Winchester T.V. Cable
Location: Southeast side of Route 522N in the Gainesboro
Magisterial District.
Proposed Use &
Improvments: To carry on the proposals made on the site plan
(No. 025-78) which was approved on November 30,
1978. T.V. Cable is in the process of transporting
fill to the area defined by the site plan for future
development.
Review Evaluations:
Dept. of the Army, Corps of Engineers - Inasmuch as
the proposed work does not involve the discharge of
dredged or fill material into waters of the United
States, this office has no objections to the proposed
work and a Department of Army permit is not required.
Va. Dept. of Highways and Transportation - We have
been advised by our Hydraulic's Engineer that the
design should be adequate for the normal floods
through the 25 to 50 year frequency. This is in
the same range as the design of the 6' X 6' box
culvert under Route 522.
A pipe culvert will be required under the proposed
street at its connection to Route 522 when the
street is built.
Department of Public Works - Satisfactory. Erosion and
sedimentation permit will be required.
Planning and Zoning - No comment.
Staff Recommendation:
Approval.

The logistics of the actual pro-
duction saw a small army of people
ranging from cameramen and
costumers through cocktail wait-
resses. Everything from mobile
videotape vans through miles of cable
invaded the L.A.'s famous Comedy
Store nightclub over two days for a
one-night, one-shot taping in front of a
live audience. An oversold house of
500-plus screaming and steaming
ered in 100' heat to witness the event.
Somehow Marty Callner and the
HBOers were able to pull it all
together and ran just a half hour
behind schedule.
The Complexities of
Covering Comedy
This was no small feat considering
that there was no camera blocking
rehearsal and no top -to -bottom
dramatic rehearsal. (Callner did,
however, rehearse each of the six
young comedians individually. Four of
them —Bill Kirchebauer, Iry Burton,
Richard Blezer and Denny Johnston —
were included in the final edited
version of the special.) Molly Stitzel
explains, "Chevy Chase wanted to be as
spontaneous as possible and didn't
want to go through that ... When
you're working with comedians, a
blocking rehearsal is really irrelevant
because they do their `bits' in
different order each time, depending
on audience response ... This is why
taping comedy is difficult. We have t
be totally flexible and have our
cameras in position to cover every
thing."

Dear Mr. White:
The Federal Aviation Administration, as you know, has a
VORTAC station located on property in Section III of Fredericktowne
Subdivison. They are relocating their VORTAC station to the Winchester
Airport, and are in the process of terminating operation, if not
already terminated, of the station in Fredericktowne.
Winchester Cable TV Company has contacted us concerning the
installation of a receiving tower on this particular location for
purposes of receiving from Winchester cable television transmissions.
They plan to provide cable television service in the Fredericktowne
Subdivision.
We have discussed the matter briefly with John Riley and he
had suggested that we write this letter to you in order to formerly
start the process seeking to obtain approval of the location of the
cable television receiving antenna on this site. The theory would be
that this would be a continuation of a non -conforming use within this
particular zoning classification. There is some question as to whether
or not these two uses are in the nature of utilities. Please advise
of the county's position concerning this proposed use as soon as
possible.

Article IV, Section 21-26, paragraph (m) "Public Utility Generating"?
It is my understanding that TV Cable systems are not public utilities;
but, would they be allowable under the aforementioned section?

possible.

Winchester TV Cable is contemplating a site in Frederick County to

My question to you is this, can Winchester TV Cable locate under
Article IV, Section 21-26, paragraph (m) "Public Utility Generating"?
It is my understanding that TV Cable systems are not public utilities;
but, would they be allowable under the aforementioned section?
I would appreciate your assistance in this matter as soon as
possible,

After reviewing the Frederick County Code, more specifically
Section 21-26, I am of the opinion that a tower and receiving
dish would be a permuted use under that section. In reviewing
all the uses outlined in said section, especially subsections
(m) and (u), a tower and receiving dish for a Cable TV company
appears to be the type of use contemplated. Because of its unusual
nature, this was apparently not specifically provided for when
this section of the code was drafted. Furthermore, such a use is
less offensive than many of those permitted in Section 21-26.
If you have any further questions regarding this matter, please
do not hesitate to contact me.

a definition of "public utility" available in the Code or

In regard to your request of our agency providing you with assistance con-
cerning Winchester TV Cable's proposal, please find our comments below:
The County should request that a registered professional
engineer provide a detailed analysis concerning the impact
upon the present one hundred year flood elevations upstream
of the project area resulting from the construction and as-
sociated fill within the drainage basin as proposed by
Winchester TV Cable.
2. The County may request the engineer to include an analysis
of flood control alternatives (structural and non-structural)
for reducing the one hundred year flood elevation so that a
cost benefit analysis may be developed.

3. The impact of high velocity flood waters in the northern site
entrance of the drainage way should be investigated. Riprap
to protect the fill may be necessary. Additionally, the County
may wish to require the plans to reflect a more efficient flow
entrance configuration for the northern channel of the drainage
way, rather than the present "right-angle" configuration. Measures
to maintain channel capacity (i.e. straigntening of the channel)
should be determined.

In regard to Section 21-141.3 of the Flood Plain District Section of the
Frederick County Zoning Ordinance concerning State Water Control Board ap-
proval of "proposed alteration or relocation...", this agency will be wil-
ling to grant such approval if a registered professional engineer would
certify that the project will not increase the one hundred year flood
elevation greater than one foot at any point (with control structures, if
necessary) to remain consistent with Frederick County's Flood Plain Ordinance.

WHEREAS, in consideration of the approval by the party of the second
part of the Land Disturbing permit for the project located at
Southeast side of Route 522N in the.Gainesboro Magisterial District
the party, parties of the first part, their heirs and/or assigns, agree
to comply in full with the following provisions:
1. To provide for the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures which
will be implemented during all phases of clearing, grading and
construction as required by the Frederick County Erosion and
Sedimentation Control Ordinance and shown in the approved Erosion
and Sedimentation Control Plan.
2. It is agreed and understood that final approval of completed work
can only be given by the County Engineer or Public Works Director
of Frederick County, or, in their absence, the Frederick County
Administrator.
3. To provide all necessary performance bonds as required by the
Frederick County Code and as set forth in the Bond for Land
Disturbing Permit of which this agreement is a part.

WHEREAS, Principal has executed the foregoing agreement of which this

performance of all of the provisions of the foregoing agreement;
NOW, THEREFORE, The condition of this -obligation and bond is such that
if the Principal and/or Surety shall perform all of the provisions of the

the obligation of this bond is to be void and of no effect; otherwise, it
is to remain in full force and effect.
It is expressly understood that this bond may be cancelled by the Surety at
the expiration of sixty (60) days from the date which the Surety shall have
lodged with the County of Frederick written notice to so cancel, but such
notice may not be lodged earlier than the end of the time period specified
in the agreement or the date of completion of construction and approval
by the County, or in the event that the Principal elects not to complete
the project, until the County gives approval of construction by the
Principal of whatever measures are deemed necessary by the County to
ensure erosion control at the site. This provision, however, shall not
operate to relieve, release or discharge the Surety from any liability
already accrued, or which shall accrue, on erosion and sedimentation
control bonds before the expiration 6f sixty (60) day period.
The Surety and the Principal hereby certify that they will within thirty
(30) days of expiration of the agreement for which this bond is executed,
and is a part thereof, execute a new bond and agreement for a period not
to exceed six (6) months in an amount to be determined by the County to
cover the work remaining and to reflect inflation costs, should the
Principal not be able to complete the bonded work within thirty (30)
days prior to the agreement expiration date.
The Principal and Surety further certify that they will continue to execute
additional new bonds and agreements in amounts to be determined by the
County for subsequent periods of time not to exceed six (6) months until
such time as the work has been completed and approved by the County or
until the County releases the Surety and Principal, whichever is earlier.

We have been advised that the design should be adquate for the normal
floods thru the 25 to 50 year frequency. This is in the same range as

The accompanying plat represents a survey of the land
conveyed to Leon V. Watson, Et Ux by deed dated 21 April 1953 and
recorded in the Frederick County Court Clerk's Office in Deed Book
232, at page 534.
The said land lies on the Southwestern boundary line of
U. S. Route 522, just Northwest of the City of Winchester, in
Stonewall District, Frederick County, Virginia and is bounded as
follows:
Beginning at a fence poet a corner to Frederick County Fruit
Grower's Association, Inc. and N/F Strother; running with the
Northern Line of said Strother N 41' 28' 57" W - 790.62' to a
fence post a corner to Hiett in the line of said Strother; thence
with the line of Hiett, J. Strobridge, and Winchester Outdoor
Advertising N 48c 311 04" E - 1122.521 to an iron pin not a corner
to said Winchester Outdoor Advertising and in the Southwestern
boundary line of U. S. Route 522, thence with the said boundary
line of U. S. Route 522 for the two following courses, with the
arc of a curve to the right 649.741 (Radius - 1772.86, Chord -
646.1111, Chord Bearing S 31' 401 59" E) to a point, thence with t1a
arc of a curve to the right 342.851 (Radius - 2809.791, Chord -
