Boltz, President 305 Copper Oaks Drive Woodsboro, Maryland 21798 RE: Foxridge Townhouse Development Improvements Dear Mr. Boltz: I enjoyed the opportunity to meet with you yesterday at the above referenced site to determine all outstanding site improvement requirements. This meeting provided an opportunity to walk the entire subdivision and determine the best methods to accomplish final build -out of this project. The following information specifies the items that we discussed: 1) Final Surface Application - A final 1 ''V2" application of SM-2A will need to be provided along the segment of Foxridge Lane from the intersection with Fox Drive (Route 739) to the limits of the development. This includes all parking and maneuvering areas and the striping of all regular and disabled parking spaces as required by the site development plan. 2) Recreational Amenities - A tot lot consisting of various playground equipment was approved for this development. The swing set needs to be rotated 90 degrees to enhance safety. A chain link fence needs to be installed between the last row of townhouses and the playground equipment to mitigate accidents along the sloped area. 3) Buffer and Screening Requirements - A six foot high board -on -board or stockade fence needs to be installed along storm water management pond located in the front of the development. Additional evergreen plantings need to occur in this area as well. A double row of evergreens needs to be provided along the rear property line of the development. These evergreens need to be a minimum of six to eight feet at the time of planting and need to be planted no more than ten feet off center. This will provide an effective screen along the rear property line that would not be accomplished by a six foot high wooden fence. 4) Parking Lot Landscaping - Plantings may be substituted that are required to be planted between the townhouse units and the parking lot area. The approved site plan calls for the planting of maple trees which will become a problem as they mature. The plantings that will be substituted need to be a minimum of two inches in caliper, produce a canopy that lends itself to shading, and be heat tolerant due to the proximity to the asphalt parking lot. 107 North Kent Street - Winchester, Virginia 22601-5000 9 . Clifford & Associates, Inc. 200 North Cameron Street Winchester, Virginia 22601 Re: Site Plan Application (#059-90) for Fox Ridge Dear Darren: This is to follow up on the call from your office March 14th concerning the zoning district buffer requirement for Fox Ridge outlined in my,letter of that date. I spoke with the Planning Director and Deputy Director about possible variations on the fence requirement that I proposed. It was agreed that, if a 10-foot easement could not be provided, that an easement as wide as possible between the property line and the road right-of-way must be provided and must meet the landscaping requirements of a landscape screen as prescribed in the zoning ordinance (art. 3, sect. 12-2.1). In other words, there would be a landscape.screen as close as possible to 10-feet wide. The existing trees on the Russo property can count towards the requirement, and will probably provide for all the deciduous tree requirement. The landscape plan should show which of the existing trees are on the Russo property and what type of trees they are, as well as show the required evergreen plants. I don't know if this will prove to be a cheaper or quicker route than going with the fence, but you may consider it as an option. That's the most we can do without going through the Planning Commission for a waiver or through the Board for a change to the Master Development Plan. Clifford & Associates, Inc. 200 North Cameron Street Winchester, Virginia 22601 Re: Site Plan Application (#059-90) for Fox Ridge Dear Darren: I have reviewed the revised Site Plan for Fox Ridge that you provided with your letter of March llth and see that there are still some items that are lacking in order for this Department to approve the plan. I will address your comments first, then note the items that remain short of what we need. 1. As I noted in my letter of January 25, the requirement of shade trees along the perimeter of parking lots is a requirement of the zoning ordinance, and the Planning Director confirmed its applicability in this case. My best advice is to choose a type of tree with a root structure that will not interfere with the water or sewer laterals or pavement. Thickly -planted evergreen shrubs would not provide the shade intended by the ordinance. 2. The location of the tot lot was not approved in the inactive portion of the buffer area at the master plan stage. The Master Development Plan serves as a conceptual review plan and is not intended to show the location of individual lot lines or structures. Changing the tot lot from the location shown on the master plan to the rear of the lot was not considered a large enough change to have the Planning Commission review, but it still has to comply with the buffer requirements prescribed in the zoning ordinance. I understand that the County Parks and Recreation Department reviewed and approved the site plan as previously submitted, though I've still not received their comments from you. However, that department will have to review this revised configuration. I still need a comment sheet noting that department's approval of the project. Also, although this was not noted in my last comments, with the tot lot location being different from what is shown on the approved master development plan, the total area of steep slope that will be disturbed may be changed. Our concern has been that, since it is not clear that the trees are actually on the Russo property, there is not enough assurance that the screen would be maintained. Also, that tree line does not provide the 10-foot landscaped easement required in the ordinance and shown on the master development plan. we are willing to work with you to meet the spirit of this requirement if a complete landscape screen cannot be provided along the B-2 district border, rather than work through the time-consuming Planning Commission process. It does not appear that there is room between the property line and the road to provide a 10-foot landscaped easement. However, if a six-foot solid fence were provided on the townhouse side of the tree line and a single line of evergreens between the fence and the road, that would meet the intent of the ordinance. The evergreens would have to be 4 feet in height at planting and intended to reach a minimum height of 6 feet at maturity. There should be at least one tree per ten linear feet. Moving to the items not addressed in your letter: 4. Comments from other review agencies are still not complete. The Fire Marshal's concerns about water pressure and fire lanes need to be addressed. And, as noted above, we still need a comment sheet from Parks & Rec. on the new layout of the tot lot. 5. The parking space dedication system needs to be indicated on the plan. Also, a ramp to the sidewalk from each handicapped space needs to be shown. 6. There are a number of other miscellaneous items that need to be addressed as well. However, there are a few questions I have over the reasoning behind such changes. Comment # 3 in your letter describes a parking lot with a shade tree planted every 40 feet. As we discussed before, the actual yard in front of each townhouse is an 8' x 8' area. (Just like Tudor Square). This yard also contains a water lateral with meter and sanitary sewer lateral with clean out. If a shade tree is planted in the direct center of this area, it cannot be more than 4 feet from the sidewalk, front stoop, driveway or either of the laterals. The damage caused by these trees may negate their usefulness. We were hoping to use low level evergreen shrubs thickly planted. Although more expensive, we thought these preferable. Comment # 4 refers to the placement of our tot lot. The tot lot, as we discussed before, has been shown in the buffer area since the beginning of the master plan stage and was approved in the buffer area. Although it is not shown in the exact location of the approved master plan, it was moved for two, what we believe to be, good reasons. First is the on going talks of a future commercial entrance to the adjoining property. This road may be good planning for Frederick County, but it is not a good location for a playground. The second reason is the size of the Storm Water Management Pond. Rather than increase the depth and create an area that would be dangerous during large storms we increased the length (using the tot lot location) for safety and aesthetic reasons, however, if we must adhere to this buffer requirement there is room in the rear active buffer area to locate our tot lot. 12 �L K t 0 • It will be only 25 feet wide, but it will meet all county requirements. Perhaps you can approve our plan as is; then, in the next several months, we can properly prepare a waiver request for expanding the site. The topo in the area, I think all agree, is adequate buffer in itself. We show an existing tree buffer along the north side of the road which we believe to be more than adequate but will yield to your decision on this issue in the interest of plan approval at the earliest date. I'm not sure, but I believe the Board and Planning Commission both wanted the natural trees preserved, rather than pushing them out in order to plant the landscape and screen pattern suggested by the ordinance. Also, the future proposal should be commented on by VDOT. I understand that VDOT's comment on the grading of Foxridge Lane will not require any change, as the portion of Foxridge Lane that is too steep for state standards is not proposed to be taken into the state road system. The portion of Foxridge Lane that is proposed to be taken into the state road system should be clearly identified, and that portion's acceptability to VDOT should be verified. 2. Comments from other review agencies need to be provided and satisfactorily responded to. Specifically, the Fire Marshal's concerns about street grades where fire equipment must operate and about water pressure need to be answered, and fire lanes need to be indicated on the plan. Also, completed review comments are needed from the Sanitation Authority, the County's consulting engineer, and the County Parks and Recreation Department. 9 Court Square - P.O. As long as the consulting engineer verifies that stormwater will be adequately provided for, the parking lot/driveway configuration is acceptable if the space dedication system you described is provided and the appropriate spaces are marked as "reserved." Both of these methods need to be indicated on the site plan. The handicapped parking spaces need to have a ramp to the sidewalk, as we discussed. Also, after checking with the Planning Director, it has been determined that the parking lots will need to have the perimeter landscaping described in the Zoning Ordinance (page 3-11), with at least one. shade tree for every 40 feet of parking lot perimeter. Light fixtures are not required, but must be shown if they are provided. 4. The buffer areas need to be amended somewhat. The Tot Lot Area is not allowed to encroach on the inactive buffer zone. Those facilities must be at least 75' from the rear property line. This requirement was not waived at the master plan stage as you thought it might have been. Without waiver by the Planning Commission, the rear buffer would require a full screen, including a 6-foot high fence. Since the topography would seem to make such a fence unnecessary, you may well wish to seek a waiver of that requirement from the Planning Commission. Variations on the composition of the landscape screen are not provided for in the Ordinance, so the composition described on page 3-28 needs to be provided. The only way for such variations to be allowed is by changing the Zoning Ordinance. With a landscape screen, no distance buffer would be required on the north side of the parcel, along the B-2 district border. The existing tree line along that border may well be sufficient for screening purposes, if it can be assured that that tree line would be maintained. There is a note to that effect, but it is not clear that the trees are actually on the Russo property, so there is not enough assurance that the screen would be maintained. Again, you may seek a waiver of the landscape screen requirement here from the Planning Commission. Our recommendations may be found on the enclosed plans marked in red and as follows: 1. The proposed entrance design has been reviewed by our District Traffic Engineering Section and has been deemed acceptable for this development. However, as you are aware access easements will be required on both sides of the Foxridge Lane right-of-way to accommodate the curb and gutter encroachment in front of the adjoining properties. I believe as you have indicated a 20' ingress/egress easement already exists on the Bailey property to the south which will be acceptable. I am also in receipt of a right-of-way agreement and plat from �Ir. Edwin B. Yost which details an access easement across the Russo property to the north. If this plat is put to record, then this will be all that is necessary in this regard. We would appreciate copies of both the access easement plats when they are available. 2. The existing Potomac Edison utility pole at the entrance may need to be relocated in order to accommodate the entrance design and to provide for minimum sight distance. 3. The proposed 36'x23"x14" R.C.P. should be realigned as noted. The new location would provide for an easy extension and/or connection to a future drop inlet if this entrance is ever upgraded to a secondary street connection. It appears this relocation would necessitate a change to the drainage easement as detailed on the subdivision plat. A drainage ditch will need to be provided from the outfall of this culvert to the proposed triple line of 43"x27 E.R.C.P. under Route 739 to the north. Your site plan indicates a 50' right-of-way along this portion of Route 739, however, our records indicate it being only 30' in width. A list of those in attendance is attached for future reference and the following issues were discussed and/or comments made by representatives of the various utilities and others involved in the project. I. Virginia Department of Highways and Transportation. VDOT was represented by Bob Childress and Ed Wymer. The existing plan is to provide access to the Foxridge subdivision with provisions for a future entrance for the Russon property. VDOT will approve the entrance design for the Foxridge development but indicated that the pavement design does not meet their commercial entrance standards. According to Bob Childress, in order to meet VDOT specifications for a commercial entrance, B-3 would need to be added to the pavement design for at least the first 300' or that portion which VDOT may be requested to accept into their system. All parties agree that the idea of a combined entrance is good, however, VDOT does not feel that adequate right-of-way or easements have been secured for this to happen. Additional right-of- way will be necessary to increase the entrance radius on the south side where presently an ingress/ engress easement is provided. Also, if a B-3 base is not installed at this time, then it will be necessary to remove the pavement at a later date and upgrade the entrance to meet VDOT standards. If this entrance could be built to VDOT standards now, it would save money in the future. Mr. Russo indicated that he had spoken with owners of the Russon property to see if they would be interested in participating in the cost to perform this additional work. However, the owner of this property is trying to sell, therefore, they were not interested in sharing in the cost to upgrade the entrance. According to Bob, VDOT will approve the entrance as designed for Foxridge and indicated that Rappawan can apply for a temporary construction permit. When final approval is received from�,VDOT the contractor is to notify them when work on the entrance is to be performed since they will provide inspection for the first 300', the area which ma F9 19 • 0 be requested to be taken into their system sometime in the future. Bob further stated that a closer review of the planned culverts under Rte 739 needs to be performed since the department feels the depth of the culvert may need to be increased. Bob pointed out that the contractor will also need to obtain a Utility Permit and this can be a joint permit with both the contractor and the Sanitation Authority listed as "joint" applicants. Bob also stated that two open cuts of Route 739 are presently being planned therefore, if any utilities are interested in "jumping in the trench" to install any conduits now would be the time. Based upon field survey it will not be necessary to relocate the existing utility pole located on the north side of the entrance. Based upon this field work the pole will remain and will be 3' behind the proposed curb. II. Utilities. All utilities will be placed underground for this project. Due to the limited space it will be tight for the first 300' along the access road. This will, therefore, require close coordination of the utilities. It was also pointed out that care should be taken to protect the trees which will line the north side of the proposed access road. Services will be needed for units 8-14 first and Mr. Russo indicated these services will be needed within 90 days. The following are comments made by the various utilities in attendance: A. Shenandoah Gas Company. Shenandoah Gas was represented by John Popovich. John stated that the gas main to which connection would be made to serve Foxridge is located on the opposite side of Rte. 739 (east side). He indicated that a 2" gas main would be extended to serve the site and ask if the gas main could be located in the street. Following a review of possible locations it was felt that the 2" main could be extended up the south side of the entrance between the C & G and property line. Gas services would be run along the rear of the properties and a 10' easement will be necessary for this purpose. If C&P and TV cable are also run in the rear a 15' instead of a 10' easement will be necessary. John stated that one service line will be extended to serve two units. The gas main is also proposed to run along the west lot lines of lots 22-28. This would place it in the area where the grading plans call for a considerable cut to be excavated by the contractor to achieve the specified plan grade. Ritchie Vaught of Rappawan stated that based 0 • upon some previous testing they had performed in the area of these lots some rock removal will be necessary and that if the gas is installed in this area then additional removal would most likely be needed. John Popovich stated that Shenandoah Gas would be willing to participate in the cost of additional rock removal to accommodate their utility. Ritchie indicated that if they encountered more rock than anticipated he would contact John to discuss cost participation. John stated they would begin installation of their mains when the site is within ± 1' of final grade. B. C & P Telephone and Adelphia Cable. C&P was represented by Bob Lillard and Adelphia Cable by Ed King. Mr. Lillard stated that they could install along the front or back. Presently Potomac Edison plans to install their utility along the front and Mr. Russo has indicated he will discuss this with P.E. to see if they would locate along the rear. If P.E. goes along the front C&P would also be allowed to follow. If C&P installed their utility along the back and P.E. in the front a "ground" must be extended to the back for C&P's use. Mr. King of Adelphia Cable inquired as to the construction of fences etc., which may conflict with utility installations. Mr. Russo stated that covenants will restrict the building of fences. Mr. King also requested updated plans for their use. C. Frederick County Planning. Ron Lilley represented Frederick County Planning. Ron inquired as to our response to their previous comments and questions. Darren Foltz discussed the responses to their comments especially those involving the construction of the entrance. In response to Ron's comments "hatched" areas are indicated on the plans for areas where easements or R/W dedication are needed for the future upgrade of the entrance to accommodate the Russon property. The securing of adequate R/W etc. must be coordinated with VDOT. Land should be dedicated now, but will not be approved by the County until accepted by VDOT. Chuck Maddox suggested that wording be added to the covenants stating that easements are for proposed future dedication to VDOT. Also, Ron inquired as to the location of the tot lot. Reference was made to a letter concerning this issue and location of the tot lot involving the active and passive areas of the buffer. A 100' buffer area must be provided and the tot lot kept within 25' behind the units. D. Frederick County Sanitation Authority. Steve Rotz represented the Authority. Steve stated the the Authority will make the taps to their utilities and suggested the owner go ahead and make application for the water tap and that would begin the process. Then the proposed tap could be scheduled. Steve also requested an updated set of plans. III. Other A. Weekly onsite meetings will be scheduled at which time utility companies and others involved in the project may discuss any issues which they may have concerning the project. B. You are correct, the plans do not address the ultimate design. Additional land and significant additional work will be required to upgrade this road to state standards. The owner of "Foxridge" is simply providing an entrance to serve the 200 trips per day generated by his development. He has agreed, in the interest of good design and planning, to shift his entrance within his 62' frontage (42' fee simple with a 20' access easement) in order that the improvements made now can be used in partial compliance of improvements necessary for future dedication. It is the County's direction that the neighbor, who owns 6 acres of commercial property, is to add the necessary rights of way and improve the section to meet the trip generation requirements of this specific future proposal. I will try to clarify any so called "misunderstandings" you feel are now arising concerning the project. First of all, I do recall discussing entrance conditions for the project during our review of the master development plan. However, I do not believe, as our review comments of July 2, 1990 indicate, we approved any specific entrance design. Furthermore, what you describe as being the "normal" commercial entrance for VDOT approval is merely our minimum design standards. Secondly, you state the site plans which you recently submitted to us for comment show the Fox Ridge Lane right-of-way as being designed to be an eventual State maintained roadway. I realize through our recent telephone conversations this is in fact your intent. However, neither the site plan nor the master development plan specifically indicate this. Furthermore, since this is the desires of both your client and Frederick County a standard secondary street connection would in fact be required rather than a commercial entrance. We certainly appreciate your design efforts and the County's desire to provide a central access point to these parcels. We feel a common entrance to the properties could be very beneficial because of the proximity to the increasingly expanding Routes 522 and 739 intersection. However, as you know any such entrance would still need to meet our minimum design requirements of which your client's limited amount of property frontage could be a factor. As you may recall, when you approved the Master Development Plan for this project, we discussed the entrance conditions to this project. The normal commercial entrance for VDOT approval, consists of a 30' pavement, two-2' gutter pans, and two 12 1 /2' minimum radius curb and gutter returns. This totals 59' of road frontage requirements in order to install a commercial entrance. As pointed out in the past, we have a total of 42' of road frontage in fee simple with an additional 20' ingress and egress easement for a total of 62' of overall frontage. If we were to design a commercial entrance appropriate to this frontage, it is feasible and can be installed "by right" by Mr. Russo. The plans that we submitted to you for comment on subdivision plat approval showed a right-of-way which is designed to be a state road eventually, serving both the townhouse development and the commercial land to the north. In order to dedicate the property to the County for state road purposes, all construction must be on the fee simple portion of the project. For that reason we have designed the road wholly on the 42' section, which moves the centerline to the the north and requires the temporary commercial entrance curb and gutter to extend in front of the commercial land of our neighbors. In accordance with your requirements, we have met with our neighbor who has tentatively agreed to give us written approval allowing for that curb and gutter to extend in front of JAN 8 !r his project. All this, as you recall, stems from requirements made by the Planning Commission and Board of Supervisors in Frederick County which, in fact, ordered both the property owners involved to cooperate on a common entrance location. We understand your concerns and your need for property owner assurance in order to approve our entrance as designed; however, you have indicated that a commercial entrance of any sort may not be possible. I would appreciate your verification of this to the owner as he is intending to make a sizable investment in the purchase of the property and your letter response of December 17 has posed the possibility that the site not usable.
