected by the M-1 buffer and screening requirements. Page 3 Adams Rezoning 3. Access and Traffic - Route 728 and Bufflick Road have been improved between Route 50 and the entrance to the airport. However, the road improvements do not quite extend to the parcel in question. Nevertheless, it will be relatively easy and inexpensive to provide the necessary improvements to give the site easy access to Route 50. However, Route 522 is accessed from this site via the unimproved portion of Bufflick Road that passes through a residential area with a number of dwellings located on the road. In addition, the intersection of Bufflick Road with Route 522 is currently not satisfactory for intensive use. The Highway Department agrees that the sight distance to the north from Bufflick Road on Route 522 is unsatisfactory. Standard sources suggest that this site, when fully developed for industrial use, could generate over 10,000 average daily vehicle trip -ends entering and leaving the site (approximately 50 trip -ends per acre). This would represent a significant increase in relation to the approximately 1,000 average daily trips on Bufflick Road and the approximately 8,000 average daily trips on Route 522. The increasing traffic generated by industrial development on this site would definitely have an impact on the residences located on Bufflick Road between the site and Route 522. It would also impact the intersection with Route 522. In order to deal with these problems, the staff recommends that Bufflick Road be included on road plans as a high -priority project. Some solution to these problems is needed both in terms of providing access to the airport area and in terms of regional road planning. The applicant's engineer, C. E. Maddox, Jr., has suggested that the problem can be solved by restricting truck traffic between Route 522 and the site. A comprehensive solution would involve relocating Bufflick Road to intersect with Route 522 at a new location. 4. Conclusions - It is the staff's opinion that industrial use is the most appropriate use of the site. In addition, the proposed rezoning would most probably have obvious benefits to the County in terms of economic development. At the same time, the rezoning may have an adverse impact on existing residential properties on Bufflick Road and on the intersection with Route 522. The problems with Bufflick Road need to be solved in order to provide appropriate access to the airport. The applicant cannot solve this problem alone. The staff recommends that the Planning Commission and Board of Supervisors ask the Frederick County Transportation Committee, staff, and the Virginia Department of Highways and Transportation to make this issue a highest priority item. Page 4 Adams Rezoning Because of potential traffic impacts, this rezoning proposal might be considered to be premature. However, the Planning Commission has a policy that a denied rezoning cannot be reconsidered for one year. Therefore, because the staff believes that M-1 Zoning provides for the most appropriate use of this site and because denial would possibly delay the resolution of access problems in the airport area, the staff is recommending in favor of the application. STAFF RECOMMENDATION: Approval, with a reduction in the area to be rezoned so that the southern boundary of the M-1 Zone follows Buffalo Lick Run from east to west and following a line parallel to, but no closer than, 200 feet from the boundary with the Buff lick Heights Subdivision. Conditions In response to the issue of traffic impact related to the pending rezoning, the writer contacted Mr. Bill Bushman, P.E.,Resident Highway Engineer, with the following: 1. State road corridors may be closed to truck traffic through an indicated procedure of public hearings (1 County and 1 State) and appropriate action by the Highway Commission. In answer to Bufflic citizens concerns, the answer is that their road can be posted "No Through Trucks",if justified. 2. T, affix: counts on VA. Rte. 728 show 1,029 vehicles per day and on Rte. 645 between US 522 and 728 show 1,054 vehicles per day. Rte. 728 was constructed for heavy truck use, according to Bushman, and is lightly loaded now. He indicates a full 24 foot section exists on which State geometric design guides will allow up to 5,500 vehicles per • day on suitable conditions of pavement depth. Based on this conversation, it appears!, that Rte. 728 can support a substantial increase in loading such as may be generated by this project, although upgrade of this 2,400 feet of road can be reasonably implemented. (Note: Part of this road is to be repaved by current Airport Planning.) Based on this brief investigation it would appear that a strategy of traffic,. restrictions on BWfflic Road 'and scheduled improvement of.
