I (we), the undersigned, do hereby respectfully make application and petition the Governing
Body to amend the Zoning Ordinance and to change the Zoning Map of Back Creek
District, Frederick County, Virginia as hereinafter requested, and
in support of this application, the following facts are shown:

Arthur Lyndall Anderson and Betty K. Anderson, his wife, parties
of the first part, hereinafter called the Grantors; VV3 Properties,
Inc., a Virginia corporation, party of the second part, hereinafter
called the Grantee; Dabney W. Watts, Substitute Trustee, party
of the third part; Western Frederick Bank of Gore, party of
the fourth part; George B. Whitacre, Trustee, party of the
fifth part; and Vernon C. Whitacre, party of the sixth part.
WITNESSETH: That for and in consideration of the sum
of Ten Dollars ($10.00), cash in hand paid and other valuable
consideration, receipt whereof is hereby acknowledged, the
Grantors do grant and convey, with General Warranty and with
English Covenants of Title, unto the Grantee, in fee simple,
together with all rights, rights of way, privileges and appurtena-
nces thereto belonging, all that certain tract or parcel of
land lying and being situate in Back Creek Magisterial District,
Frederick County, Virginia, containing 3.18644 Acres, more
particularly described by plat of Charles H. Kirkland, C.L.S.,
dated January 8, 1974, attached hereto and incorporated herein
in full by this reference; and being a portion of a larger
tract known as the Dr. S. J. Smith Home Farm and also sometimes
known as the M. C. Garvin Farm which was devised under the
Last Will and Testament of Arthur C. Oates, Deceased, duly
probated and of record in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, in Will Book 60, at Page
11, to Ivon T. Anderson (same,as Ivan Anders and Ivan Anderson
as referred to therein), with remainder in fee simple to his
son, Arthur Lyndall Anderson (same as Arthur Anders as referred
to therein), the male Grantors herein. A reference to the

aforesaid plat and will and to the references contained therein
is here made for a further and more particular description
and derivation of title of the land herein conveyed.
This conveyance is made subject to all legally enforceable
restrictive covenants and easements of record, if any, affecting
the aforesaid realty.
WHEREAS, the above described property is subject to a
certain deed of trust to Joseph B. Newlin, Trustee, securing
the party of the fourth part, and of record in the aforesaid
Clerk's Office in Deed Book 288, at Page 740; and,
WHEREAS, the said Trustee, Joseph B. Newlin, is deceased;
and,
WHEREAS, the party of the fourth part, being the sole
beneficiary under the said deed of trust, has constituted and
�I appointed Dabney W. Watts as Substitute Trustee of the said
jdeed of trust by substitution document duly recorded in the
aforesaid Clerk's Office in the current Deed Book, immediately
preceding this deed of conveyance; and,

to a second deed of trust to George
B. Whitacre, Trustee, securing

hereto, directs the hereinabove described property to be released
from the lien created by the second deed of trust.__
THEREFORE, that for and in consideration of the sun of
Ten Dollars ($10.00), cash in hand paid and other valual)le
consideration, receipt whereof is hereby acknowledged, George
B. Whitacre, Sole Acting Trustee, joins in this deed for the
sole purpose of releasing all his right, title and interest
in the property hereby conveyed, including his interest as
Sole Acting Trustee under the aforesaid•second deed of trust,
but it is expressly understood that the release of the property
herein conveyed from the lien of said second deed of trust
shall not affect in any wise the lien of said second deed of trust
upon the other land thereby conveyed and not released hereby.
