Transmitted herewith is our Application for Rezoning
together with all the supporting documents and studies which
I understand are required by the Zoning Ordinance and the
Amendment Policies promulgate under the Zoning Ordinance
adopted November 1, 1973.
It will be noted that all the lands involved, except 50.9
acres (30.61 acres recently acquired and 20.29 acres now in
process of being closed under a 1972 option) have been owned
by the company for several years, and are included in the original
Boundary Survey of the project dated December 9, 1971. Until
recently we were under the impression that all the properties
included in the 1971 Boundary Survey had been rezoned to R-5.
On the enclosed Rezoning Map it will be noted that the
boundaries shown on the County's map are at variance with the
certified Boundary Survey in many places, but most of the variances
are relatively minor except for two specific tracts. For this reason
we are including in our Application the names and addresses of all
persons who own property adjacent to the entire project, so that the
new Zoning Map, when adopted, will be completely accurate.
The enclosed documents have been prepared in large part
by James C. Wilkins & Associates, Inc. , Certified Land Surveyors
and Engineers, of Harrisonburg, Virginia, and insofar as I know, are
complete and in accordance with the requirements of the Commission
and the Board. However, if any additional information is desired,
please let us know and it will be supplied promptly.

sation concerning the employment by the development of a nationally
known, top-flite, Land Planning consulting firm to assist us in the
long-range planning of The Summit project, including suitable sites
and areas for schools, churches, commercial areas, parks, playgrounds,
etc. In this endeavor , as I have verbally assured you, and Mr. Berg,
we hope to coordinate very, very closely with the Planning Commission
and the Board of Supervisors, so that the final result will be for the
mutual benefit of both Frederick County and the development.

1970) by and between Rual P. Anderson, being one and the same
person as R. P. Anderson, and Viola Anderson, his wife, parties
of the first part, hereinafter called the Grantors, and Donald
L. Bayliss, party of the second part, hereinafter called the
Grantee.
WITNESSETH: That for and in consideration of the
sum of Ten Dollars ($10.00), cash in hand paid and other good
and valuable considerations, the receipt of all of which is
hereby acknowledged, the parties of the first part, being the
Grantors, do hereby grant, bargain, sell and convey, with general
warranty of title, unto Donald L. Bayliss, the Grantee, in fee
simple, all of the following rear estate, together with all
improvements thereon and appurtenances thereto belonging and
subject to all easements and legally enforceable restrictions of
record affecting such realty:
All of that certain tract or parcel of land,
containing 98.977 acres, according to the survey of
H. Bruce Edens, Certified Land Surveyor, dated August,
1970, which survey and description are attached hereto
and made a part hereof for a more particular description
of the land hereby conveyed, the said land being the
Eastern portion of two larger tracts or parcels of
land which were devised to Rual P. Anderson and Dewey
L. Anderson, by the Last Will and Testament of James
E. Anderson, and of record in the Clerk's Office of
the Circuit Court of Frederick County, Virginia, in
Will Book 47, at Page 146, and the one-half interest
of Dewey L. Anderson was conveyed to Rual P. Anderson
by deed of record in said Clerk's Office in Deed Book
190, at Page 207, and which land is bounded on the
Southern side by Virginia Secondary Route No. 705,
on the West by the remaining portion of the Anderson
Land, on the North by another tract belonging to the
Grantee herein, formerly the land of Earl Haines,
Inc., and on the East by an old county road and the

land of Oscar Eller and is situate about fifteen
(15) miles Northwest of Winchester, in Gainesboro
Magisterial District, Frederick County, Virginia.
Reference is made to the aforesaid deeds and the
references therein contained for a further descrip-
tion of the land hereby conveyed.
The Grantors covenant that they have the right to con-
vey the within described property; that the same is free from all
liens and encumbrances except as may be hereinabove set forth;
and that they will forever warrant and defend the title thereto.

In consideration of the sum of One Thousand Dollars
($1,000.00) paid by the Purchaser to the Sellers, the receipt of
which is hereby acknowledged, the Sellers hereby give to the
Purchaser, his heirs and assigns, the exclusive option to purchas(
for the further sum of One Hundred Twenty -Seven Thousand Dollars
($127,000.00) hereinafter called the purchase price on or before
twenty-one (21) months from the date hereof, the real estate
situate in Gainesboro District, Frederick County, Virginia, and
more particularly described as being 128 acres, more or less,
having excepted therefrom 25 acres from a total of 153 acres
presently owned by the Sellers, which 128 acres is situate
partially along the Southern and Western sides of Virginia
Secondary Route 703 and bounded by Clinton Whitacre, Long and
Dickerson and Gilbert Whitacre, and a portion of which lies
North of Route 703 and is bounded by Lake Holiday Estates, Inc.,
and being a portion of the same realty that was conveyed to the
Sellers by deed from

buildings and a total acreage of 25 acres and adjoining the said
Route 703.
Further payments upon the option shall be as follows)
$2,000.00 each quarter beginning November 15, 1972, for a total
of $15,000.00 which shall include the initial deposit of $1,000.01
said quarterly payments after the first one mentioned above being)
February 15, 1973, May 15, 1973, August 15, 1973, November 15,
1973, February 15, 1974 and May 15, 1974, and said payments shall,
apply to the purchase price in the event the option is exercised;'
otherwise, they shall be retained by the Sellers.
If the Purchaser shall give notice, by delivery to,
or by registered mail addressed to the Sellers at Gore, Virginia,
on or before twenty-one (21) months from the date hereof of the
Purchaser's election to exercise this option, the Sellers shall
within ninety (90) days thereafter deliver to the Purchaser a
deed in fee simple to the premises, free of all liens and encum-
brances, and with covenant of general warranty and proper form fo
recording using a survey description to be made and paid for by
the Purchaser.
Settlement of the said purchase shall be made in
the Law Offices of Massie and Snarr, 31 South Braddock Street, in
the City of Winchester, Virginia.
If the Sellers shall not, prior to expiration of
said period of ninety (90) days clear all liens and encumbrances
from the premises so as to be able to convey a title in fee simpl
free of all liens and encumbrances, the Purchaser may at his
election either (1) refuse, without liability on his part, to
complete the purchase of the premises, in which event the Sellers

shall refund to the Purchaser all monies paid for this option,
or (2) deposit, in the Commercial and Savings Bank of Winchester,i
Virginia, so much of the purchase price as shall in his judgment
be sufficient to discharge or satisfy all liens and encumbrances
upon the premises outstanding at the expiration of said period

in which event the Sellers shall, on payment of the balance of
i
the purchase price, deliver to the Purchaser a deed in fee simple
to the premises, subject to such liens and encumbrances, with
covenant of general warranty, and shall be entitled to receive
from said Commercial and Savings Bank of Winchester, Virginia;
such part as shall remain of the sum so deposited after such sum
shall have been applied as promptly and practicable, to the dis-
charge or satisfaction of such liens and encumbrances and to the
payment of any expenses including the fee of the Commercial and
Savings Bank of Winchester, Virginia, attorney's fees and Court
costs incident thereto.
If the Purchaser shall exercise this option, real
estate taxes and insurance for the current year shall be appor-
tioned as of the time of the delivery of the deed by the Sellers,
and possession of the premises shall be delivered to the Purchaser
at that time.
This option may be assigned by the Purchaser either
before or after the Purchaser shall have given notice of his
election to exercise this option.
In the event that the option is exercised to pur-
chase the property, all payments on the option shall be applied
to the total purchase price, which is a purchase by the acre and
not in gross, at $1,000.00 per acre.

The sellers give and grant to the Purchaser the
right to send his surveyors upon the premises and to enter upon
the premises for the purpose of inspection of the same for
engineering purposes, for prospective future development and
improvement of the property to be sold hereunder and for the
determination of the area reserved by the Sellers which is
described as follows: 25 acres, more or less, to be retained by
the Sellers including the dwelling house and out buildings, and
bounded by a line beginning at Virginia Secondary Route 703 and
running West to a point 150 feet below the dam of pond No. 1,
located about 50 feet West of Route 703; and running Westward to
a point about 125 feet from the West boundary of the property;
and thence running parallel to and 125 feet from the property
boundary Northward to a point on the fence line West of pond No.;
and thence by a turn North of about 120° to a point in the field
which bisects a line running from Route 703 Westward which follow
the Northern edge of Field No. 5 as shown on the sketch attached.
The Northern or Southern line will be modified to make the
reserved area 25 acres, more or less; the line which parallels
the Dow Whitacre and Long -Dickerson line will be not less than
125 feet from such line.

The terms of payment of the purchase price for all
of the 128 acres, more or less, shall be as follows: ice% of the

portion of the property purchased, a lot release fee shall be
paid to the Sellers or any bona fide holder of the negotiable
bond at the rate of $1,500.00 per acre. The Sellers further
agree that said release fee shall apply to all payments made upon)
the purchase price .
The Purchaser agrees to pay for the survey or
attorney's fees for preparing the deed, bond, deed of trust,
vendor's tax, realty transfer taxes, recording fees and title
search, if any.

It is understood and agreed between the parties
hereto that the conveyance of the said real estate shall be
subject to all rights of way, easements, covenants and conditions
legally enforceable and of record, if any, affecting said realty.
It is further understood and agreed between the
parties for the mutual covenants herein set forth that the
Sellers will first
offer to the Purchaser, his heirs or assigns,
the real estate reserved by the Sellers at a price that may be
agreed upon by them or at any price offered by a bona fide
purchaser, at which time the Purchaser shall have thirty (30)
days from the date of the notice of offer of sale to accept the
same, and if accepted, settlement should be made thirty (30) days
thereafter provided the Sellers then give to the Purchaser a good
and sufficient general warranty deed free of all liens and
encumbrances.
Time is of the essence of this option, and if the
Purchaser shall not notify the Sellers that he elects to take,
accept and purchase said real estate at the price and terms
aforesaid within the time aforesaid, then this agreement shall
forthwith become null and void and of no further effect, and all
payments paid by the Purchaser to the Sellers shall be retained
by the Sellers.

Detailed Answers to Question 1
PARCEL #1 - Consisting of approximately 225 acres of the entire
1885.54 acre tract located near Cross junction, Virginia. In addition
to the miscellaneous areas around the entire boundary, there are two
major parcels: (1) The tract formerly owned by Rural P. Anderson
situated on State Route 705. It has about 2750 feet of road frontage

ECONOMIC IMPACT STUDY
'Lake Holiday Estates, Inc. respectfully submits the following economic impact
study to accompany the request for rezoning to R5 the following three parcels
of land.
Parcel I, all of that land which was included in the original boundary survey
for Lake Holiday Estates, Inc. dated December 9, 1971, but was not included
in the original R5 rezoning for Lake Holiday Estates, Inc.
Parcel II is a tract of land consisting of 20.29 acres being bounded on two
sides by Lake Holiday Estates, Inc. and on the third side by State Route 703.
Parcel III is a tract of land consisting of 30.61 acres being bounded on
three sides by Lake Holiday Estates, Inc. and on the fourth side by the re-
mainder of the lands of Rual P. Anderson.
This economic impact study will take each of the three parcels mentioned above
and study them separately for their possible uses and their impact on the area
to be rezoned.
Parcel I
When the R5 area was first designated for Lake Holiday Estates, Inc. there
were two large areas left out of the boundary and several other minor errors
in the boundary as shown on the official zoning map of Frederick County.
These areas have been included as a part of Lake Holiday Estates, Inc.'s
boundary since its inception. These areas will be used primarily for the
purpose of single family detached units. However, there are some locations
that multi -family or cluster -type dwellings are being considered. All of these
lands will simply be a continuation of the present concept of Lake Holiday
Estates, Inc. and will not materially change the ideas that have been put
forth and accepted to this time. They will continue to comply with all of
the zoning requirements designated by R5 with regard to densities, open
speces, land uses and physical configurations. You will note on the accompany-
ing map that the area originally zoned R5 is outlined in black line and the
area that should have been rezoned R5 is outlined in red line. We respectfully
request that these corrections to the R5 zoning limits be made at this time
so that we may proceed with our development in an expedient and well formed
manner.
Parcel II
This parcel of land is bounded on two sides by Lake Holiday Estates, Inc. and
on the third side by State Route 703. It consists of a total of 20.29 acres
of land with approximately 2,260 feet of road frontage on State Route 703. Our
present thoughts for this parcel of land show that we will put 46 single family
lots, averaging about 12,000 to 13,000 feet on this parcel of land and would
anticipate that all dwellings placed hereon would probably be in the neighbor-
hood of 1,200 square feet of living area per floor and probably would consist
of three bedroom homes. We anticipate no town houses or apartments on this
particular tract of land, although town houses are being considered on some
lands adjacent to this 20.29 acre tract. Based on 46 lots contained within
this 20.29 acres, we will arrive at a density of units per acre at slightly
over two. There is no anticipation of any commercial area or industrial
area within this tract of land. We do anticipate having some open green area
for local playgrounds and also riding trails that would go around the perimeter
of this tract of land. As with the rest of our development, we will be pro-
viding central water and sewer services in addition to the other amenities
and services provided by Lake Holiday Estates, Inc. We do not anticipate the
county having to provide any services for this parcel of land.
Parcel III
This tract of land consists of 30.61 acres which is bounded on three sides by
Lake Holiday Estates, Inc. and on the fourth side by Rual P. Anderson and has
no frontage on any state highway. Our present plans for this area show approx-
imately 80 single family lots contained within this 30.61 acres and a small
corner consisting of less than one acre which might be used for multi -family
or town house purposes in conjunction with several other acres already contained
within the boundaries of Lake Holiday Estates, Inc. Our anticipation of dwell-
ing units on this tract of land would be the same as we anticipate on the 20.29
acre tract of land and as stated above. This would give us a total density of
less than three units per acre on this tract of land. As with the previous
parcel No. II, we anticipate no commercial or industrial development on this
land and we will be providing central water and sewer services along with the
other amenities and services available to the entire project. As with Parcel
II, we do not anticipate the county having to provide any services to this land.
As a concluding comment, we would like to point out that all of these parcels
of land that we are requesting to be zoned R5 are a natural continuation of
the boundaries of the present Lake Holiday Estates, Inc. and their use will be
simply a continuation of the present thoughts and ideas already put forth for
the entire project. It is our feeling that with the addition of these parcels
to Lake Holiday Estates, Inc., the natural flow and progression of development
will be able to take place in an orderly fashion that will be to the benefit of
everyone concerned.
