LOCATION: Intersection of Routes 522 and 679.
MAGISTERIAL DISTRICT: Gainesboro
ADJACENT LAND USE AND ZONING: M-2 (Industrial General) zoned land, which contains
the Frederick County Bus Garage.
PROPOSED USE AND IMPROVEMENTS: 80' X 100' building for a farm market.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to rezoning, however, a
Commercial Entrance Permit must be applied for and approved prior to opening
a business.
Health Department - No objections; a permit for a sewage disposal system to
serve the proposed market and existing home is being processed.
Round Hill Fire Company_- No comment.
Inspections Department - Proposed building to be designed and built in
accordance with the virginia Uniform Statewide Building Code and applicable
standards for the proposed use.
Planning and Zoning - The following issues should be considered:
1. Location - The two parcels in question are located at Albin, within 3,000'
of the intersection of Routes 522 and 37 and the urban area designated by
the Comprehensive Plan. The property is adjacent to existing M-2 land
presently containing the Frederick County Bus Garage.
2. Site Planning and Impacts - The site appears to have good sight distance
on Route 522 and will be able to have an entrance off the arterial on
Route 679. The site is a corner lot which may not be suitable for
residential use because of the neighboring land use and because of the
configuration of the lot. The rezoning will not create significant impact
in relation to the already significant affects of the bus garage.
STAFF RECOMMENDATIONS: Approval.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval.

part, and the Valley Proteins, Inc., party of the second part.

Book No. 68, page 155. A plat and metes and bounds description of the with-
in conveyed land made by Thomas A. Shockey, Surveyor, is attached to, and
by this reference incorporated in, this deed,
It is expressly ptipulated that this conveyance is made subject
to all applicable, or legally enforceable, easements, if any, of record
affecting same.
Except as noted above the aforesaid grantors covenant that they
have the right to convey the said land to the aforesaid grantee; that the said
grantee shall have quiet possession of the said land, free from all encum-
brances; that they have done no act to encumber the said land; and that they
will execute all such further assurances of the said land as may be requisite.

between Isabel M. Calkin, widow, of the one part, hereinaftev
called the Grantor, and Valley Proteins Inc+, a Virginia cor"t"I
of the other part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten
Dollars 010.00), cash in hand paid and other valuable con-
sideration, receipt whereof is hereby acknowledged, the Grantor
does grant and convey, with General Warranty and with English
Covenants of Title, unto the Grantee, in fee simple, together
with all rights, rights of way, privileges, improvements and_
appurtenances thereto belonging, all of that certain lot of land
'containing one (1) acre, more or less, lying and being pituate
along the Northern side of Virginia - U. S. Highway No. 522 (the
North Frederick Turnpike) about two miles.Northwest of Winchester
in Stonewall Magisterial District of Frederick County, Virginia;
and being the same property conveyed,,to the Grantor herein and
Theron J. Calkin jointly, with the right of survivorship, by
Robert R.,Butler and wife by deed dated October 28, 1954 and
recorded in the Clerk's Office of the Circuit Court of Frederick
County, Virginia in Deed nook 233, at Page 442. Upon the death
of Theron-J. Calkin, Isabei M. Calkin became the sole owner of
the property as the sole surviving joint tenant.
This conveyance id made subject to all legally enforceable
restrictive covenants and easements of record affecting the
aforesaid realty. I
