REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to the rezoning of this property. Before

review. Any work performed on State rights -of -way must be covered under a land use permit. This
permit is issued by this office and requires an inspection fee and surety bond coverage.
Public Works: Every effort shall be made to protect the groundwater and surface water sources
along the western property boundaries. Appropriate buffers shall be installed and maintained during
the life of the mining operations.
County Attorney: Do not believe that the applicant can proffer no access to roadway by W. S. Frey
vehicles or drivers. The applicant could proffer that access to the road would be closed. The rest
appears to be of proper form.
Planning & Zoning_
1) Site History
The original Zoning Map for Frederick County (USGS - Stephenson Quadrangle) demonstrates that
the properties owned by the W. S. Frey Company, Inc., that are located on the north side of Walters
Mill Lane (Route 836) were zoned M2 (General Industrial) District. These properties were rezoned
to EM (Extractive Manufacturing) District as a part of the Comprehensive Rezoning initiated by the
Board of Supervisors on October 8, 1980.
The W. S. Frey Company, Inc., also owns property on the south side of Walters Mill Lane. This
property, totaling 121, acres was originally zoned A-2, Agricultural General District and is now zoned
RA (Rural Areas) District. The W.S. Frey Company, Inc., has requested to rezoned 31.74 acres of
this 121 acre tract.
2) Location
The 31.74 acres proposed for rezoning is located in the Sewer and Water Service Area (SWSA) and
is part of the acreage incorporated into the study area for the Route 11 North Corridor Plan. The
31.74 acres is within an area depicted for future industrial in the Route 11 North Corridor Plan.
3) Site Suitability
The 31.74 acres proposed for rezoning does not contain areas of steep slope, flood plain, wetlands,
or woodlands. The portion of this acreage on the north side of Walters Mill Lane contains a small
amount of Carbo Silt Loam soils (513) which are classified as prime agricultural soils.
The Frederick County Rural Landmarks Survey identifies two structures within the proximity of the

31.74 acres proposed for rezoning. One of these structures, identified as the Zinn House (34-114),
is identified as a potentially significant historic structure by the survey. Staff has walked the acreage
proposed for rezoning and believes that the continuation of the subsurface mining and quarry
operation will not impact the viewshed or property associated with this historic resource.
4) Potential Impacts
1) Walters Mill Lane
Approval of this rezoning application would necessitate the relocation of Walters Mill Lane
to the south. Walters Mill Lane is identified on the Frederick County Secondary Road
Improvement Plan as an unscheduled hard -surface project. The Virginia Department of
Transportation (VDOT) will require the applicant to submit an engineered plan which
accounts for right-of-way dedication and construction of this realignment. Hard -surface
improvements to Walters Mill Lane need to be a component of this relocation project.
2) Expansion of Current Operation
The proximity of the 31.74 acres to adjoining residents and other land uses does not appear
to create any significant impacts associated with the subsurface mining and quarry operation.
The W. S. Frey Company, Inc., is required to obtain a permit from the Department of Mines,
Minerals and Energy (DMME) for their operation. This permit is subject to annual renewal,
which has been approved by DMME through December 28, 1998. The W. S. Frey Company,
Inc., is required to file for an amendment to the DMME permit should this 31.74 acres be
rezoned by the Board of Supervisors.
The W.S. Frey Company, Inc., is subject to DMME and Department of Environmental
Quality (DEQ) compliance for dust, and noise impacts. Operations are required to keep dust
down by watering, while berming, screening, and equipment mufflers are required to mitigate
noise impacts. The DMME permit does not regulate hours of operation; however, it does
prohibit blasting during non -daylight hours. The DMME will inspect mining operations if
complaints are received to ensure compliance with their permitting requirements. The annual
renewal of the DMME permit is contingent upon compliance with these requirements.
3) New Structure Development
Staff advised the project engineer that it would not be necessary to run the Capital Facilities
Impact Model for this rezoning application or obtain review agency comments from the Fire
Marshal and Building Official if no new structures were to be developed on the 31.74 acres.

The Impact Analysis Statement indicates that there are no habitable structures planned for
development on the 31.74 acres; however, this is not a condition of the proffer statement.
5) Proffer Statement
The applicant has prepared a proffer statement which has been signed, notarized, and reviewed by
the County Attorney. The applicant has proffered to construct the relocated portion of Walters Mill
Lane in accordance with VDOT standards and specifications, and has proffered no access to this road
by W. S. Frey Company vehicles.
STAFF RECOMMENDATION FOR 07/01/98 PLANNING COMMISSION MEETING:
The proposal to rezone 31.74 acres from RA (Rural Areas) District to EM (Extractive
Manufacturing) District is compatible with existing land use and is consistent with the Route 11 North
Corridor Plan. The applicant has proffered to relocate Walters Mill Road as required by VDOT.
Staff believes that the applicant should consider the inclusion of language in the proffer statement
which prohibits the development of structures within the 31.74-acre area. Staff would also
recommend that the applicant revise the proffered condition for access onto Walters Mill Lane to
address the concerns expressed by the County Attorney. Staff believes that the request to rezone
this 34.71-acre area would be appropriate, provided that the applicant adequately address the issues
raised by staff.
PLANNING COMMISSION SUMMARY & ACTION FROM THE 07/01/98 MEETING:
The revised proffer statement submitted to the Planning Commission included language prohibiting
habitable structures from being constructed on the 31.74 acres; it prohibited new entrances from
being added onto Walters Mill Lane along the 31.74 acre -parcel; and it specified that the relocated
portion of Walters Mill Lane shall be designed, approved for construction, and constructed prior to
the abandonment of the existing road.
Five adjoining property owners were present to express their concerns about what they perceived to
be repercussions of the expansion. The concerns expressed included: decrease of property values;
additional noise, dust, and vehicular traffic; environmental issues, such as water pollution to Hot Run
Spring and the effects of limestone dust on livestock; vibration damage to foundations and water
systems; concern that the proposed 200' between relocated Walters Mill Lane and the railroad tracks
did not provide enough separation for safety. There were questions on what portion of the road
would be upgraded and who would pay for the upgrade; questions on anticipated plans for the

remaining section of road, between Route 11 and the relocated portion; and, how the road would be
surfaced. One adjoining property owner, Mr. Gregory G. Roberts, said that his kitchen is a mere 15'
from the center of Walters Mill Lane and his well is approximately 15'-20' away. He hoped the road
could be upgraded from the opposite side.
Members of the Commission explained to the citizens that if a state -maintained road has 250 trips per
day or less, it is only required to have a tar and chip surface; it is not required to have bituminous
concrete (black top). Furthermore, the decision on what road surface is used and where the right-of-
way is acquired is made by VDOT, not Frederick County. Members of the Commission also noted
that most of the concerns expressed fell under the jurisdiction of the DEQ and the DMME and are
monitored by their permitting process and yearly inspections. Commission members believed that the
request to rezone the additional 34.71-acre area was appropriate, provided that the applicant address
the issues raised. It was noted that the quarry has been at this location for more than 30 years and,
considering the existing size and scope of the quarry which is almost two miles long, the applicant
was only requesting an additional 500'-600' to expand operations for a few additional years.
The majority of Planning Commission members were in favor of the rezoning with a recommendation
to the Board of Supervisors that they request VDOT improve Walters Mill Lane (Rt.836) from Route
11 to the Frye property line, at which point the W.S. Frey Company will be responsible for
improvements.
The vote on this recommendation was:

AN ORDINANCE AMENDING

Rezoning #010-98 of W. S. Frey Company, Inc.
WHEREAS, Rezoning #010-98, W. S. Frey, Inc. (Cedar Land Co., L.C.), was submitted by G. W.
Clifford & Associates, Inc. to rezone 31.74 acres from RA (Rural Areas) to EM (Extractive
Manufacturing) District. This property is located approximately 1,600 + feet east of the intersection
of Martinsburg Pike (Route 11 N.) and Walters Mill Lane (Route 836), and is identified with Property
Identification Number 44-A-96 in the Stonewall Magisterial District; and
WHEREAS, the Planning Commission held a public hearing on this rezoning on July 1, 1998; and
WHEREAS, the Board of Supervisors held a public hearing on this ordinance adoption on August
12, 1998; and reconsidered this ordinance adoption on September 9, 1998; and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be
in the best interest of the public health, safety, welfare, and in conformance with the Comprehensive
Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map
to change 31.74 acres from RA (Rural Areas) to EM (Extractive Manufacturing) as described by the
application and plat submitted, subject to the attached conditions voluntarily proffered in writing by

Preliminary Matters
Pursuant to Section 15.2 - 2296 et. sea., of the code of Virginia, 1950, as amended, and
the provisions of the Frederick County Zoning Ordinance with respect to conditional
zoning, the undersigned applicant hereby proffers that in the event the Board of
Supervisors of Frederick County, Virginia, shall approve Rezoning Application #
for the rezoning of 31.74 acres from Rural Area (RA) to Extractive Manufacturing (EM)
Zoning District, development of the subject property shall be done in conformity with
the terms and conditions set forth herein, except to the extent that such terms and
conditions may be subsequently amended or revised by the applicant and such be
approved by the Frederick County Board of Supervisors in accordance with Virginia
law. In the event that such rezoning is not granted, then these proffers shall be
deemed withdrawn and of no effect whatsoever. These proffers shall be binding upon
the applicant and their legal successor or assigns.
Transportation Improvements to Offset Impact of Development
In the event, the property is rezoned to EM and used for mining extraction Virginia
Secondary Route 836 shall be relocated by W. S. Frey Company, Inc. The relocated
portion of Virginia Secondary Route 836 shall be constructed in accordance with the
Virginia Department of Transportation (VDOT) Standards and Specifications including
the road design manual. W. S. Frey Company, Inc. proffers right-of-way as necessary to
design/construct Virginia Secondary Route 836 from U.S. Route 11 eastward to connect
with the relocated portion of Virginia Secondary Route 836 proposed. W. S. Frey
Company, Inc. shall provide additional right of way and pavement for that portion of
Virginia Secondary Route 836 from the eastern most end of the proposed relocated
roadway to the cul-de-sac at the end of state maintenance.
The relocated portion of Virginia Secondary Route 836 shall be designed, approved for
construction, and constructed prior to the abandonment of the existing road.
The W. S. Frey Company, Inc. proffers to pave the section of the existing Virginia
Secondary Route 836, or an alternative connection to U.S. Route 11, in accord with
VDOT standards at such time the minimum right of way is donated by individual
property owners and a road base is provided by VDOT. The proffer described in this
paragraph shall be void if the Frederick County Board of Supervisors does not make
the right of way described herein available within four (4) years of the date of the
rezoning approval.

Traffic Considerations for Virginia Secondary Route 836
No new entrances shall be added on Virginia Secondary Route 836 along the 31.74 acres
to be rezoned to EM.
W.S. Frey Company, Inc. mining operation vehicles shall not assess Virginia
Secondary Route 836.
Building and Structures
No habitable structures will be constructed on the 31.74 acres rezoned to EM.
The conditions proffered above shall be binding upon the heirs, executors,
administrators, assigns and successors in interest of the Applicant and Owner. In the
event the Frederick County Board of Supervisors grant said rezoning and accepts these
conditions, the proffered conditions shall apply to the land rezoned in addition to
other requirements set forth in the Frederick County Code.

Review of Impact Analysis Statement Components.
Purpose - The purpose of this request is to add 31.74 acres of Extractive Manufacturing (EM)
zoning district allowing W.S. Frey Company, Inc. to continue the existing limestone
quarry on property owned by W.S. Frey Company, Inc.
Background - Presently Cedar Land Company, Inc. (W.S. Frey Company, Inc.) owns a considerable
amount of property in the Clearbrook area. The property requested to be rezoned from
Rural Area (RA) to Extractive Manufacturing (EM), 31.74 acres is a portion of a larger
tract that is actively being mined. The larger tract has both RA and EM zoning
classifications. The zoning district boundary splits the property. To the south of the
existing quarry along Va. Sec. Route 836 favorable geology continues allowing W.F. Frey
Company, Inc. to move into the area identified for EM zoning.
A portion of Va. Sec. Route 836 will be designed and relocated in accord with Virginia
Department of Transportation standards. The portion of the road requiring relocation for
the quarry operation is located on property owned by Cedar Land Company, Inc. The
owner has proffered that the road will be relocated and built to VDOT standards.
There are no habitable structures planned for development on the 31.74 acre site to be
zoned EM.
Location - The portion of the property to be zoned EM is located approximately 2,000 feet from U. S.
Route 11 (Martinsburg Pike) along Va. Sec. Route 836 (Walters Mill Road). A majority
of the site is located south of existing Route 836.
Site Suitability - The site, 31.74 acres, is suitable for EM zoning. There are no flood plains, steep slopes,
wetlands, mature woodlands or prime agricultural soils that provide limiting factors for the
intended quarry use. The geology of the area to be zoned EM indicates excellent
subsurface positioning of the high -calcium limestone formation. This formation is knows
as the Mosheim formation.
Surrounding Properties - The use of the surrounding properties located around the 31.74 acre portion to
be zoned EM, are owned by the Cedar Land Co., Inc. and are actively used for
the W.S. Frey Company, Inc. limestone quarry operation. The areas not being
quarried are in pasture land or are vacant. The property is bound on the north by
Va. Sec. Route 836, on the east by the W.S. Frey Company, Inc. railroad spur,
on the south by the railroad main line and on the west by pasture land.

Traffic - There are no traffic impacts associated with the requested EM zoning. The owners have
proffered that W.S. Frey Company, Inc. vehicles shall not access Va. Sec. Route 836.
Current traffic counts are low for the portion of Va. Sec. Route 836 impacted by the EM
zoning change. This route serves a few single family large - acre residential homes and an
existing business, Aberdene Acres, a kennel operation.
A portion of Va. Sec. Route 836 will be relocated and constructed by the owners. The
portion impacted by the quarry operation will be constructed to VDOT standards.
Sewage Conveyance and Treatment - Not applicable, no impact.
Water Conveyance and Treatment - Not applicable, no impact.
Drainage - The major portion of the site proposed for EM zoning drains north toward the existing quarry
operation. There are no impacts anticipated on the unnamed tributary of Hot Run to the
south.
Solid Waste Disposal Facility - Not applicable, no impact.
Historic Sites and Structures - There are no known historic structures or sites located on the 31.74 acre
site. Two structures are located near the intersection of U.S. Route 11
North and Va. Sec. Route 836. There are no associated impacts to these
structures with the proposed EM zoning. An earlier berm currently
exists along a portion of the property.
Impact on Community Facilities - There are no known projected capital costs for community facilities
attributed to the proposed rezoning.
As with most business and industrial projects a net positive fiscal impact
occurs. The writer believes that a net positive fiscal impact would be
projected for the proposed 31.74 acre EM zoning should the County
model allow for such criteria.
Other Impacts - There are no known other impacts that would impact on the cost of the County
providing facilities to serve this request.

This conveyance is made subject to all duly recorded and enforceable restrictions,

DATE: September 2, 1998
During the August 12, 1998 meeting, the Board considered the referenced application to rezone
31.74 acres from RA, Rural Areas District to EM, Extractive Manufacturing District. The purpose
of this application is to expand the limits of the current mining operation to the south, which will
traverse Walters Mill Lane (Route 836). Approval ofthis application would necessitate the relocation
of Walters Mill Lane to the south, approximately 200 feet north of the CSX railroad tracks.
As you know, the Board tabled this application for 30 days and directed the applicant to address
several issues and concerns that were raised during the August 12, 1998 meeting. These issues and
concerns pertained to the relocation of Walters Mill Lane and the extractive manufacturing mining
operation process and procedures, and are summarized as follows:

concerns with structural damage or concerns with air, water and noise pollution?
Supervisor Shickle directed the applicant to address the issues and concerns enumerated in this
memorandum, and advise the Board of their willingness to go above and beyond the requirements
imposed by the state permitting process. Supervisor Sager directed the applicant to meet with the
Virginia Department of Transportation (VDOT) to determine how the state envisions Walters Mill
Lane improvements to occur, and directed staff to contact the Resident Engineer and ask if he would
attend the next meeting.

Dear Frederick County Board of Supervisors:
As you are all aware, the W.S. Frey Co. has requested approval to re -zone 31.74 acres
along Route 836 from RA to EM. During the two public hearings, several questions have
been asked concerning; the road relocation and the quarry expansion. I would like to
outline these questions and respond accordingly:
1. Relocation of Route 836 - The W.S. Frey Co. has proffered to relocate approximately
3100 feet of this road. We will design, engineer, and build the relocated section
of road to current VDOT specifications. The road will be constructed 18 feet wide
with a minimum 4.0 right-of-way. The W.S. Frey Co. has agreed to construct the
road's surface using HMAT (asphalt), which exceeds the minimum subdivision street
requirement of double prime and seal. This will minimize future maintenance costs for
the State. Additionally, we have agreed to give a minimum 40 foot right-of-way for
additional road improvements along our property. Furthermore, we have agreed to
furnish and install HMAT min: over the front portion of the road out to Route 11 after
VDOT has designed and built the base. As an additional token of good faith, we will
HMAT surface the balance of the road to the current end of state maintenance
provided VDOT designs and builds the base. All other right-of-way, negotiations must
be between VDOT and the property owners. In a meeting last week with the
neighbors and VDOT, everyone seemed to agree that the best location for the section of
road out to route I 1 was to go behind the Roberts house on W. S. Frey property.
Mr.Cutshaw seemed conducive to give right-of-way for a coiner of his property to
facilitate the curve in the road . The relocated section of road will be constructed
completely prior to the abandonment of the existing road, thus there will be no
inconvenience to road travelers. The W.S. Frey Co. has also proffered not to run
customer trucks from our facility over route 836.
2. Screening - The VA State Mining Laws states that screening shall be provided to
improve the appearance of the mining site from public roads, public buildings,
recreational areas, and occupied dwellings. At the request of A4r. Rudy Martin, we
are currently improving the screening berm along Route I I by re -seeding and planting
pine trees. A similar "screening" will be constructed along the relocated portion of
Route 836. Vegetation will be planted to assure it is aesthetically pleasing to the
neighbors.

3. Reclamation - The Virginia Department of Mineral Mining conducts annual
inspections to insure the all reclamation work is done to State guidelines. The
W.S. Frey continues to reclaim "inactive" land on an annual basis to ensure the beauty
of the surrounding area. The State Mining and Reclamation regulations allow the
mining operator to have a site for disposal of overburden, dirt, rock, etc. Our
disposal Area has been at its current location since 1960. The active area is only a
small section of the overall disposal area. The rest has been reclaimed.
In addition, the W.S. Frey Co. pays $ 12.50 per affected acre, annually, into a. State
Reclamation Fund. The purpose of the Statewide fund is to reclaim abandoned mine
property if the operating company defaults. Therefore, the surrounding property
owners can be assured that the land will be "restored" once muting, has ceased.
4. Environmental Concerns -The W.S. Frey Co. has been operating at this location since
1960. I have been employed here since 1976. To my knowledge, there has never
been instances where the ground water/ wells have been contaminated or now
affected by our mining operation. Therefore, I have no reason to believe there
will be any problems in the fixture. We utilize our inactive quany to collect surface
runoff; then, we pump it at a controlled rate into Clear Brook Run. This reduces
erosion and flooding during times of heavy rains. All water discharged is
monitored by us in accordance to our State Water Discharge Permit. All under-
ground f iel storage tanks have been removed; and replaced with above -ground tanks
with eontaininent. A Phase I Environmental Site Assessment has been completed
by Triad Engineering. The W. S. Frey Co. has a "clean bill of health."
There will be no change inn the mining related activities. We will continue to utilize
water for dust suppression on our drills and roadways. Water sprays and dust
collectors will continue to be utilized throughout the processing plants as required
by the Virginia Department of Environmental Quality. Any plant built after 1976
is required to have a "Air Pollution Permit" and must utilize the Best Available
Control Technology - BACT. There are 19 dust collectors located throughout the
various plants at the Clear Brook location. A pulse jet, fabric filter, dust collector is
99.9% efficient.
Mining in the rezoned area will not affect current operating hours. We will continue to
primary crush rock during the dayshift. The, lime kiln and fine- grinding plant will
continue to operate 24 hrs. per day. There will be no additional new noises created.
As a result of the re -zoning, mining south of the existing route 836 will still be over
1/4 of a mile from our closest neighbors (Martin and Roberts); only a few hundred feet
closer than current mining. It will be 1/2 - 3/4 mile to the Ebersol's, Braggs,
Anderson's, Pooles, and Stubblefields. None of these folks can see mining in the re-
zoned area from their homes.
Blasting procedures will continue without changos. We generally blast at noon
and/or 4:00 PM. Aloud horn is sounded just before, and just after the blast. There
are no other requirements to notify surrounding homeowners. Most neighboring
property owners are aware of our blasting procedures and time schedule, since it
have been the same for over 20 years.
hi closing, I would like to say that I understand why the surrounding neighbors have
concerns. We have tried to be a good neighbor throughout our 38 years in
Clear Brook. It is very, very seldom that a complaint is made to us. However, if a
complaint is made; it is then investigated by our safety director, and handled
accordingly. If a homeowner does not notify us of a problem, then live have no way to
resolve it. I would also hope that Ave, can continue to be good neighbors to all
those families/businesses who chose to move in next to our operating quarry.
However, homeowners can always contact the appropriate State or Federal Agency
if he or she feels that their concerns have not been addressed properly. The phone

Jeff Everett and I went to the Department of Historic Resources Office to research the
potentially significant structures which adjoin the W. S: Frey property. The Zinn House
(ID# 34-114) is significant, while Rose Lawn (ID# 34-717) is not as significant but
warrants consideration. An HRAB comment will be required for this application as
indicated in my notes. This issue was apparently discussed with Mark Georgiana and
David Frey during the 4/7/98 meeting, as a reference was made to providing a landscaped
screen with an earth berm. W. S. Frey may want to consider this as a component of their
proffer statement.

The Zinn House is a very well-preserved stone house. It has had no major additions/changes except
for some 'Victorianization" and still stand in its original central hall plan. The symmetrical
house is 5 bays wide with 2/2 windows with wooden lintels and plain corner blocks. It has a boxe
cornice with brackets; 2 interior end brick chimneys; a recessed front door with a 2-light transo
There is a datestone in the north end of the house (in the gable) that say "W.S. 1809". A 3-bay
porch with wrought iron supports is found at the front of the house. It has a hipped roof and
brackets in its eaves. Asphalt shingles cover the porch roof. The roof of the house is gable and
is covered with slate. A 5-bay porch runs the length of the entire rear elevation. The Zinn

The Zinn house has many outbuildings. There is a stone/brick fireplace directly to the east of th
house. It was nrobab]v from the summer kitchen. A late 19th Century bank barn on a stone found-
ation is located NE of the house. There is also a frame corn crib, stone springhouse, frame shed/
garage and frame chicken coop around the house. The house sits off of Rt. 11N. A wrought iron
fence runs across the front of the house. Mature trees are found in the yard. A spring is
located East of the house. The Zinn house is significant as a fine example of an early 19th
Century stone house in Frederick County. It was originally on the Alexander Ross tract.

County Historic Resources Advisory Board (HRAB) is meeting Tuesday, June 16, 1998
and that your concerns regarding the identified structures near the intersection of
Routes 11 and 836 will be discussed. Additionally, since no habitable structures are
planned comments from the building inspector and fire marshal are not required. I
have included copies of the appropriate permits from the Department of Mines, Mineral
and Energy per your request.
The continuation of the W. S. Frey Co., Inc. limestone operation into the area requested
for EM zoning is an important economic development action for this existing industry.

B. Minimum landscaped area. In the B2 Business General Zoning District,
the Planning Commission may require that more than fifteen percent
(15%) of the area of a site shall be landscaped in order to meet the
intent of this chapter. Additional landscaped areas may be required to
ensure that all unused areas are landscaped and to improve the general
appearance and use of the site. In no case shall more than twenty-five
percent (25%) of the site be required to be landscaped in the B2
Business General Zoning District.
ARTICLE XI
EM Extractive Manufacturing District
§ 165-84. Intent.
The intent of the Extractive Manufacturing District is to provide for mining and
related industries, all of which rely on the extraction of natural resources.
Provisions and performance standards are provided to protect surrounding uses
from adverse impacts. It is also the intent of this Article to avoid the
encroachment of incompatible uses on the borders of the EM District.
§ 165-85. Permitted uses.
The following uses shall be allowed:
A. Surface or subsurface mining of rock, metal and nonmetallic ores.
B. Oil and natural gas extraction and/or pumping, including storage of
production produced on the site. No refining is allowed.
C. Sand and gravel mining and processing.
D. Crushed stone operations.
E. Manufacture and processing of cement, lime and gypsum.

F. Asphalt and concrete mixing plants.
G. Brick, block and precast concrete products.
H. Farming, agriculture, orchards, nurseries, horticulture, dairying and
forestry.
I. Accessory uses.
J. Business and directional signs.
K. Public utilities, including poles, lines, distribution transformers, pipes,
meters and sewer facilities.
§ 165-86. Performance standards.
All uses shall conform to applicable state or federal regulations governing
noise and vibration. The Zoning Administrator may require the submission of a
copy of data submitted to state or federal agencies pertaining to these
performance standards with the required site plan.
§ 165-87. Landscaping.
Appropriate landscaping or screening may be required by the Zoning
Administrator or Planning Commission within any required yard setback area in
order to reasonably protect adjacent uses from noise, sight, dust or other
adverse impacts.
§ 165-88. Setback and yard requirements.
A. Front setback.
(1) All principle and accessory structures shall be set back seventy-
five (75) feet from any road, street or highway right-of-way.
(2) Excavations shall be no closer than one hundred (100) feet from
any road, street or highway right-of-way. The Planning Commis-
sion may reduce the required front setback for excavation to fifty
(50) feet if it determines that, through the use of measures, such
as landscaping or screening, the effective protection afforded to
adjacent properties has not been reduced.

any property zoned RA, RP, R4, R5 or MH 1. No excavation shall
be located closer than two hundred (200) feet from any dwelling
or platted residential subdivision. The Planning Commission may
reduce these required setbacks to fifty (50) feet if it determines
that, through the use of measures, such as landscaping or
screening, the effective protection afforded to adjacent properties
has not been reduced.
(3) All crushing or screening machinery shall be set back at least
three hundred (300) feet from any property boundary. If such
equipment is fully enclosed within a building which maintains the
effective protection afforded adjacent properties, the Planning
Commission may reduce this yard requirement to a minimum of
two hundred (200) feet.
§ 165-89. Height limitations.
No structure shall exceed forty-five (45) feet in height.
§ 165-90. Additional requirements.
All uses in the EM District must conform with all state, federal and local
regulations. All mining operators shall submit to the Zoning Administrator a copy
of the operations plan required by state agencies with the required site plan.
