Dear Greg:
This letter is in reference to the site plan requirements for
Brookland Heights Subdivision on Valley Mill Road. Hopefully, this
letter will help you plan your strategy for completing all site
work while simultaneously receiving your Final Certificate of
Occupancy Permits.
Our records indicate that there are approximately seventy (70)
units that still require finals. That should allow you enough time
to contract any help needed to finish the site work while receiving
finals for closing purposes. The requirements that I will be
looking for during my inspections are as follows.:
I. Completion of all curb and guttering.
2. All parking and maneuvering areas to be double prime and
seal or better surface.
3. Demarcation of all parking spaces.
4. Hydroseeding all lots and areas of common open space.
5. All landscaping vegetation. -
6. Provisions for all recreational requirements..
(5 recreational areas and 3 gazebos);-
7. All buffer.requirements.
The majority of this site work is generally finished when I do my
inspections;- however, I_would suggest that you look into the
recreational requirements soon as that may take some time to
complete. If all site work is complete with the exception of the
buffer requirements (due to the location of the office trailer) and
you need to final 'out the_ last few units, we can work out some type
of bonding agreement.

Dear Mr. Vickers:
This letter is in reference to the site plan requirements for the
Brookland Heights townhouse project being developed by your
company. This project was approved by the Frederick County
Planning Department on October 3, 1988 with the understanding that
all items listed on this approved site plan would be fulfilled.
I have made your off ice, as well as Jim Petry' s off ice aware of the
fact that the required tot lots.�need to be installed.,': The units
should have been completed at 60% occupancy of this project;
however, this continues to be ignored. I have worked closely with
Greg Unger and Julie Hilton to provide you with the occupancy
permits that are necessary for closing purposes, and have
continually made your office aware of the fact that even though
Oakcrest is not responsible for the installation of these units,
that your occupancy permits would be affected if the units were not
provided.
It is now a year and a.half since your project received approval
to begin construction. My records indicate that 80% of your units
have received occupancy. This leaves me no choice but to hold the
remaining occupancy permits until this problem has been resolved.
I would strongly -suggest that you meet with Jim Petry.and provide
our department with a resolution to this problem.

This is to place in writing those agreements reached on June
19, 1990 in regard to what is commonly called the "Grand Canyon"
problem at Brookland Heights. This agreement was reached after
the following people met on the site: John Riley, Bob Watkins,
Wayne Miller, Evan Wyatt, Johnny Neff, Jim Vickers, Greg Unger,
Chuck Maddox, Harrington Smith, James L. Bowman, Fred L. Glaize,_
III, Jim Petry and myself.
The following things, I believe, were agreed to:
1. That Oakcrest Builders, Inc., G. W. Clifford &
Associates, Inc. and Bowman & Glaize will undertake the project
as outlined on -site which basically consists of extending an 18"
pipe from the existing 18" pipe south of lots 67 and 68 to a new
man -hole which will also connect with a new 15" pipe running from
a northerly direction and through a new man -hole into the same
man -hole. From the new man -hole a 24" pipe will be extended in a
southeasterly direction which will extend just beyond an existing
man -hole just south of Lot 89 and will clear lot 90 which has a
unit with a basement. The area will then be back -filled to cover
the.pipe and to create a terraced effect resulting in two
basically level areas in which playground equipment may be
placed. The pipe will be covered for the entire length that it
is extended. The fill area"will be accomplished by the importing
of material from another area and no material will be disturbed
within the project area with the slopes remaining as they are.
After the fill portion of the project is completed the same will
be -top-soiled and grass seed planted. At that time, the slopes
on the side of the project area will also be seeded as necessary.

2. That this work will be accomplished sometime in the fall
when the children have returned to school and are not present at
the site.
3. That in the event that the material is taken from a site
where an erosion control permit is necessitated that the fees for
applying for the same will be waived. Regardless of.the fees
being waived a soil and erosion plan will be developed in
accordance with the regular processes and whatever steps are
necessitated will be observed to comply with the permit that is
issued.
4. That in return for the above the County will waive two
units.of playground equipment in the Brookland Heights
Subdivision, meaning that three units will be installed rather
than five] In addition a credit will be given on one playground
unit at the Huntington Meadows project.
5. That the above referenced project will be undertaken by
G. W. Clifford & Associates, Inc., Oakcrest Builders and Bowman
and Glaize at their expense. The preliminary estimate for
accomplishing this work was $48,000.00 and possibly will remain
somewhere around that figure although the project was somewhat
modified as a result of our meeting.
6. That Harrington Smith, Supervisor, with the assistance
of Wayne Miller, will clear the way with the Property Owners
Association of Brookland Heights and make it possible for the
project to go forward this fall.
7. That of the three units remaining to be placed in
Brookland Heights the same will be spotted by the appropriate
authorities and Jim Petry.notified as to the appropriate
locations in order that the same may be installed in the very
near future.
I believe that the above_ encompasses the agreements reached.
I would say, in passing, that this agreement is the result of the
governmental body -working -with G. W. Clifford & Associates, Inc.,
Oakcrest Builders, Inc., and Bowman and Glaize in order to
achieve something that is reasonable and which we believe will
enhance the Brookland Heights project. It is always difficult to
get so many people together to agree on anything and these matter
can drag on for an extended period of time unless there are
reasonable good faith efforts -to resolve them.

All of the people involved should resolve to keep a candid
conversation going about what problems exist and what actions can
be taken to correct them. G. W. Clifford & Associates, Inc.,
Oakcrest Builders, Inc. and Bowman and Glaize intend to continue
business in this community and are very aware that a working
relationship has to exist with everyone involved.

This letter is in reference to the research I have been conducting
for the parking requirements at Brookland Heights. The original
figure of 568 parking spaces was derived from the dimensional
requirements listed on enclosure A-2. This is the figure that we
base our calculations on for new townhouses. This plan, however,
was submitted prior to the June 30, 1988 amendment date (enclosure
A-1); therefore, I had to calculate the required parking spaces
again using the -dimensional requirements listed on enclosure B-2.
The calculations I came up with require a minimum of 527 parking
spaces. This figure was based upon calculations of 2 and-3 bedroom
units. I gave the Brookland Heights homeowners the benefit of the
doubt when calculating parking spaces as I did not single out the
FMHA units which are all two bedroom units. My calculations are
based on the following:
The parking spaces shown on the Brookland Heights site plan total
534 spaces, which is slightly more than the site plan requires:. I
question the design and layout of the parking on this site plan;
however, it is an approved plan, therefore,.our department has no
legal avenue to pursue to require0akcrest Builders to alter their
plan. I apologize for leading you and the other homeowners to
believe that more parking was required. My eagerness to help your
cause was only topped by my mistake of finding out all of the facts
before presenting them. Once again, I apologize for jumping the gun.

REVIEW EVALUATIONS:
Transportation Department - No objection to the master development plan,
however, before we can make our final comments it will be necessary to submit
a complete set of subdivision plans for our review. The proposed entrances
fronting Route 659 shall be constructed to our minimum requirements. It will
be necessary to apply for a land use permit before any work is done on the
Department's right-of-way.
Sanitation Authority - 1) Metering and sampling station required; 2) Water
meters will be set at property lines.
Greenwood Fire Company - No problem with this plan.
Inspections Department - Shall comply to Use Group R - Residential, Section
309.0, of the BOCA Basic National Building Code 1984.
Planning and Zoning - No objections. This application was submitted before
the RP amendments were adopted. All environmental, open space, use,
dimensional, and buffer provisions are suitable.
Floodplain along Abrams Creek will remain undisturbed and will be in open
space. Approximately 9.755 acres of open space will be provided (30% of
total area). Buffer areas will be required along the eastern boundary of the
development in relation to the Brentwood Terrace, single-family development.

On this date I met with Doug Kiracofe to review fire hydrant locations for Brookland. He was
working off an old set of plans (April 88) which only showed 10 hydrant locations.
Following our review the number and location of the hydrants were good with the exception
of the two hydrant locations. Doug has requested we move the hydrant located at lot 27 to the
open space east across from the proposed parking area. Also, Doug requested us to see if the
hydrant shown at lot 136 could be moved to the traffic isle between lots 132 & 133, some
adjustment would need to be made at this location due to the storm sewer located in that area.
Doug also requested a revised set of plans.
