The resubmitted plans appear satisfactory and are therefore approved. Please advise the developer accordingly. As we have previously advised, a drainage easement to include the proposed detention basin as well as an agreement between VDOT and Frederick County which absolves this Department of any maintenance/liability responsibilities of said basin will be required. Please ensure the developer understands the required agreement is his responsibility and will be required prior to the issuance of any land use permits. I would like to call your attention to a ccmrent in your letter to this office dated September 6, 1990 (copy attached) concerning the required agreement.
