Harold Moss Transmitted herewith is our Application for Rezoning together with all the supporting documents and studies which I understand are required by the Zoning Ordinance and the Amendment Policies promulgate under the Zoning Ordinance adopted November 1, 1973. It will be noted that all the lands involved, except 50.9 acres (30.61 acres recently acquired and 20.29 acres now in process of being closed under a 1972 option) have been owned by the company for several years, and are included in the original Boundary Survey of the project dated December 9, 1971. Until recently we were under the impression that all the properties included in the 1971 Boundary Survey had been rezoned to R-5. On the enclosed Rezoning Map it will be noted that the boundaries shown on the County's map are at variance with the certified Boundary Survey in many places, but most of the variances are relatively minor except for two specific tracts. For this reason we are including in our Application the names and addresses of all persons who own property adjacent to the entire project, so that the new Zoning Map, when adopted, will be completely accurate. The enclosed documents have been prepared in large part by James C. Wilkins & Associates, Inc. , Certified Land Surveyors and Engineers, of Harrisonburg, Virginia, and insofar as I know, are complete and in accordance with the requirements of the Commission and the Board. Parcel I, all of that land which was included in the original boundary survey for Lake Holiday Estates, Inc. dated December 9, 1971, but was not included in the original R5 rezoning for Lake Holiday Estates, Inc. Parcel II is a tract of land consisting of 20.29 acres being bounded on two sides by Lake Holiday Estates, Inc. and on the third side by State Route 703. Parcel III is a tract of land consisting of 30.61 acres being bounded on three sides by Lake Holiday Estates, Inc. and on the fourth side by the re- mainder of the lands of Rual P. Anderson. This economic impact study will take each of the three parcels mentioned above and study them separately for their possible uses and their impact on the area to be rezoned. Parcel I When the R5 area was first designated for Lake Holiday Estates, Inc. there were two large areas left out of the boundary and several other minor errors in the boundary as shown on the official zoning map of Frederick County. These areas have been included as a part of Lake Holiday Estates, Inc.'s boundary since its inception. These areas will be used primarily for the purpose of single family detached units. However, there are some locations that multi -family or cluster -type dwellings are being considered. All of these lands will simply be a continuation of the present concept of Lake Holiday Estates, Inc. and will not materially change the ideas that have been put forth and accepted to this time. They will continue to comply with all of the zoning requirements designated by R5 with regard to densities, open speces, land uses and physical configurations. You will note on the accompany- ing map that the area originally zoned R5 is outlined in black line and the area that should have been rezoned R5 is outlined in red line. We respectfully request that these corrections to the R5 zoning limits be made at this time so that we may proceed with our development in an expedient and well formed manner. Parcel II This parcel of land is bounded on two sides by Lake Holiday Estates, Inc. and on the third side by State Route 703. It consists of a total of 20.29 acres of land with approximately 2,260 feet of road frontage on State Route 703. Our present thoughts for this parcel of land show that we will put 46 single family lots, averaging about 12,000 to 13,000 feet on this parcel of land and would anticipate that all dwellings placed hereon would probably be in the neighbor- hood of 1,200 square feet of living area per floor and probably would consist of three bedroom homes. We anticipate no town houses or apartments on this particular tract of land, although town houses are being considered on some lands adjacent to this 20.29 acre tract. Based on 46 lots contained within this 20.29 acres, we will arrive at a density of units per acre at slightly over two. There is no anticipation of any commercial area or industrial area within this tract of land. We do anticipate having some open green area for local playgrounds and also riding trails that would go around the perimeter of this tract of land. As with the rest of our development, we will be pro- viding central water and sewer services in addition to the other amenities and services provided by Lake Holiday Estates, Inc. We do not anticipate the county having to provide any services for this parcel of land. Parcel III This tract of land consists of 30.61 acres which is bounded on three sides by Lake Holiday Estates, Inc. and on the fourth side by Rual P. Anderson and has no frontage on any state highway. Our present plans for this area show approx- imately 80 single family lots contained within this 30.61 acres and a small corner consisting of less than one acre which might be used for multi -family or town house purposes in conjunction with several other acres already contained within the boundaries of Lake Holiday Estates, Inc. Our anticipation of dwell- ing units on this tract of land would be the same as we anticipate on the 20.29 acre tract of land and as stated above. This would give us a total density of less than three units per acre on this tract of land. As with the previous parcel No. II, we anticipate no commercial or industrial development on this land and we will be providing central water and sewer services along with the other amenities and services available to the entire project. As with Parcel II, we do not anticipate the county having to provide any services to this land. As a concluding comment, we would like to point out that all of these parcels of land that we are requesting to be zoned R5 are a natural continuation of the boundaries of the present Lake Holiday Estates, Inc. and their use will be simply a continuation of the present thoughts and ideas already put forth for the entire project.
