LOCATION: On the east side of Baker Lane, between the properties of Fertig
Cabinet Company and Estes Trucking Company.
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Businesses on land zoned B-2 (Business General) and
M-1 (Light Industrial) and vacant land is zoned M-1 (Industrial Limited).
PROPOSED USE AND IMPROVEMENTS: Not determined at this time.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to rezoning. However,
we will require curb and gutter to be extended to the City Limits along the
front of this proerty as it develops.
Sanitation Authority - Water and sewer facilities are available to the
property.
Greenwood Fire Company - No problems.
Inspections Department - No comments at this time.
Planning and Zoning - The applicant has proposed to rezone land along Baker
Lane to a depth of 250' from M-1 to B-3. The following issues should be
noted:
1) Rezoning Impacts - If the rezoning is granted, the following M-1 uses will
no longer be allowed: manufacturing, general office buildings, and
restaurants. The uses Allowed in B-3 but not M-1 include: monumental
stone sales, motor vehicle sales and service, veterinary hospitals,
outdoor theaters, and mobile home sales. According to the Statement of
Intent, the B-3 District uses, "will be large, some will have open-air
display." Therefore, B-3 uses should not be considered to be the same as
M-1 uses. Instead, the rezoning could change the type and appearance of

uses in this industrial area. Ultimately, however, rezoning would
probably reduce the range of possible uses that could occur on this site.
2. Site Planning Considerations - The fact that the rezoning is proposed only
to a depth of 250' suggests that the applicant is planning to develop the
land using relatively small lots with separate, individual access onto
Baker Lane. This approach will necessarily result in a pattern of smaller
scale businesses along Baker Lane. Such a smaller scale approach does not
strictly appear to meet the intent of the B-3 District. The applicant may
in fact, wish to consider increasing the depth of the rezoning. In
addition, it will be critical for the developer to plan for the access to
the M-1 land to the east before developing the strip on Baker Lane.
3. General Land Use Patterns - The pattern in this area consists of a large
industrial area adjacent to business and residential areas in the City of
Winchester. The rezoning request in question might represent a logical
extension of a transitional use from the neighboring business areas.
STAFF RECOMMENDATION: Approval.

THIS DEED made and dated this 18 day of January, 1980, by
and between George W. Baker, Jr,, Executor of the Estate of
Joseph F. Hughes, Deceased, and Helen M. Hughes, Single, of
the one part, hereinafter called the Grantors, and J. P.
Darlington, of the other part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of
Ten ($10.00) Dollars and other good and valuable consideration,
receipt whereof is hereby acknowledged, the Grantors do hereby
grant and convey, with special warranty of title, unto the
Grantee, in fee simple, all that certain tract or parcel of
land,.together with the rights, rights of way and appurtenances
thereto belonging, lying partly in Stonewall Magisterial District
Frederick County, Virginia, and partly in the City of Winchester.
Virginia, containing 61.304 Acres, and being more particularly
described by plat of J. R. Nicely, Certified Land Surveyor,
dated December 19, 1979, attached hereto and by this reference
made a part hereof, and being a portion of the property
conveyed to the Grantors by deed of Shenandoah Brick and Tile
Corporation dated February 16, 1979, recorded in the Clerk's
Office of the Circuit Court of Frederick County, Virginia, on
February 27, 1979, at Deed Book 505, Page 234, and in the
Clerk's Office of the Circuit Court of the City of Winchester,
Virginia, on March 19, 1979, at Deed Book 158, Page 651, to
which deeds and the references therein, reference is here made
for a more particular description.
This conveyance is made, however, subject to all rights
,of way, easements and/or conditions of record, if any,
affecting the aforesaid realty.
