Your Petitioners, who are property owners in the area of the property for which rezoning is proposed, respectfully represent that the proposed rezoning should be granted for many reasons, of which the following are representative: Such proposed rezoning has been requested in order that a modern self-service grocery store may be constructed. There is presently a great need for such a facility in the area because of the relatively dense population and a lack of any modern grocery stores for a radius of several miles. The property for which rezoning is requested is bordered by two state roads and by other property owned by and Gretchen D. Rosenberger which would serve as a buffer as far as any other property owners are concerned. Ronald Berg, Frederick County Planning Director DATE: SUBJECT: Rezenings to be considered at the August 2, 1973 Planning Commission Meeting 1. Shawneeland doing business as Shawneeland has requested the rezoning of 475 acres near their present development for multi -family apartments, condominiums and duplexes. 2. William and Leroy Edmonson have requested the rezoning of 106 acres from Agricultural to Light Industrial. This lard is located on Route 50 East across from Perry Engineering and runs back to the Winchester Municipal Airport along Route 728. 3. Carlin Smith and Lester Elliott have applied to rezone 39 acres on Senseny Road, next to the Fairway Estates for multi -family and commercial uses. 4. Tabled at the last Planning Commission Meeting and to be con- sidered at the August Meeting is the application of Thomas Rosenberger to rezone one (1) acre on Route 600 for a grocery store. 1.3y- 7/ ROSENBERGER REZONING The property for rezoning is one (1) acre in Back Creek Magisterial District with a 159 foot frontage on Route 600. The land is owned by Thomas Rosenberger who seeks to rezone it from Agricultural (A-1) to Business (B-1) for a grocery store. WCAT ION : This property is located at the corner of Route 600 and the Shawneeland entrance and is across the access road from the Rosenberger Home. STAFF COMMENTS: There should be no problem with this one (1) facility. The only possible problem would be that a spot zoning such as this would open Route 600 to other commercial uses, such as filling stations, or vacation home sales lots. A possible alternative would be to rezone five (5) or ten (10) acresfora commercial complex and then restrict commercial development to that complex.
