TO THE PLANNING COMMISSION AND BOARD OF SUPERVISORS, FREDERICK COUNTY, VIRGINIA:
I (we), the undersigned, do hereby respectfully make application and petition the Governing
Body to amend the Zoning Ordinance and to change the Zoning Map of Frederick
County, Virginia as hereinafter requested, and
in support of this application, the following facts are shown:
1. The property sought to be rezoned is located at Kernstown, Virginia

Re: Mobile Home Application
Dear Mr. Van Dyke:
I am writing you concerning the status of your
mobile home application which you recently filed with
the County. After receiving an interpretation from
the State Planning Division, it was determined that
your mobile unit is not a mobile home, as defined in
the 'Zoning Ordinance of Frederick County. The County
Ordinance defines a mobile home as a dwelling unit.
The State Planning Division interpreted your structure
as a mobile unit and not a mobile home.
The Frederick County Board of Supervisors concurs
with this interpretation. Consequently,.a location
permit for your mobile unit, used as office space, will
not be necessary.
If there are any questions concerning this letter,
please do not hesitate to contact me.

Pursuant to the action taken by the Frederick County Board
of Supervisors on Wednesday evening, January 24, 1973, I
request that you direct a letter to me confirming the fact
that no trailer permit is required for the mobile business
unit located upon the tract of land containing 1.72 acres
on the East side of U.S. Route 11 south of Winchester,
Virginia, and owned by H. Ray Van Dyke. I need this infor-
mation so that Mr. Van Dyke can proceed to have the electrical
work done on the business unit and other similar preparations.
As your file will note, this office filed an application for
rezoning of the said 1.72 acres from M-2 to B-2 on
January 8, 1973. As of this date, I have seen no notice or
advertisement of a public hearing before the Planning Com-
mission in the Winchester Evening Star or any other newspaper.
Please be advised that Mr. Van Dyke would like to proceed with
this rezoning as soon as possible. As you are well aware, the
notice requirements as set down by the Code must be followed
strictly in order for a rezoning to be legally made. I there-
fore solicit your cooperation in this regard.
I shall look forward to hearing from you forthwith.

before the Frederick County Planning Commission on February
21, 1973, at approximately 2:55 p.m. in the above -captioned
matter. I will be happy to pay whatever fee there is connected
with this service.
I would appreciate your expediting, to the extent that you are
able , the setting of a hearing date for Mr. Van Dyke' s
application beface the Frederick County Hoard of Supervisors.
