Box 601 9 Court Square Winchester, VA 22601 Attn: Evan Wyatt Re: Frederick House Parking Requirement Dear Mr. Watkins: I'm writing this letter in regards to the meeting held in your offices pursuant to the discussions I have been having with Mr. Evan Wyatt of your staff on the above mentioned project. As you are aware, we have designed Frederick House, a 48-unit elderly housing development with 50 parking spaces for 48 units. This is a ratio of 1.04 spaces per unit of off-street parking. We would request that per Section 3-3-1.1 of the Frederick County Zoning Code the Zoning Administrator allow some variation in the standards for required parking, which in this case would be 91 spaces for the 48 designated units. I believe that we have enumerated and included ample evidence to suggest that the 50 parking spaces is, in reality, more than adequate for a development with the tenant base required under regulatory agreements filed with the U.S. Department of Housing & Urban Development, for a project of this type. Our reasons for asking this are as follows: 1) An additional 41 parking spaces would negatively impact on the green space and aesthetic value of the site and will at the same time provide no real positive advantage to the project in terms of additional parking for the tenants/visitors as off-street parking areas are typically under utilized. 2) Forty-one (41) parking spaces would represent an additional 9 percent of the site to be hard surface and would significantly affect the amount of storm -water runoff which would have to be controlled. 3) The United Methodist Housing Development Corporation headed by Rev. Robert Regan of Fredericksburg, VA is an experienced manager of affordable elderly housing such as this project and in fact manages several other developments sponsored under Section 202 of the National Housing Act which provides affordable housing for elderly and hadicapped citizens. In the course of managing these projects as will be the case at Frederick House, the United Methodist Development Corp. will provide transportation with the senior citizens center in Frederick County to assist and facilitate the transportation needs of the elderly citizens at this development. SEA' OFFICES AT 6860 TOSSING ROAD 4) I have provided with this a list of twelve (12) other projects sponsored and developed under Section 202 of The National Housing Act of 1937 as amended which are, in fact, very similar to this project both in terms of design, location, and tenant profile. As you can see, the parking ratio on almost every project is lower than that proposed for Frederick House, and in some cases is less than .5 spaces per unit. In none of these projects have we or the Sponsors experienced a problem in providing adequate parking nor in accommodating visitors on the occasions when that occur. I respectfully request that your staff and zoning administrator review this information and make a determination as soon as possible as this issue appears to be the only real obstacle in obtaining a construction start by the end of September thus preserving the funding of this much needed affordable housing development. The amount author- Ized by the Congress for HUD to make direct loans to cover eligible develop- ment costs of a section 202 project. Local government. Any city, county, town, township, parish, village or other unit of general local government which is a general purpose political subdivision of a State or the Common- wealth of Puerto Rico; . The field office manager shall consider the comment period closed for that local government when the written objection or other com- ments pursuant to this subpart are re- ceived. In no case shall the field office be obligated to consider subsequent or revised objections unless the initial re- sponse indicated that additional com- ments would be provided and such comments are received prior to the ex- piration of the 30-day • comment period. , (b) Applications for housing assist- ance shall be reviewed for consistency with the HAP on which the invitation or notification of funds availability was based. If a HAP was not in effect at the time that the invitation or noti- fication was issued, the field office shall not be required to review tke ap- plications for consistency with L any subsequently approved HAP. However, where an interim or amended HAP is 9 ¢ Y91.404 approved prior to approval of the ap- plications, the chief executive officer may indicate in writing that special circumstances require its consideration in the review of the applications re- ceived. (b)' Objection. The chief executive officer, on behalf of the local govern- ment, may submit within the 30-day comment period a written objection to the approval of an application for housing assistance on the ground that 9 791.205 11UD review of applications for housing assistance. (b) Review process. The field office finding of consistency or inconsistency shall be based on the information pro- vided in the HAP, the application for housing assistance, and an analysis of the comments of the local govern- ment, including comments submitted by the chief executive officer on behalf of the local government. (1) HUD review when response Indi- cates no objection. The field office may approve the application unless It makes an independent determination that It is inconsistent with the applica- ble HAP. With respect to each application for housing assistance to be provided In an area which does not have a HAP, the field office is required to make a deter- mination as to whether there is a need for such housing and whether there is or will be available in the area Public facilities and services adequate to serve the proposed housing. (a) The initial determination of need for housing assistance within an allo- cation area is made as Part of the allo- cation process In 4 791.404. In making this determination, the field office shall give consideration to She con- tents of any applicable or areawide housing Plan Proposing hous- ing assistance in the area, as well as generally available data on population, poverty, housing overcrowding, hous- 1ng vacancies, amount of substandard housing, or other objectively measura- ble conditions pertaining to lower - income housing needs. (b) Prior to making a determination with regard to a specific application, the field office shall give the local gov- ernment in which the proposed assist- ance is to be provided an opportunity to provide comments, during a 30 cal- endar day period, concerning the need for housing assistance and the adequa- cy of public facilities and services. I have several minor comments which are as follows: A. SITE ACCESS 1. From the road topography and alignment provided on the plan, it appears sight distance will be adequate to the north of the entrance. Site distance south of the entrance is not verifiable from the plans. Mapping indicated that horizontally the sight distance may not be a problem. I would suggest that the designer confirm that the sight distance is adequate both vertically and horizontally. B. STORM WATER MANAGEMENT 1. The drainage design for pipes and inlets appears adequate. 2. Stormwater management by means of retention or detention techniques have not been incorporated to insure post development runoff rates and velocities do not exceed pre -development rates or velocities. The total peak site runoff rate will be increased by approximately 10 c.f.s. It is my opinion that stormwater management should be made a part of this plan. C. EROSION CONTROL 1. Since erosion controls are adequate and with the assumption that a suitable entrance can be obtained, I can recommend that an early grading and foundation permit be given. As you are aware, we have designed Frederick House, a 48-unit elderly housing development with 50 parking spaces for 48 units. This is a ratio of 1.04 spaces per unit of off-street parking. We would request that per Section 3-3-1.1 of the Frederick County Zoning Code the Zoning Administrator allow some variation in the standards for required parking, which in this case would be 91 spaces for the 48 designated units. I believe that we have enumerated and included ample evidence to suggest that the 50 parking spaces is, in reality, more than adequate for a development with the tenant base required under regulatory agreements filed with the U.S. Department of Housing & Urban Development, for a project of this type. Our reasons for asking this are as follows: 1) An additional 41 parking spaces would negatively impact on the green space and aesthetic value of the site and will at the same time provide no real positive advantage to the project in terms of additional parking for the tenants/visitors as off-street parking areas are typically under utilized. 2) Forty-one (41) parking spaces would represent an additional 9 percent of the site to be hard surface and would significantly affect the amount of storm -water runoff which would have to be controlled. 3) The United Methodist Housing Development Corporation headed by Rev. Robert Regan of Fredericksburg, VA is an experienced manager of affordable elderly housing such as this project and in fact manages several other developments sponsored under Section 202 of the National Housing Act which provides affordable housing for elderly and hadicapped citizens. In the course of managing these projects as will be the case at Frederick House, the United Methodist Development Corp. will provide transportation with the senior citizens center in Frederick County to assist and facilitate the transportation needs of the elderly citizens at this development. OFFICES AT 6880 TUSSING ROAD • 4) I have provided with this a list of twelve (12) other projects sponsored and developed under Section 202 of The National Housing Act of 1937 as amended which are, in fact, very similar to this project both in terms of design, location, and tenant profile. As you can see, the parking ratio on almost every project is lower than that proposed for Frederick House, and in some cases is less than .5 spaces per unit. In none of these projects have we or the Sponsors experienced a problem in providing adequate parking nor in accommodating visitors on the occasions when that occur. I respectfully request that your staff and zoning administrator review this information and make a determination as soon as possible as this issue appears to be the only real obstacle in obtaining a construction start by the end of September thus preserving the funding of this much needed affordable housing development.
