We have received your revised site plan dated July 10, 1997 for the referenced project.
It appears all of our earlier review comments have been satisfactorily addressed.
Please advise the owner of our approval.
Since an extensive period of time has lapsed on the approval dated 01/03/91 this
approval supersedes that approval.
The appropriate land use permits may now be applied for to cover work within the
Route 784 right-of-way. The permits are issued by this office and will require a
minimum processing fee, surety bond coverage, and the salary & expenses of a State
assigned Inspector.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue.

RE: Winchester Warehousing Site Development Plan #052-90
Dear Mr. Markle:
This letter is provided in follow up to the site inspection I conducted at your facility on December 11, 1997.
Among other things, we discussed the clearing of an area of trees and the elimination of a berm within the front
yard setback during the development of the property. These trees, along with berm, were identified as protected
on the approved site plan. The primary reason for the protection of these trees and the maintenance of a berm
was to fulfill the required "C" category zoning district buffer with a full screen. This full screen must be
replaced before a certificate of occupancy will be issued for this facility.
The adjoining property along Smithfield Avenue is zoned RP (Residential Performance), thus constituting the
need for a "C" category zoning district buffer. The Board of Zoning Appeals, variance 4031-89, granted a 50'
buffer variance on the east, west, and south sides of the property for a warehouse. This was a reduction in the
distance only and not a reduction in the level of screening. Furthermore, in October of 1990, the Planning
Commission approved the site plan with the required buffering in place along the east, west, and south sides
of the property. In lieu of maintaining the existing trees and berm, a full screen that meets the requirements of
the zoning ordinance should be placed along the west side of the property within the front yard setback and
between the limits of the two entrances. I would be happy to discuss the requirements of a full screen with you
in more detail.
The paving of the entrances to the facility and the shoulder of Smithfield Road, along with the paving of the
fire lanes and parking and loading areas, should also be completed prior to the issuance of a Certificate of
Occupancy for this facility.

function pursuant to the requirements of Chapter 144, Subdivision Ordinance, and/or Chapter 165,
Zoning Ordinance, of the Frederick County Code and pursuant to the agreement of the Subdivider,

Developer, or his agent to comply with said ordinance as a condition of the approval of the
subdivision or site plan to the satisfaction of the Zoning/Subdivision Administrator."
We hereby engage with drawers, endorsees and bona fide holders that all drafts drawn in compliance
with the terms of this credit shall be duly honored upon presentation and delivery of the above
documents. This Irrevocable Letter of Credit shall remain in full force and effect for a minimum
of one (1) year from the date hereof and shall be automatically extended for additional terms of six
(6) months from the present or future expiration dates, unless sixty (60) days prior to such date or
dates, the above named bank or financial institution issuing the instrument, notifies the County in
writing by certified mail, that they elect not to renew the instrument for such additional period.
During the last thirty (30) days while this Letter of Credit is in force and effect after notice of
termination has been given, the County may draw up to the full amount of the sum when
accompanied by a document stating that

In consideration of VDOT General Note Number 4, we have reviewed previously
approved (01 /03/91) plans for the referenced project. In view of the length of
time lapsed and to update the project to current standards, we have the
following comments as shown in red on the plan sheets:
Sheet 2 of 5
1) The typical section for widening Route 784 should be revised to reflect
extending the base stone 1' beyond the curb & gutter and adding a UDA the
entire length of the curb & gutter.
2) Drainage easements should be provided ai the outlet of Culvert B and the
one on Structure C.
3) A note should be added to the affect "VDOT is absolved from any
liability/maintenance responsibilities for the on site detention pond".
4) Trip generation volume and source (I.T.E. Trip Generation, 51h Edition) is
needed.

5) The VDOT Detail Drawings should be checked to determine if they are
current with updated standards and specifications. Add CG-12 curb ramps

Dear Wayne:
Based upon our recent discussions, I started to extensively research the zoning
and development code changes that would impact the above referenced site plan
for submittal for your review. The intent was to allow for the extension of site
plan approvals until construction can start. Since the site development plan
#052-90 has been approved, a water line has been installed upon the site.
he April 27, 1992 Winchester Warehousingsite development Plan (#052-90)
wa extension o one year until May,1994) My recent request was to
determine what was needed to keep the current, approved site plan active and
valid. Your answer was to note code changes and to have the plan re -reviewed
by certain plan review agencies if needed. Based upon the noted code changes,
their impact on the site, and the review agency comments the site plan could be
administratively extended or it may have to be resubmitted as a new site
development plan depending upon the nature of the changes and comments.
With these directions in hand, I began to pursue a plan of action with
Winchester Warehousing to extend and update their site plan. I stopped,
however, after reading the Code of Virginia, 1950; 1994 Cumulative Supplement
Annotated; Volume 3A; § 15.1-475. Plat of proposed subdivision and site plans
to be submitted for approval; I F.; G.; H. A copy is attached for your reference.
Based upon review of the above referenced code section the Winchester
Warehousing site develmnent plan #052-90 a0prove on pril 27, 1992 hould

subdivision plats for tentative approval. The local agent designated by the
local commission or the agent designated by the governing body to review
preliminary subdivision Plats or the local commission shall complete action on
such preliminary plats within sixty days of submission to such agent. However,
if approval of a feature or features of the preliminary plat by a state agency is
necessary, the local agent shall forthwith forward the preliminary plat to the
appropriate state agency or agencies for review.
2. Any state agency making such a review of a Plat forwarded to it under
this section, including, without limitation, the Virginia Department of Trans-
portation, shall complete its review within forty-five days of receipt of such
preliminary plat. If the state agency does not approve the plat, it shall comply
with the requirements, and be subject to the restrictions, set forth in the
second paragraph of this section (except for the time period therein specified).
Upon receipt of the approvals from all state agencies, the local agent shall act
upon a preliminary plat within thirty-five days.
3. If a planning commission has the responsibility of review of preliminary
plats and conducts a public hearing, it shall act on such plat within forty-five
days after receiving approval from all state agencies. If the local agent or
commission does not approve the preliminary plat, the local agent or commis-
sion shall set forth in writing the reasons for such denial and shall state what
corrections or modifications will permit approval by such agent or commission;
provided, however, that no local commission or agent shall be required to
approve a preliminary subdivision plat in less than sixty days from the date of
its original submission to the local commission or agent, and that all actions on
preliminary subdivision plats shall be completed by the local agent or commis-
sion and, if necessary, state agencies, within a total of ninety days of
submission to the local agent or commission.
4. If the local commission or other agent fails to approve or disapprove the
preliminary plat within ninety days after it has been officially submitted for
approval, the subdivider after ten days' written notice to the commission, or
agent, may petition the circuit court of the county or municipality in which the
land involved, or the major part thereof, is located to enter such order with
respect thereto as it deems proper, which may include directing approval of the
plat.

agent may, at the time of approval, determine to be reasonable, taking into
consideration the size and phasing of the proposed development. A site plan
shall be deemed final once it has been reviewed and approved by the locality if
the only requirement remaining to be satisfied in order to obtain a building
permit is the posting of any bonds and escrows.
E. 1. Upon application of the subdivider or developer filed prior to expiration
of a recorded plat or final site plan, the local commission or other agent may
grant one or more extensions of such approval for additional periods as the
local commission or other agent may, at the time the extension is granted,
determine to be reasonable, taking into consideration the size and phasing of
the proposed development, the laws, ordinances and regulations in effect at the
time of the request for an extension.

an approved development in accordance with the lawful terms of the recorded
plat or site plan unless the change or amendment is required to comply with
state law or there has been a mistake, fraud or a change in circumstances
substantially affecting the public health, safety or welfare.
G. Application for minor modifications to recorded plats or final site plans
made during the periods of validity of such plats or plans established in
accordance with this section shall not constitute a waiver of the provisions
hereof nor shall the approval of such minor modifications extend the period of
validity of such plats or plans.
H. The provisions of this section shall be applicable to all recorded plats and
final site plans valid on or after January 1, 1992. Nothing contained in
subsections D, E, F, G and H of this section shall be construed to affect G) any
litigation concerning the validity of a site plan pending prior to January 1,
1992, or any such litigation nonsuited and thereafter refiled; (ii) the authority
of a governing body to impose valid conditions upon approval of any special use
permit, conditional use permit or special exception; (iii) the application to
individual lots on recorded plats or parcels of land subject to final site plans, to
the greatest extent possible, of the provisions of any local ordinance adopted
pursuant to the Chesapeake Bay Preservation Act (§ 10.1-2100 et seq.); or (iv)
the application to individual lots on recorded plats or parcels of land subject to
final site plans of the provisions of any local ordinance adopted to comply with
the requirements of the federal Clean Water Act, Section 402 (p.) of the
Stormwater Program and regulations promulgated thereunder by the En"i-
ronmental Protection Agency. (Code 1950, §§ 15-789, 15-967.10; 1952, c. 333;
1962, c. 407; 1964, c. 498; 1975, c. 641; 1977, c. 10; 1978, c. 283; 1979, c. 111;

amended this section, in cl. 2, provided that the
provisions of the 1992 act would expire on July

earlier disapproval. -Although this section
requires planning commission action within 60
days after submission of any plat, the commis-
sion should not be required to consider a plat
covering property which was the subject of an
earlier disapproved plat, when that disapproval
is on appeal, either to the council or the courts.

Prohibition of property use for landfill.
- The board of supervisors acted well within it

erty for landfills since the language of this
section is sufficient to allow a local governing
body to prohibit the use of property for a landfill
altogether, and the language is also sufficient,
by necessary implication, to permit a local
governing body to prohibit the use of property
for that purpose by a private person or entity.

Landowner did not acquire vested right
in zoning classification. — Where although
the landowner had filed a proposed subdivision
plat and a site plan, neither the plat nor the
plan had been approved by the local planning

landowner did not acquire a vested right in the
zoning classification which existed before the

§ 15.1-477. Statement of consent to subdivision; execution; acknowl-
edgment and recordation; notice to commissioner of the revenue or
board of real estate assessors. — Every such plat, or deed of dedication to
which the plat is attached, shall contain in addition to the professional
engineer's or land surveyor's certificate a statement as follows: The platting or
dedication of the following described land (here insert a correct description of
the land subdivided) is with the free consent and in accordance with the desire
of the undersigned owners, proprietors, and trustees, if any. The statement
shall be signed by such persons and duly acknowledged before some officer
authorized to take acknowledgment of deeds. When thus executed and ac-
knowledged, the plat, subject to the pro�risions herein, shall be filed and
recorded in the office of the clerk of court where deeds are admitted to record
for the lands contained in the plat, and indexed in the general index to deeds
under the names of the owners of lands signing such statement, and under the
name of the subdivision. Owners shall notify the appropriate commissioner of
the revenue of improvements to real property situated in platted subdivisions.

The Frederick County Planning Department administratively approved Site Plan #052-90
of Winchester Warehousing on April 27, 1992. The approved site plan calls for the
construction of a 67,500 square foot warehouse, 25 feet in height, the installation of two fire
hydrants and a siamese connection, the installation of two fire lanes that are at least 20 feet
in width, a full landscaped buffer complete with a six foot high solid board fence, existing
mature trees, and the addition of all new trees necessary to adequately screen the east, west,
and south property lines, the installation of curb and gutter along Smithfield Avenue, and
all appropriate erosion and sediment control measures.

meet the intent of Section 3-12-2.1 of the Zoning Ordinance.
All other staff concerns regarding this project are currently
being addressed by Mr. Scott Marsh of G.W. Clifford and

Project Description -
This project involved is being developed by Winchester Warehousing.
The type of construction is a warehouse facility. The project will also involve
extension of water and utilities to the warehouse site. The total developed area is
approximately three acres.
Existing Site Conditions -
Prior to construction, the site was characterized by gently sloped terrain,
moderately wooded with heavy undergrowth. The site is in the Frederick-
Poplimento-Oaklet Soil Association. The area is generally characterized by
gently sloping, very deep, well drained soils that have a fine textured subsoil;
formed in material weathered from limestone.
Adjacent Areas -
The areas to the west and north of the site are industrial in nature. The
portions to the south are residential. The area to the east is of vacant use, but
zoned RP.
Soils -
For purposes of design runoff conditions, antecedent moisture condition H
(normal consideration for the mid -Atlantic region) is assumed. The soil is
considered to have a moderate rate of water transmission, therefore, SCS Soil
Class "B" is adopted. Soils are of the Frederick type (16 B). A copy of the
respective soil may is enclosed.
Permanent Stabilization, -
Seeding for permanent stabilization is specified in the V.E.S.C.
Handbook. Any area denuded in which work is not proceeding for a period of 30
days or more will be stabilized by a temporary seeding in accordance with State
guidelines and procedures. All areas to be seeded will receive seed application by
•
•
hydroseed methods immediately upon obtaining grades.
Storm Water Management Consideration -
A copy of the site plan has been attached.
All drainage from the site will be channeled to a narrow detention pond
located along the east west property line, east of the new warehouse site. The
pond will detain the 10 year post development flow from the site to below two
year predevelopment levels.
The drainage areas and flow calculations are on sheet 3 of 5 of the plans.
The detention pond routing calculations are attached.
All erosion and sediment control structures and details are specified in
the plans.
Maintenance -
All soil erosion control structures shall be checked weekly by the
contractor during his construction period and after construction is completed until
grass cover is established. Sediment retained by these structures shall be
continuously removed and placed in an area of the site specified, damage to soil
erosion control structures shall immediately be repaired when identified by the
contractor. The contractor shall cooperate with all agents of the County, the
Engineer and others who may identify needed facilities or work in order to protect
the environment within the subject of this report.

SITE PLANS
Revised Site Plan #009-90 of Abundant Life Christian Center for a church in the
Opequon Magisterial District.
Action - Approved
Chairman Golladay turned the chair over to Vice -Chairman Sherwood and
abstained for discussion and vote, due to a possible conflict of interest.
Mr. Wyatt said that the site plan was approved on May 18, 1990 and
construction is underway. He said that Abundant Life has submitteed a revised site plan
to exclude the double row of red cedar along the parking lot. Mr. Wyatt noted that the
zoning ordinance allows the Planning Commission to waive buffer requirements on the
property line when adjacent uses are the same.
Mr. Malcolm Van de Riet, Pastor of the Abundant Life Christian Center,
felt that since churches were permitted in residential zoning, nothing more should be
required of them than would be required from a residential use.
The commissioners were concerned about automobile headlights shining into
adjacent homes. The staff suggested a two -foot hedge instead of a full screen for the
property.
Upon motion made by Mr. Thomas and seconded by Mrs. Copenhaver,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously approve Revised Site Plan #009-90 of Abundant Life Christian Center with
the condition that the parking lot include landscaping that would protect adjoining
residences from automobile headlights. This property is located on the west side of
Route 647, opposite Frederick Road intersection, near Stephens City, in the Opequon
District.

Mr. Wyatt reported that the applicant had received a variance to reduce
the required 100' full -screened buffer to a 50' full -screened buffer on the south, east and
west sides of the property. Mr. Wyatt noted concerns from the City of Winchester
regarding the fire lane within the buffer area, the potential effects of the proposed
grading adjoining the residential properties along Green Street, and the type of screening
to be used.
Mr. Scott Marsh, Engineer for G. W. Clifford & Associates, presented the
site plan to the Commission. Mr. Marsh pointed out that the existing entrance would
be utilized, there will be no vehicular traffic around the building; only one employee will
be available at the facility; no sewer facilities would be available --the existing bathroom
in an adjacent building will be used; curb and gutter will be installed along Smithfield
Avenue and pavement widened by two feet.
Mr. Gary Chrisman, Winchester City Council member, presented a
resolution from the City. The three main concerns of the City were: 1) that a
connection with Fort Collier Road or adjacent Dominion Knolls be provided to allow
vehicle access from the county so that not every vehicle would need to use city streets
to get to the development; 2) Since the 100' buffer requirement was reduced by the
Board of Zoning Appeals, the fire lane should not be considered a part of the passive
buffer and the existing trees should be saved and also made a part of the buffer; 3) The
fence should be located north of the berm and trees as opposed to the south, to protect
the residences to the south.
Upon motion made by Mrs. Sherwood and seconded by Mr. Rinker, the
City's resolution was made a part of the official record, by unanimous vote. (resolution
at end of minutes)
Ms. Karma Crawford, resident of Green Street, suggested that a solid,
opaque wall be used as a screen between the warehouse and residences.
The Commissioners discussed the concerns raised by the City of Winchester.
It was decided that the security fence would be placed inside the tree buffer, if allowed
by the applicant's insurance carrier.
Mr. Rinker noted that during previous worksession discussions regarding this
plan, it was suggested that the existing Health Department entrance be moved off of
Smithfield Avenue and a "T-intersection" created to control traffic. Mr. Marsh responded
that the location of the Health Department's drainfield limited access to the property.
With regard to the City's concern about using city streets for access, Mr.
Stiles said that it may be possible to gain access to Fort Collier Road through the
temporary cul-de-sac at the northeastern end of this property; and if this was not
possible, when the site plan and subdivision plats are submitted for Dominion Knolls
and Hampton Chase, the commission could work with the developers to amend the
master plans to provide a connection to this development.

unanimously approve Site Plan #052-90 of Winchester Warehousing for a warehouse on

Amended Conditional Use Permit #001-86 of Mark and Cheryl Anderson for expansion
of the existing kennel per Site Plan #047-90. This property is located on the north side
of Route 836 in Stephenson, Stonewall Magisterial District.
Action - Approved
Mrs. Cheryl Anderson, the applicant, described the expansion of the kennel
facilities to the Commission. Mrs. Anderson stated that the dogs would be completely
enclosed and she described the structure planned. She said that insulated ceiling tiles
and skylights would be used.
Chairman Golladay called. for public comment and the following persons
came forward to speak in opposition:
Ms. Tina Bragg, neighbor to the Andersons, felt that increasing the number
of dogs would increase the intensity of noise from dogs and traffic; she was concerned
about the welfare of the dogs being restricted to indoor kennels; she said that the section
of the road owned by the state has not been maintained.
Mr. Eston Rudolph, neighbor to the Andersons, said that noise from
barking dogs has always been a problem.
There was some discussion regarding the adequacy of the road, and Mrs.
Anderson said that she would be willing to widen the road, if the neighbors would agree
to donate property.
It was generally felt that the proposed new facility would be an
improvement to the noise situation at the kennel. Mr. Stiles requested that the applicant
look into the possibility of using vermiculate insulation inside the blocks of the exterior
walls before the Board of Supervisors meeting.

Background information indicated that the lots in this area
were laid off at a slight angle to the street and the houses were
placed parallel to the street causing one corner of the houses to
be closer to the property lines. Staff comments noted that other
properties were divided by a high wood fence and this request would
have no adverse impact on the neighborhood if approved.
Mrs Alice G. Bichel, property owner, stated that she desired
to build a one car attached garage and was requesting a 3' setback
variance at the rear of the property.
Upon motion made by Mr. Sempeles and seconded by Mr. Wakeman,

Appeals does hereby unanimously approve Variance #030-89 of Alice
G. Bichel for a 3' rear yard variance. This property is located

ACTION - APPROVED
Staff comments noted that the hardship in this case was the
fact that the property, zoned M-2, is surrounded on two sides by
residential areas. Enforcing the 100' buffer variance would
proable render the property useless. A 50' buffer requirement
would seem appropriate if the use of the property was limited to
warehousing.
Jim Markle, representative of Winchester Warehousing,
explained that the metal building would be 225 ft. wide and 350 ft.
long. He said that Winchester Warehousing purchased the property
in 1979, at which time there were no requirements for a buffer.
Mr. Markle stated that if this buffer was enforced, 70% of the
property will be in buffers and 30% useable for the owner.
Winchester Warehousing is requesting a 50/50 buffer.
Mr. Scott Marsh of Clifford and Associates presented a drawing
of the proposed building and explained that there would be no daily
activity on the residential sides of the warehouse. Mr. Marsh was
questioned by the Board and confirmed the fact that there would be
no doors or loading docks on the south side of the building and
that truck traffic would not deviate from the present situation.

Speaking in opposition of the variance was Brian and Susan
Carter of 308 Green Street. Their concerns included depreciation
of property value, the possibility of additional traffic and noise,
and upkeep of the property. Mr. and Mrs. Carter expressed their
concern for the safety of the neighborhood children considering the
warehouse would be surrounded by a wire fence causing a temptation
for children to climb the fence.
The Board explained that if the buffer variance is enforced
the building can still be built resulting in the same traffic and
fencing. Other Green Street residents were present to voice their
concerns regarding traffic, property value and privacy.
Mr. Robert Solenberger, owner of the property and treasurer
of Winchester Warehousing, was present and he stated that he felt
warehousing was the best use for this piece of property.
Mr. Marsh explained that the building would be used for dry
storage and that there would be no manufacturing activity.
Upon motion made by Mr. Sempeles and seconded by Mr. Wakeman,
BE IT RESOLVED That the Frederick County Board of Zoning Appeals
does hereby unanimously approve Variance #031-89 of Winchester
Warehousing for a 50' buffer variance on the east, west and south
sides of the property located on Smithfield Ave., adjacent to the
Winchester city line, in the Stonewall Magisterial District. This
parcel is identified as parcel #73 on tax map 54.
Variance Application #033-89 of Nickson P. Turner for a 10' rear
yard variance. This property is located on Route 645 in the
Shawnee Magisterial District.
ACTION - APPROVED
Staff comments stated that this structure was built in the
setback zone and since there are no visible adjoining residences
approval of this variance should cause no impact on the area.
Mr. Nick Turner, owner of the property, was present to speak.
He stated that he wished to get this variance approved so he could
continue to use the structure. Mr. Turner explained that the
building was erected by the previous property owner and that he
purchased the property in September 1989.
It was noted by a staff member that the previous owner was not
aware of the location of the property lines when he built the
structure.
No one was present to speak in opposition of this variance.

As requested we have reviewed the above referenced site plan dated November 1, 1991.
Our recommendations may be found on the enclosed plans marked in red and as follows:
1. The typical section for the lane widening along Route 784 should be increased to 6'
from the edge of pavement to the face of curb to align properly with the existing
curb and gutter offset at the City Limits. This lane widening will require the
adji:stment/relri)cation of existing utilities. This cost would be the developer
responsibility.
2. The existing entrance to the facility is to be widened to a minimum 50' from face of
gutter pan to face of gutter pan to accommodate the turning movement of tractor
trailers. A standard CG-6 radius should also be provided on the north eastern side
of this entrance.
3. Because of a sag in the Route 784 roadway a drop inlet (standard DI-3A) should be
provided at the location noted. A 15" pipe should also be provided at proposed
Structure r8 to intercept drainage from behind the curb line.
4. The proposed 8" wate main should be relocated from under the proposed curb and
gutter. Also, the proposed fire hydrant should be set at the right-of-way line.
5. The proposed typical section should be revised as noted.

This is to acknowledge receipt of the above referenced project's site plans
dated June, 1990. Upon preliminary review please find our comments on the
plans marked in red and as follows:
1. The existing CG-6 curb and gutter which ends at the Winchester Corporate
Limits should be extended across this property's frontage and the two (2)
substandard gravel entrances serving the property upgraded to our minimum
commercial standards. The proposed fire access entrance should also meet
our minimum standards as well.
2. A storm sewer system should be designed to accommodate drainage from the
curb and gutter section.
3. Existing and proposed utilities should be clearly shown on the site plan.
4. The existing trees adjacent to the proposed fire access entrance are to be
removed as necessary to provide for minimum sight distance.
5. There was some confusion over the submitted predicted traffic totals for
they indicated the project to be on Imboden Drive.
Please revise the plans in accordance with the aforementioned and resubmit
three (3) copies for further review.

On behalf of the City of Winchester I respectfully request that you notify
the Frederick County Planning Commission of our desire to have this item
placed on the agenda for public review based upon potential impacts on
surrounding properties.
Following discussions with you and Evan, I met with Scott Marsh of Clifford
& Associates, Inc. to review the plans and to obtain a better understanding
of the site plan requirements as they apply to this development. While other
comments will be noted on the plans returned to the applicant, our primary
concerns pertain to the activity occurring within the fifty (50) foot buffer
along the south side of the property. You will recall that the BZA granted
approval to allow this buffer to be reduced.
It is unclear as to the proportion of this reduced buffer that must be
inactive. At a minimum, the 3:1 ratio of inactive to active area would seem
logical. Installation of the fire lane within this buffer area greatly
reduces the width of natural area provided for installation of screening
and/or landscaping. This should not be taken to underscore the importance of
the fire lane --just the proximity of it within the buffer area.
A second area of concern is the grading adjacent to the residences along the
north side of Green Street in the City. [chile construction of a berm is
admirable, the affect upon drainage and the ability to undertake such
grading immediately along the property line needs to be investigated
further. Some of the changes between existing and proposed grade exceed two
feet and may require off -site temporary grading easements. A preferred
alternative would be to specify an undisturbed zone along the property line
of sufficient width to preclude potential off -site impacts. Given this
concern, please notify me if advanced land disturbance is requested.
As to the improvements within the buffer area, the screen buffer detail
depicted on Sheet 3 of 5 does not seem consistent with the buffering
requirements of Section 3-12-2.1 of the ordinance. A more dense screen of
greater opacity seems required. It would be much appreciated if the
applicant could discuss screening alternatives (e.g. evergreens vs. opaque
fence) with each of the five immediately adjacent homeowners. Further, it
would be desirable to have the 8-foot chain link fence with the three
strands of barbed wire placed between the screen and the building instead of
o the
property line if this is possible.

The applicant is to be ccnniended for situating the active truck loading and
drive area to the north end of the site far from the residential area and
somewhat screened fiat Smithfield Avenue/Brick Kiln Road. While the
developer has the right to place the building within fifty feet of the
adjacent residential districts as granted by the BZA, it is all the more
critical that the remaining buffer area provide an effective screen.
I would be most willing to work with your staff or with Scott Marsh to
explain the development proposal with the adjacent han awners along Green
Street. Thank you for for your time in reviewing this matter and for
bringing this to the attention of the Planning Commission.

iately to the west of the intersection with Butler Avenue, which has since
been eliminated and replaced with a curved extension of Butler Avenue:
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Win-
chester that the City hereby expresses the following concerns regarding the
Hampton Chase and adjacent development:
1. A street connection should be pursued providing access to Fort
Collier Road from the subdivision, even if such access requires
County consideration of condemnation on the small sliver of
property precluding such connection;
2. As an alternative to a direct connection to Fort Collier Road, a
connection should be provided to the Dominion Knolls property
immdiately to the east, thereby providing access to streets
away from lower density residential neighborhoods;
3. The buffer reduction granted by the Frederick County Board of
Zoning Appeals for Winchester Warehousing should not have been
granted so as to preclude or hamper the likelihood of a connec-
tion from the Hampton Chase development as shown on the approved

Dear Wayne:
We have reviewed the subject site plan and have the
following comments:
STORMWATER MANAGEMENT PLAN:
The sizing of the stormwater detention facility seems
adequate. However, we do not totally understand the
rationale (specifically the inflow hydrograph) used in
arriving at the rainfall volumes for designing the
structure. Applying the modified rational method for a
60-minute storm event, the storage volume requirement
is slightly less than that used. Therefore, it appears
the design is on the conservative side.
GENERAL COMMENTS:
1. On Sheet 4, the detention dam clay core elevation
should probably read 718.4' instead of 81.4'.
Also, the 2, 10, and 100-year elevations should be
100' higher than shown.
2. The zoning for Smithfield Square Section II should
be shown on the site plan.
Once these minor changes are made, we recommend plan
approval.
