County Engineer: We have no comments at this time. A detailed review will be made at the time
of the site plan submission. Stormwater management could be a consideration at that time if
additional pavement is added.
Health Department: As there are to be no employees and, therefore, no sewage generated, the
Health Department has no objection to this proposed use.
Planning & Zoning_
1) Site History
The original Zoning Map for Frederick County (U.S. G. S. Gore Quadrangle) demonstrates that this
site was zoned A-1 (Agricultural Limited) District. This zoning designated was reclassified to RA
(Rural Areas) District on February 14, 1990 when the comprehensive revision to the Zoning
Ordinance was adopted by the Board of Supervisors.
2) Location
The 3.29-acre site is located on the south side of Gore Road (Rt. 751) which is the site of the Gore
Elementary School on old Route 50 West. This property is located outside of the County's Urban
Development Area (UDA) and the Sewer and Water Service Area (SWSA), and is located within the
Gore Rural Community Center. The Comprehensive Policy Plan states that land use within the Gore
Rural Community Center should include commercial and increased residential densities that are
developed in character with the existing rural area.
3) Site Suitability
The 3.29-acre site does not contain environmental features or historic resource areas. An intermittent
stream beginning on the north side of Northwestern Pike traverses the eastern boundary of this
property which drains into Back Creek.
4) Potential Impacts
a) Community Facilities and Services: Staff has applied the Capital Facilities Impact
Model to this rezoning application assuming the worst case square footage
development scenario for self-service storage facilities. The results of this impact
model run demonstrate a negative impact to Fire and Rescue Services for capital
facilities costs.
b) AdjoiningProperties: The conversion of the Gore Elementary facility into self-service
storage facilities, as well as the potential for the development of new self -storage

facilities may have an impact on adjoining properties that are currently used for
residential purposes. These impacts would involve increased traffic in and out of this
site, security lighting, and hours of operation.
5) Proffer Statement
The applicant has submitted a proffer statement that has been signed, notarized and reviewed by the
County Attorney. The applicant has proffered to prohibit all permitted uses in the B2 District except
for self-service storage facilities, to prohibit new entrance locations along Gore Road, and to maintain
the existing Gore School playground as a neighborhood park until such a time that self-service
storage facilities are developed in this area of the site. The applicant has also proffered a monetary
contribution of $0.02 (two cents) per square foot of existing and future building area on this site.
STAFF CONCLUSIONS FOR 11/04/98 PLANNING COMMISSION MEETING:
A land use plan has not been created for the Gore Rural Community Center; however, the
Comprehensive Policy Plan recommends future commercial development in this area. The applicant
has proffered out all potential uses permitted in the B-2 District except for self-service storage
facilities; therefore, the perpetual effect of a favorable action would be a specific commercial use on
this site which is not water and sewer dependent and has a reasonably low average daily traffic count.
The monetary amount proffered by the applicant is 17% greater than the amount demonstrated by
the Capital Facilities Impact Model results. The willingness to allow public access on this site for the
use of a neighborhood park, which would be maintained by the applicant, provides a recreational
opportunity for the community center in the short term, as a western county regional park has not
been realized. The applicant should provide additional information regarding facility security lighting
and hours of operation to ensure that all potential impacts are realized during the decision -making
process for this application.
PLANNING COMMISSION SUMMARY & ACTION OF 11/04/98: Two citizens were
present to speak concerning the rezoning application. One person was not opposed to the rezoning,
but had questions about the hours of operation, if security lighting would affect the neighbors, if there
would be outside storage, if the size of the individual interior units would exceed the square footage
allowed by the zoning ordinance, if the facility would be completely screened according to the B2
ordinance requirements, and if the lease agreements would state that no hazardous materials are to
be stored. The other individual was opposed to the rezoning because of the potential negative impact
on the residential neighborhood, his belief that the vegetative or opaque fencing would not
accomplish screening objectives because of the way the property drops off, that an additional self-
service storage facility in this area would not benefit the community, his belief that the use promotes

the storage of illegal drugs and other stolen items, that children playing in the park would be at risk
because of strangers and outsiders coming into the neighborhood to use the facility, and finally, that
a B2-zoned property in the middle of an RA -zoned area was not appropriate.
The applicant addressed the concerns raised to the satisfaction of the Commission. The Commission
believed that as long as the issues raised were addressed satisfactorily, in addition to the proffers
submitted, the rezoning was appropriate; and they recommended approval by the following majority
vote:

Rezoning #017-98 of Gore School
WHEREAS, Rezoning Application #017-98 of Gore School was submitted to rezone 3.29 acres
from RA (Rural Areas) to B2 (Business General). This property is located at 251 Gore Road (Rt.
751), and is identified with Property Identification Number 28-A-52 in the Back Creek District; and
WHEREAS, the Planning Commission held a public hearing on this rezoning on November 4,
1998; and
WHEREAS, the Board of Supervisors held a public hearing on this ordinance adoption on
December 9, 1998; and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be
in the best interest of the public health, safety, welfare, and in conformance with the Comprehensive
Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map
to change 3.29 acres from RA (Rural Areas) to B2 (Business General), as described by the
application and plat submitted, subject to the attached conditions voluntarily proffered in writing by
the applicant and the property owner.

INTPZODUCTION
The subject property consists of one parcel containing a total of approximately 3.29
acres. The property is located on 251 Gore Road, Route 751, (old Route 50). The
property is zoned RA.
The intended purpose for the rezoning is to allow self -storage in the currently vacant
building.
Pursuant to the applicable provisions of the Frederick County Zoning Ordinance, the
undersigned applicant proffers that in the event that the Board of Supervisors of
Frederick County shall approve Rezoning Application #017-98 for the rezoning of 3.29
acres will be in conformity with the terms and conditions set forth in this document.
These terms and conditions may be subsequently amended or revised by the owner of the
property with permission from the Frederick County Board of Supervisors in accordance
with Frederick County codes. These proffers shall be binding on the owner and their
legal successors or assigns.
PROFFERS
1. Applicant proffers to restrict permitted use on this property to self -storage facilities
only.
2. Applicant proffers to not construct any new entrances or exits to property off of Route
751.
3. Applicant proffers to maintain existing park for neighborhood use until such time as

ORGANIZATIONS
The owner will pay or will cause to be paid to the Treasurer of Frederick County the sum
of $.02 (two cents) per square foot of the existing 12,000 square foot building for impacts
to fire and rescue services. The sum will be paid when the change of zoning is approved
by the Board of Supervisors. The owner will also pay $.02 (two cents) per square foot
for any additional storage facilities built in the future.

2. Enforcement of Lien. In the event of default in the payment of rent provided.herein, LANDLORD shall notify the TENANT of such default by regular mail at his last known
address. If such default is not cured within Ten (10) days after its occurrence, then the LANDLORD may enforce its lien according to the laws of the State of Virginia.
3. TENANT shall not place or keep in such space explosives, inflammable liquids, contraband or other goods prohibited and agrees to abide by any rules promulgated by
LANDLORD governing the use of the premises. TENANT shall permit no damage thereto and shall indemnify and hold LANDLORD harmless from any claim or cause of
action arising out of TENANT'S use of the premises. TENANT assumes responsibility for any loss or damage to the property stored by TENANT in said space
and may or may not elect to provide insurance coverage for same, TENANT will not use the premises for any unlawful purpose. NO SMOKING ALLOWED.
4. Upon expiration of this Lease, if TENANT, with LANDLORD'S written approval, continues to rent the premises on a month -to -month basis, all covenants and conditions
contained in this Lease shall continue in full force and effect so long as TENANT retains possession of said premises.
5. LANDLORD will have the right , in the event of an emergency, to enter the premises using whatever reasonable force is necessary.
6. In the event LANDLORD is required to obtain the services of an attorney to enforce any of the provisions of this Lease, TENANT agrees to pay in addition to the sums due
hereunder, an additional amount as and for attorney's fees and costs incurred.
7. The covenants herein contained shall extend to and be binding upon the parties hereto, their heirs, executors, administrators, successors and assigns.
8. Rental Refund: A no -refund policy exists; any exceptions to be at the sole discretion of the LANDLORD.
9. Contract Signature: TENANT'S signature determines the only person with authority to entry. LANDLORD cannot assist anyone other than the TENANT to gain entry.
19. Early Move -Out: LANDLORD will consider a locker abandoned per evidence of contents removed or absence of a TENANT padlock. LAND LORD has authority to re -rent
an abandoned locker without obligation to the previous TENANT.
11. Red -Lock Procedure: LANDLORD has authority to 'RED -LOCK' a past due unit. TENANT removal of a'RED-LOCK' constitutes breaking and entering.
12. Padlock Ownership: TENANT to provide and be solely responsible for the unit padlock.
13. No monthly billing will be sent to TENANT
14. No electricity may be used by the TENANT other than lights without permission of the LANDLORD. All TENANTS must turn off lights upon leaving their leased space.
15. TENANT shall abide by rules of LANDLORD, not use premises for any unlawful purpose, observe operating hours, and conduct themselves in an orderly manner while
on premises.
16. No storage shall be permitted on the exterior of any storage unit.

IMPACT ANALYSIS STATEMENT
GORE SCHOOL REZONING
A. Suitability of the Site:
100 year flood plains: The FEMA Flood Insurance Map — Community Panel #510063-
0100-B indicates that the flood plain associated with Back Creek is located on the south
side of the railroad tracks which is not on the 3.29 acre tract.
The 3.29 acre tract does not contain areas of wetlands, steep slopes, mature woodlands,
prime agricultural soils, or soil conditions, which would create construction difficulties or
hazards.
B. Surrounding Properties:
A copy of the plat for this property is attached. I own the land (3.534 acres) on the East
Side of the property I'm asking to rezone. Winchester and Western Railroad owns the
adjoining land on the South Side of my property with the railroad tracks adjacent to the
back of my property line. Route 751 lies in front of my property on the North Side with
one house facing my property. On the East Side of my property past the school and the
driveway is one house facing the school. It is approximately 400 ft. from my driveway.
There should be a very minimal impact on surrounding properties with just an occasional
vehicle unloading or loading their storage items. The driveway circles around the school
with plenty of room for parking and maneuvering, Hours of operation and lighting
should have little or no impact.
C. Traffic:
There are already two entrances to this property and no more will be added or needed.
This is part of my proffer statement. If every room was rented out and every person came
on the same day to retrieve something from storage, than there would be eleven vehicles
stopping that day. This would be the maximum amount of traffic. Most days would be
very minimal with just an occasional vehicle. I do not believe there are any peak vehicle
trip hours associated with this use.
D. Sewage Conveyance and Treatment:
There is no public sewer system in the vicinity of this 3.29 acre tract. There are several
drainfields; but they will not be used as part of this proposed operation.
E. Water Supply:
There is well water available on this property; but it will not be used as part of this
proposed operation.

F. Drainage:
There is a drainage area located along the eastern property line that drains into Back
Creek; however, there will be no impact on this from my proposed operation.
G. Solid Waste Disposal Facilities:
There will be no dumpster areas or other refuge facilities proposed for this project;
therefore, no impacts for solid waste disposal are anticipated.
H. Historic Sites and Structures:
According to the Frederick County Rural Landmarks Survey, the Gore School and other
structures in this area are not listed as structures of potential historic significance.
Impact on Community Facilities:
There should be very minimal impact. The only facilities that could be affected are the
Sheriff's Department in case of a break-in and the Fire Department in case of fire. This
property is less than a quarter of a mile from the Gore Fire Department.
I have attached copies of the Frederick County Capital Facilities Impact Model to show
the fiscal impact to fire and rescue services.

Dear Mr. Morgan:
As requested, I have reviewed the referenced statement that has been prepared for your rezoning
proposal. I offer the following comments based on this review:
1) Site Suitability
I would recommend that you go into more detail and document sources. For example, I would state
that the FEMA Flood Insurance Map - Community Panel #510063-0100-13 indicates that the flood
plain associated with Back Creek is located on the south side of the railroad tracks which is not on
the 3.29 acre tract. I would also state the features by name and state that they are not on the
property. For example, the 3.29 acre tract does not contain areas of steep slope or mature
woodlands.
2) Surrounding Properties
You need to provide additional information about the surrounding properties, including the zoning
classification, the various uses, and the proximity of existing uses or structures to the 3.29 acre tract.
I believe' that the statement regarding minimal impacts to adjoining properties is appropriate;
however, you need to discuss how surrounding properties will be impacted by issues such as hours
of operation, lighting, and vehicle maneuvering.
3) Traffic
Although you do not need to do a detailed traffic analysis, you should provide a number of vehicle
trips that would reasonably utilize this site during a 24 hour period. You should also indicate if there
are peak vehicle trip hours associated with this use and what those numbers would be.
4) Sewage Conveyance
Although there is no public sewer system in the vicinity of this 3.29 acre tract, you should address
any existing health system (ie: drainfield) and discuss if it would be utilized as a part of this proposed
operation for patrons or employees.

negative fiscal impact to fire and rescue services as demonstrated by the Frederick County Capital
Facilities Impact Model which was provided to you as an attachment to my letter dated August 19,

Dear Mr. Morgan:
Please find attached information regarding fiscal impact model runs forthereferencedproperty. The
model runs represent two scenarios for the development of warehouse square footage on this
property. The Capital Facilities Impact Model determines the cost associated with capital facilities
needs for public schools, county parks, and fire and rescue services, provides a credit based on the
taxes that would be paid for this property which would be utilized by the county for capital costs,
and determines the net impact based on this rezoning application. The two scenarios demonstrated
a negative fiscal impact to fire and rescue services as indicated in the Fire and Rescue Addendum,
and did not demonstrate a negative fiscal impact to public schools or county parks.
I have reviewed the Frederick County Rural Landmarks Survey to determine ifthis property or other
properties within close proximity are of historic significance. The survey includes the Gore School
and other structures in this area; however, they are not listed as structures of potential historic
significance. Based on this research, you will not be required to obtain a review agency comment
from the Historic Resources Advisory Board.
