Gyurisin, Deputy Director SUBJECT: Site Plan for Mr. Robert H. Claytor DATE: February 11, 1988 Mr. Robert H. Claytor has submitted a site plan for business uses in a B-1 zoning district located on the north side of Senseny Road. This site plan shows a 4000 square foot structure, while the B-1 zoning regulations suggest a 3000 square foot limitation, as part of the statement of intent. Please see the attached B-1 zoning regulations. The staff would like the Planning Commission's opinion to help determine if the 4000 square foot structure is acceptable as intended in the B-1 zone. Box 601 - Winchester, Virginia - 22601 ARTICLE X BUSINESS, NEIGHBORHOOD DISTRICT Bal 21-10-1 • ARTICLE X BUSINESS, NEIGHBORHOOD DISTRICT B-1 10-1 STATEMENT OF INTENT The primary purpose of this district is to establish a business district that will serve the surrounding residential districts. Traffic and parking congestion is to be held to a minimum to protect and preserve property values in the surrounding residential districts and, insofar as possible, neighborhood business development should take place in the district. The district should include such activities as are necessary for the day-to-day operation and -convenience of a normal household, and structures should be limited to 3,000 square feet. 10-2 USE REGULATIONS In Business District B-1, structures to be erected or land to be used shall be for one or more of the following uses: 10-2-1 Limited retailing uses, including but not limited to • convenience -type stores, bakeries, and drug stores. 10-2-2 Personal services including automatic self-service laundries, dry cleaning, barber and beauty shops. 10-2-3 Financial institutions. 10-2-4 Public buildings including a library and a post office. 10-2-5 Public utilities such as poles, lines, distribution transformers pipes, meters and/or other facilities necessary for their provision and maintenance, and including water and sewer lines and stations. 10-2-6 Off-street parking as required by this Ordinance. 10-2-7 Business signs 10-2-8 Directional signs. 10-2-9 Accessory residential uses which are within the principal structure and are to be used solely by the owner and/or operator of the principal commercial use. 10-2-10 Commercial outdoor recreation, athletic, or park facilities, only with a conditional use permit; and recognizing the intent of the • district as stated in this Code. 21-10-2 10-3 AREA REGULATIONS For permitted uses utilizing individual sewage disposal systems, the required area shall be approved by the health official. 10-4 SETBACK REGULATIONS 10-4-1 No structure, except signs, shall be located between the setback line and the street, road or highway center line. 10-4-2 The setback line shall be located thirty-five feet (35') or more from any highway, street or road right-of-way which is fifty feet (50') or greater in width or sixty feet (60') or more from the center line of any street with a right-of-way less than fifty feet (50') in width and parallel or concentric to the center line. 10-5 YARD REQUIREMENTS For permitted uses, the minimum side and rear yard adjoining or adjacent to a residential district shall be thirty feet (301). The side and rear yard shall be used only for landscaping, including screening, and for a delivery entrance. A natural or artifical buffer and/or screen shall be maintained to screen the commercial activity from the adjoining residential area. 10-6 HEIGHT REGULATIONS • 10-6-1 Buildings and signs may be erected up to thirty-five feet (35') in height from grade. 10-6-2 No accessory structure which is within twenty-five feet (25') of any party lot line shall be more than one story high.
