Dear Bruce:
This is to acknowledge receipt of the above referenced project's revised site
plans dated July 25, 1990. The resubmitted plans appear satisfactory and are
therefore approved. Please advise the developer accordingly.
As we have previously advised, a drainage easement to include the proposed
detention basin as well as an agreement between VDOT and Frederick County
which absolves this Department of any maintenance/liability responsibilities
of said basin will be required. Please ensure the developer understands the
required agreement is his responsibility and will be required prior to the
issuance of any land use permits.
I would like to call your attention to a ccmrent in your letter to this office
dated September 6, 1990 (copy attached) concerning the required agreement.
Please be advised the agreement is to be between this Department and Frederick
County only. No third parties can be considered. We would suggest the
developer proceed with submitting the required agreement to this office for
review to prevent any delays at time of construction.

Enclosed you will find the land use permit application and Check #03338 in the
amount of $75.00 to the above referenced project which was recently submitted
to. thisoffice with your letter of transmittal dated October 25, 1990. We
will be unable to process the application until such time the developer
submits an agreement to this office for review and approval which absolves
VDOT of any maintenance/liability responsibilities of the sites stormwater
detention pond. He has been advised on this matter on several occasions; most
recently by a letter (copy attached) to his agent Mr. H. Bruce Edens of
Greenway Engineering & Surveying Company, Inc.
I would strongly suggest your firm not even consider proceeding with this
project where the State's right-of-way is involved. By copy of this letter to
the Frederick County Sanitation Authority I am also apprising them of the
situation and asking they deny any taps and/or connections to the developer
until our requirements are met.
We regret any inconvenience this may cause your firm. However, the developer
has been aware of our requirements for quite sometime and to our knowledge has
made no attercipt to meet them. He has been further advised no land use permits
would be issued until they are met. Therefore, we will expect to receive you
full cooperation in this matter.

Upon further review of the above referenced project's site plans dated
July 25, 1990 please find our recommendations on the attached plans marked in
red.
The resubmitted drainage design from the proposed detention basin along the
Route 1322 right-of-way appears satisfactory. However, as we have previously
advised a drainage easement to include the basin will be required. An
agreement between VDOT and Frederick County which absolves this Department of
any maintenance/liability responsibilities of the detention basin will also be
required. Please ensure the developer understands the required agreement is
his responsibility and it will be required prior to the issuance of any land
use permits.
Please revise and resubmit four (4) copies for final approval. Should any
changes be deemed necessary please design them to meet or exceed the above
recommendations.
