Dear Ms. Daniels:
This letter is in response to your correspondence dated December 1, 2003, to the Zoning Administrator
requesting a zoning determination of a restaurant use located at the above -referenced property. The subject
property is a multi -use business center known as "Country Park Plaza" and is illustrated on Site Plan #015-
88. Restaurant uses (SIC 58) are allowed in the B-2 zoning district provided the proposed site meets all other
requirements of the Frederick County Zoning Ordinance.
An inspection of the site revealed several issues which are considered violations of the approved site plan.
Although a proposed restaurant use is allowed on the subject property, any associated business licenses will
not be approved until the existing conditions are brought into compliance per approved site plan. A revised
site plan may also be required, depending upon the final proposed layouts.
You may have the right to appeal this determination within thirty (30) days of the date of this letter in
accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and unappealable,
if it is not appealed within thirty (30) days. Should you choose to appeal, the appeal must be filed with the
Zoning Administrator and the Board of Zoning Appeals (BZA) in accordance with Article XXI, Section 165-
155A(1), of the Frederick County Zoning Ordinance. This provision requires the submission of an
application form, a written statement setting forth the decision being appealed, the date of decision, the
grounds for the appeal, how the appellant is an aggrieved party, any other information you may want to
submit, and a $250.00 filing fee. Once the appeal application is accepted, it will be scheduled for public
hearing and decision before the BZA.

Dear Bob:
This letter is in regards to a meeting between Mr. Thomas Glass and
myself this afternoon. Hopefully, this letter will explain the
revision of this site plan in more detail.
As you know, the original plan would encourage stacking of cars by
the approved entrance. The proposed revision of this plan removes
the gas pad/pumps away from this entrance and allows for a better
traffic flow through this site. I have advised Mr. Glass of the
fact that Greenwood Road will be widened to fifty (50) feet in the
immediate future. Mr. Glass is aware of this fact and feels that
this plan will still work.
Please look this over, and if you think it will work give me a
call. Once I have discussed this revision with you, I will advise
Mr. Glass on his procedure.

SITE PLAN INSTRUCTIONS
Frederick County Department of Planning and Development
A site plan must be approved by the County before building in the
following zoning districts:
R-4 Residential Planned Community District
R-5 Residential Recreational Community District
B-1 Business Neighborhood District
B-2 Business General District
B-3 Industrial Transition District
B-4 Business Shopping Center District
M-1 Light Industrial District
M-2 Industrial General District
A site plan is also required for the following types of
construction:
1. Any development in which shared parking is proposed for more
than one establishment.
2. Additions to buildings in business or industrial zones.
3. All public and/or semi-public buildings.
4. Any residential use containing three or more dwelling units
in a single structure.
STEPS FOR APPROVAL OF A SITE PLAN
Preliminary Review Conference: In association with the
submission of a site plan, a preliminary review conference must
be held between the applicant (or his representative) and the
County planner in charge of reviewing the site plans. The
purpose of the preliminary review conference is to discuss the
proposed site plan in relation to County requirements.
Application and Agen Comments: In association with the site
plan, the applicant must complete the application forms and check

list attached. In addition, it is the responsibility of the
applicant to obtain comments from various review agencies using
the attached forms. The applicant may not be required to obtain
comments from all the review agencies listed and should check
with the planning staff to determine which agency comments are
required. In order to obtain the agency comments, the applicant
should submit 2 copies of the site plan with the comment sheet to
each required agency.
Submission of Site Plan: In order to apply for site plan
approval, the applicant must submit the completed application
forms and agency comments, together with three (3) copies of
site plan to the Frederick County Planning Department. The site
plan should be prepared by a registered engineer, architect, or
surveyor and should meet all requirements of the Frederick County
Zoning Ordinance.
In addition, It will be the responsibility of the applicant to
submit a review package for the consulting engineer consisting of
two (2) copies of the site plan, a copy of the application, and a
copy of each agency review comment with any copies of the plan
marked or notated by the review agency.
Staff Review: As a part of the review of the site plan, the
Planning Department must submit the site plan to review by the
County Consulting Engineer. This package will be in addition to
copies of all materials required by the Frederick County Planning
Department. Review packages will be delivered to the engineer
once a week on every Friday. The engineer will send a copy of
the review to the applicant when it is complete. At that time,
it will be the responsibility of the applicant to contact the
Planning Department to pay fees and insure that the application
is complete.
Payment of Fees: Before the site plan can be approved, the
applicant must pay review fees as specified on the attached
schedule. It will be the responsibility of the applicant to
contact the Planning Department to pay the fees.
Review of Site Plan by Planning Commission: The site plan will
be listed in each bimonthly report of the Planning Commission
agenda from the date of submittal until it is approved. If the
Frederick County Planning Commission wants to review the site
plan, it makes this request, and the plan is presented by the
applicant at the next regular meeting. The Planning Commission
can approve, approve with revisions, or deny the site plan. If
the Planning Commission request to review the site plan, all
materials must be submitted and reviews completed at least twelve

working days before the Planning Commission meeting, in order for
the plan to be placed on the agenda.
If the Planning Commission does not request review of the site
plan, the Zoning Administrator may proceed with final approval of
the site plan. However, the site plan must be listed on the
Bimonthly Report of the Planning Commission at least once before
it can be approved.
In addition, the Zoning Administrator may determine that any site
plan shall be reviewed by the Planning Commission because of the
scale or intensity or the potential impacts of the proposed
development.
Final Approval: Site plans receive final approval from the
Zoning Administrator once all requirements of the Frederick
County Zoning Ordinance and all requirements resulting from
Planning Commission review have been met. The site will be
inspected before final occupancy is granted to insure that all
requirements have been met.

As requested we have e a ve referenced site plans dated
December 10, 1989. We are very concerned about the proposed location of the
gasoline pump island as it relates to the existing Route 657 entrance. If
"stacking" should occur at the pump island then safe egress and ingress
through this entrance could be affected. Therefore, causing a severe traffic
hazard at this very busy intersection.
We recommend shifting the island away from the entrance as detailed on the
attached site plan marked in red.

As requested, a review of the site plan to the above referenced location has
been made. The traffic engineering and drainage sections from our District
Office over the following comments.
1. Curbing should be installed along the right-of-way to control parking and
access.
2. The eastern entrance on Route 657 should be shifted to the west away from
the intersection of Route 656 so a minimum of fifty (501) feet separates
the two (2) radii.
3. Entrance widths should be a minimum of forty (40') feet instead of the
proposed thirty (30') feet as shown on the plans.
4. Curb and gutter offset from the road should be a minimum of eight (8')
feet to the face of gutter pan due to the high volume of traffic on
Route 657. With additional development in the area, this office
recommends consideration of a ten (10') feet offset to facilitate widening
of roadway in the future. Offsets should end with three (3) to one (1)
asphalt taper sections.
5. A standard DI-7 Drop Inlet should be used in lieu of in walls on the north
side of Route 657 between the two (2) entrances.
Our comments have been shown on the proposed plan which I am returning. If we
can be of further assistance, please advise.
