to be rezoned to M-1 (Industrial Limited)
LOCATION: On Route 672 in Clearbrook, adjacent to the Clearbrook Park.
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Residential land is zoned A-2 (Agricultural
General) and Clearbrook Park is zoned M-1 (Industrial Limited).
PROPOSED USE AND IMPROVEMENTS: Custom woodworking, plane and milling lumber,
making sash, doors, trim, guards, hubs, and repair work such as furniture,
screens, etc.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to rezoning. If this is
for a new business, the existing entrances are sub -standard and must be
brought to the Virginia Department of Highways and Transportation's standards
before starting the new business.
Health Department - No on -site sewage disposal. Bathroom and sink waste only
are disposed of at Clearbrook Park's system via terra cotta sewer line.
There has been some problem with this system in the past, but since the
proposed use will not employ more people than are presently using the system
(2-4 employees), the Health Department has no objections to this request.
Clearbrook Fire Company - We see no problem with rezoning this property.
Inspections Department - Existing building to be brought into compliance with
the requirements of the Virginia Uniform Statewide Building Code and
referenced standards for Use Group F-1 (Moderate Hazard Factory and
Industrial Use) and a Certificate of Use and Occupancy must be issued before
the building is occupied.
Planning and Zoning - This site is currently occupied by a nonconforming
heavy equipment sales and service business. In considering the application
for rezoning, the following issues should be examined:

Frederick Investment Rezoning
1. Location and Site Planning — The site is located across Route 672 .from
existing industrial areas. It is a limited site of only one acre in area.
The site planning requirements will greatly limit possible expansion on
this site. No structure will be allowed within 75' of the boundary on the
west side of the property, nor within 25' of any other boundary. The
Health Department has noted problems with sewage disposal, but has no
objections to the rezoning. Problems with sewage disposal will possibly
be alleviated by plans for a package sewage treatment plant in the
Clearbrook area. The site is located within the Clearbrook Rural
Community Center.
2. Impacts on Neighboring Properties — There is one residential property
located adjacent to this lot on the west. This residence is between the
existing nonconforming use and the Clearbook Post Office. There are other
residences located diagonally across Route 672, adjacent to the industrial
land. Due to the limitations on expansion and existing nonconforming use,
new impacts resulting from the rezoning will be limited. However,
additional noise, dust, and truck traffic could possibly result from the
rezoning. The use that is immediately proposed of woodworking could occur
under the existing nonconforming status. If sufficient changes to the
site are made to require a site plan, screening could be required.

Dear Mr. Watkins:
Please consider rezoning a property that I am an owner of in Clear
Brook, Virginia. The property is on Rt 672, just off Rt 11 North,
and has been used by a varity of businesses since the mid 1940's.
Clear Brook Woolen Co. built the building in the 40's and used
it to process their products until the early 70's.
A company named Pacesetter purchased it from Clear Brook Woolen
Co. and manufactured plastic piping for about 3 years.
In about 1976, Adams Truss Co. acquired the property and built
roof trusses until 1980.
Frederick Investment Group, of which I am a part, purchased it
in 1980 and leased it to Vansco Industries, to manufacture Timberline
Woodstoves.
Since 1981, until the present, Vernon Stup Co. has leased this
property to sell and service heavy equipment.
Rollison's Woodworking Shop, from Leesburg, Virginia, wishes
to purchase this property if it can be zoned M-1 for their use.
Your cooperation in changing this zoning to allow them to operate
their business would be greatly appreciated.

I enjoyed talking with you Monday and appreciated your
help very much.
I am writing to let you know about our interest in the
property at Clearbrook, Virginia, which is approximately
500 feet east off of Route 11 on 672.
We,hope to operate a woodworking shop on this property
if we would be able to get the property zoned M1 (Light
Industrial).
I have for the past ten years and presently am operating
a woodworking shop in Leesburg, Virginia at 107 South Street,
S. E.
My son and I would like to start a woodworking shop at
this location and see how it would go. We would probably be
a staff of four people including ourselves. Our operation
will be custom woodworking, plane and milling lumber, making
sash, doors, trim, guards, hubs and repair work such as furni-
ture, screens, etc.
We try to keep our property up as well as clean and neat.
We would not be a large operation but would hope to be able
to make a decent living. Our operation would be mainly during
daylight hours five and a half days a week.
Hope our operation might be an asset to this area.

INVESTMENT GROUP, a Virginia partnership, parties of the second
part, hereinafter called Grantees.
WITNESSETH: That for and in consideration of the sum of
Ten Dollars ($10.00) cash in hand paid, and other valuable
consideration, the receipt of which is hereby acknowledged by the
parties of the first part on or before the execution and delivery
of this Deed, the said parties of the first part do hereby grant,
sell and convey, as specific partnership property, with general
warranty of title, unto the parties of the second part, their
heirs or assigns, the following described property:
All of that certain tract or parcel of land
improved by a factory building and including
thereon one (1) mobile home or trailer, together
with all rights, rights of way, privileges, the
improvements thereon and the appurtenances
thereunto belonging, lying and being situate in
Stonewall Magisterial District, Frederick
County, Virginia, containing 1.000 acres, more
or less, as per plat and survey of Orle C.
Paciulli, C.L.S., dated April 10, 1973, of
record in the Office of the Clerk of the.Circuit
Court of Frederick County, Virginia, in Deed
Book 421, at Page 157, and being the same realty
which was conveyed to the Grantors herein by
deed of Manuel C. Dehaven, et ux, dated the

11th day of April, 1970 and recorded in the
aforesaid Clerk's Office in Deed Book 489, at
Page 698; and further, the same realty which
was subject to an Agreement dated the ldth day
of February, 1980, between Harold B. Adams, et al,
to David C. Jenkins, Jr. et al, t/a Frederick
Investment Group, a Virginia partnership, the
Grantee herein, and recorded in the aforesaid
Clerk's Office in Deed Book 510, at Page 756,
to which deed and agreement, and the references
therein contained, reference is here made for
a more particular description of the property
hereby conveyed.
This conveyance is made subject to all duly recorded and
enforceable restrictions, easements and rights of way.
Ray Barton and Sue Ann Adams join in the execution of
this instrument for the purpose of conveying any and all marital
interests they may have acquired in this real estate upon their
marriages to Judith C. Adams and Harold B. Adams, respectively.
Except as noted above, the parties of the first part
covenant that they have the right to convey said property to the
parties of the second part; that they have done no other act to
encumber said property and that they will execute such further
assurances of said property as may be requisite; that they are
seized in fee simple of the property conveyed, and that they will

foreverwarrant and defend the title thereto.
