Frederick Winchester Health Department - This site plan is
acceptable to the Health Department.
Virginia Department of Highways and Transportation - Strongly
recommends standard cc mrercial entrance be required.
Department of Public Works - This site plan is satisfactory.
Department of Inspections - Structure must comply with require-
ments of use group(s) of the Virginia Uniform Statewide
Building Code.
Zoning - Variance for rear yard setback approved 8/21/79.
Since the rest of the industry was in operation previously,
there is no objection to the Site Plan as submitted.
The Staff recommends approval but suggests that the reccumendation of: the
Virginia Department of Highways be incorporated into the Ccuniission's approval.
Planning Commission Recommendation:
The Planning CourLission unanimously moved to recommend approval to the Board
of C. Edward Shirley Site Plan.

We are in receipt of your revised site plan. While the changes have
now been sent .back to the Department of Public Works for review, I
thought I should notify you that the rear property line cannot pass
site plan or building permit approval. When you were issued your
permit for a slab only during the rezoning application, your rear
line was listed on the building permit as fifty feet_ Fifty feet
is the amount of space rear yards require by the ordinance_
Your site plan submittal shows the building has been placed within
34.4 feet of the rear property line. Neither your site plan nor
your building permit for your building can be approved as it stands
now.
I talked with your attorney, Mr. Schultz, today and advised him that
an appropriate action for you to pursue is to attempt to obtain a
variance from the terms of the zoning ordinance which can only be
granted from the Board of Zoning Appeals. Since the Board of Zoning
Appeals only meets every other month, it will be necessary for your
completed application and $20.00 application fee to be in this office
by July 17, 1979 for your application to be heard by the Board of
Zoning Appeals August 21, 1979. Your attorney has been furnished
with application and your latest submitted site plan will serve as
plot plan submittals for the variance request.
If we do not receive your application for variance by July 17, 1979,
this office will be forced to assume that you do not wish to pursue
this remedy and will, at that time, serve notice and institute

I am enclosing a copy of your site plan as submitted_ Please have your
surveyor add the following additions and/or corrections that were sub-
mitted by the various reviewing agencies:
1. Show side and rear yard dimensions to new building;
2. Show existing and proposed utilities of all types;
3. Show zoning of tract.
4. Proposed use for all buildings.
S. Provision and schedule for the adequate control of eroision
and sedimentation, indicating proposed temporary and permanent
control practices and measures which shall be implemented
during all phases of clearing, grading and construction.
(Contact Stan Pangle, Director of Public Works, for the
requirements.)
6. Show typical street sections.
7. Designate all current outside storage areas. Note that future
expansion of outside storage will only occur within a
screened area.
The Virginia Department of Highways and Transporation strongly recommends
that a standard commercial entrance be required.
If you feel that you do not wish to install such, an entrance, do not include
it on your revised site plan and you can discuss it with the Planning
Commission at their meeting.
It would be necessary for the revised site plan to be in irly office by
