June 14, 1988. Our recommendations may be found on the attached plans marked

Please revise and resubmit for my review. My office will require four (4)
copies of the revised plans in order to process a land use permit. The permit
will be issued by my office and will require an inspection fee and surety bond
coverage.

THIS DEED OF DEDICATION, made,and dated this /_ day of March,
1973, by and between Robert K. Stickley, unmarried, individually, and
Robert K. Stickley, Attorney -in -Fact for Evelyn Heath Stickley, Virginia S.
Estop and Harold Estop, parties of the first part, hereinafter referred to
as Grantors; and the County of Frederick, Virginia, party of the second
part, hereinafter referred to as the Grantee.
WHEREAS, the Grantors are the owners in fee simple, of a certain
tract or parcel of land lying and being situate in Opequon Magisterial
District, Frederick County, Virginia, on the Southeast side of State Route
647, just East of Stephens City, Virginia, and more particularly described
by plat and survey of H. Bruce Edens, C. L. S., dated October 15, 1971,
revised January 1, 1973 and January 30, 1973, as SECTION TWO OF PLYM
OWEN ESTATES, attached hereto and made a part hereof, to which refer-
ence is made for a more particular description of said Section, and now
desires to subdivide the same into lots to be known as PLYMN OWEN
ESTATES, SECTION TWO, in accordance with the provisions of the Sub-
division Ordinance of Frederick County, Virginia.
NOW, THEREFOREO WITNESSETH: That for valuable consideration
and the benefits that will accrue by reason of this dedication, the Grantors
do grant and convey to the Grantee, in fee simple, such portion of the
premises platted as is on plat attached hereto, and described above set apar
for streets, alleys, public easements or other public use and to create a
public right of way of passage over the same. The aforesaid is a portion of
the same property conveyed to Robert K. Stickley, Evelyn Heath Stickley,
and Mary Virginia Stickley Estep by deed dated December 23, 1970, of reco;
in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in

Deed Book 372, page 410. Robert K. Stickley acts hereunder by virtue of a
certain power of attorney dated January 5, 1971, of record in said Clerk's
Office in. Deed Book 372, page 409. Reference is hereby made to the
aforesaid deed and the references therein contained for a more particular
description and further derivation of title.
The lots or tracts of land in this Subdivision, with the exception of the
land lying on the North side of Virginia Highway No. 277 marked "Comm
B, C, and D" on said plat, are subject to certain restrictions which are to
constitute covenants to run with the land and shall be binding on all parties
and persons claiming under them, and for the benefit of and limitations upon
all future owners in said addition and are more particularly set out as
follows:
1. SUBDIVIDING: None of said lots shall at any time be subdivided,
conveyed or sold except as a whole, unless the subdivision, conveyance or
sale thereof involves multiple lots so that each of the portions into which the
lots are subdivided for the purpose of subdivision, conveyance or sale resul s
in the lots being created for the purpose of subdivision, conveyance or sale
as well as each of the lots remaining after such subdivision, conveyance or
sale are of a size larger than the lots as shown on the plat recorded herein
and from which said portions are created.
2. LAND USE AND BUILDING TYPE: No lot shall be used except for
residential purposes. No building shall be erected, altered, places, or
permitted to remain, on any lot other than one detached single-family
dwelling not to exceed two and one-half stories in height and a private garag
for not more than two cars.
3, DWELLING COST - QUALITY AND SIZE: No dwelling shall be
permitted on any lot at a cost of less than $20, 000. 00, excluding cost of lan

based upon cost levels prevailing on the date these covenants are recorded,
it being the intention and purpose of the covenant to assure that all dwellings
shall be of a quality of workmanship and materials substantially the same or
better than that which can be produced on the date these covenants are
recorded at the minimum cost stated herein for the minimum permitted
dwelling size.
4. BUILDING LOCATION: No building shall be located on any lot
nearer to the front lot line or nearer to the side street line than the mini-
mum building setback lines shown on the recorded plat. No building shall b
located nearer than ten feet to an interior lot line except that a garage that i
located at least ten feet from the rear of the residence may be located no
nearer than five feet to any side or rear lot line. No dwelling shall be
located on any interior lot nearer than 50 feet to the rear lot lines. For the
purposes of this covenant, eaves, steps, and open porches shall not be
considered as a part of a building, provided, however, that this shall not
be construed to permit any portion of a building on a lot to encroach upon
another lot.
5. NUISANCES: No noxious or offensive activity shall be carried on
upon any lot, nor shall anything be done thereon which may be or may becon
an annoyance or nuisance to the neignborhood. Each and every lot shall be
kept mown and free from weeds and debris at all times, to comply with
county ordinances.
6. TEMPORARY STRUCTURES: No structure of a temporary
character, trailer, basement, tent, shack, garage, barn or other outbuildin
shall be used on any lot at any time as a residence, either temporarily or
permanently.

7. SIGNS: No sign of any kind shall be displayed to the public view
on any lot except one professional sign of not more than one square foot,
one sign of not more than five square feet, advertising the property for sale
or rent, or signs used by a builder to advertise the property during the
construction and sales period.
8. LIVESTOCK AND POULTRY: No animals, livestock or poultry of
any kind shall be raised, bred or kept on any lot, except that dogs, cats
or other household pets may be kept, provided that they are not kept, bred
or maintained for any commercial purpose.
9. SIGHT DISTANCE AT INTERSECTIONS: On any corner lot there
shall be no planting, construction, fences, shrubbery or other obstruction
to vision, more than three feet above the curb level, within 25 feet of the
intersection of any two street lines.
10. ENFORCEMENT: Enforcement shall be by proceedings at law or
equity against any person or persons violating or attempting to violate any
covenant either to restrain violation or to recover damages.
11. SEVERABILITY: Invalidation of any one of these covenants by
judgment or court order shall .in no wise affect any of the other provisions
which shall remain in full force and effect.
12. Easement for the installation and maintenance of utilities and
drainage facilities are reserved where shown on a recorded plat or reservec
in deed of conveyance.
The above and foregoing subdivision of Plymn Owen Estates, Section
Two, more particularly described by survey of H. Bruce Edens, C. L. S.,
as appears in the attached plat, is with the free consent and in accordance
with the desires of the undersigned owners.
