Your site plan has been given final approval. Before any excavation or land disturbance is undertaken, a land disturbing permit must be obtained and before construction, a building permit must be obtained. Frederick County Pump and Haul Contract My staf-f, and the Assistant Attorney General for the Department, have reviewed the application and pertinent submit- tals related to a request by the Frederick County Sanitation Au- thority and Group 44, Inc. for a pump and haul permit in accor- dance with Section 5.05 of the Virginia Sewage Handling and Dis- posal Regulations. The agreement between the Department and the Frederick County Sanitation Authority has been signed by me, and you are authorized to issue those permits as will be required by the regu- lations for the Authority to carry out the agreement. Please deliver a• copy of the signed agreement to Mr. Donald R. Hodgson, Chairman, Frederick County Sanitation Authority and Mr. Robert Tullins, President, Group 44, Inc. VA 22601 REEMENT, made and dated this �� day of J 1986, by and between.the COMMONWEALTH OF VIRGINIA, DEPARTMENT OF HEALTH, hereinafter called the "DEPARTMENT"; FREDERICK COUNTY SANITATION AUTHORITY, a Virginia corporation organized and existing under the provisions of the Virginia Water and Sewer Authorities Act (§15.1-1239, et seq., Code of Virginia, 1950 as amended), hereinafter called the "AUTHORITY"; and GROUP 44, INC., a Virginia corporation, hereinafter called "GROUP 44". WHEREAS, §5.00, et seq., of the Virginia Sewage Handling and Disposal Regulations permit the disposal of sewage on a "Pump and Haul" basis by a government entity upon execution of a contract between the Government entity and the "DEPARTMENT", and upon issuance of permits by the "DEPARTMENT" for pumping and hauling and for each sewage facility; and WHEREAS, no practical economic method exists, under current circumstances, for the disposal of sewage from "GROUP 44" except by pumping and hauling to a "DEPARTMENT" approved sewage disposal facility; and WHEREAS, "GROUP 44" will secure a sewage hauling permit to pump and haul sewage as required; and WHEREAS, the "AUTHORITY" does guarantee to the "DEPARTMENT" that "GROUP 44" shall comply with all applicable provisions of said regulations. THEREFORE, WITNESSETH: That for and in consideration of the requirements of said regulations, the issuance of "Pump and Haul" permits and sewage storage facility permits, and in consideration of the various covenants, conditions and obligations set forth below, the parties agree as follows: 1. "GROUP 44" shall design and construct a sewage storage facility in accordance with §14.00 of said regulations and shall apply to the "DEPARTMENT" for a permit for the sewage storage facility. 2. "GROUP 44" shall apply to the "DEPARTMENT" for a "Pump and Haul" permit and shall provide such service to "GROUP 44" until sewer service is provided by "AUTHORITY". 3. "GROUP 44" shall conform to the conditions contained in all sections of the Virginia Sewage Handling and Disposal Regulation and any other applicable regulations in the Operations and Maintenance of Sewage Storage Facility and in the conduct of the Pump and Haul Collection and Disposal of Sewage from "GROUP 44". 4. The "AUTHORITY" shall receive and treat all sewage delivered to the "AUTHORITY'S" facilities from "GROUP 44" and guarantees compliance by "GROUP 44" with all applicable regulations concerning sewage collection and disposal services to "GROUP 44". 5. "GROUP 44" will abandon all storage facilities in accordance with "DEPARTMENT" instructions and cease pumping and hauling of sewage as outlined in this agreement when sewer service is provided by "AUTHORITY". 6. Upon receipt of proper application therefore, and provided regulations are adhered to, "DEPARTMENT" will issue all permits required for the sewage storage facility and pump and haul operation required to provide sewage collection and disposal from "GROUP 44". 7. It is understood and agreed between the "AUTHORITY" F CIA and "GROUP 44" that the "AUTHORITY" is not obligated to provide said guarantee and does so only as a convenience to JDRE'. Nothing herein shall be construed to restrict the Department of Health's ability to revoke the permit for failure to comply with provisions or applicable statute's, the Sewage Handling and Disposal Regulations, or other applicable regulations. REVIEW EVALUATIONS: Inspections Department - Proposed building to be built and designed in accordance with the Virginia Uniform Statewide Building Code and applicable standards for the proposed use. Article 17 of BOCA requires a fire suppression system (sprinkler system) for buildings of Use Group "F" (Industrial) in excess of 12,000 square feet. Must comply with ANSI Handicap Provisions for building and will need one handicap parking space. Health Department - Mr. Tullius has applied for a "Pump and Haul" Contract approval from the State Commissioner of Health. VA. Dept. of Highways - This site plan is not within the VDH&T's minimum requirements. We have discussed this matter with Mr. H. Bruce Edens and he indicated he would resubmit another set of plans. Greenwood Fire Company - We find a problem with water supply to protect life and property at this location. For our approval of this building, we would need a private or public water supply capable of supplying 2,500 gpm for up to one hour. We would also need a 20' fire lane around the building, 10' away from the building itself. Planning and Zoning - No objections. The site plan conforms to all appropriate dimensional and off-street parking requirements. Page 2 Skyline Oil Site Plan STAFF RECOMMENDATIONS: Approval, with the following changes indicated on the plan: 1) There should be gates or openings along the north fence line for emergency access. 2) A pond area should be indicated on this site for on -site storage of water for fire fighting needs. The location of the pond is to be located along Victory Lane and between the two structures. Unfortunately, the site will not support a suitable septic system. I would like to ask the county to consider a temporary pump and haul system permit.
