To Whom It May Concern:
On June 18, 2004, I visited the above -referenced property in response to a complaint regarding
inoperable vehicles and noise violations.
An inoperable vehicle is defined as a motor vehicle that is not in operating condition. This includes
vehicles that have been either partially or totally disassembled through the removal of tires, wheels,
engine, or other parts necessary for their operation. Furthermore, an inoperable vehicle is also one
that may not legally operate on the roads of either Fredericks County or the Commonwealth of
Virginia due to the absence of any of the following: license plates, valid registration sticker(s), and/or
valid inspection sticker.
In accordance with Section 165-47C(2) of the Frederick County Zoning Ordinance, inoperable
vehicles are permitted to be stored outside of an enclosed structure in the Ml (Light Industrial)
Zoning District when such storage is completely screened from view from public roads and
surrounding properties. Permitted screening includes opaque fences, opaque landscaping, or opaque
natural vegetation. Opaque is defined in Article XXII of the Zoning Ordinance as not transparent or
translucent. Therefore, the outdoor storage of the inoperable vehicles on this property constitutes
a violation of the provisions of Section 165-47C(2). Resolution of this violation may be
accomplished by either removing the vehicles from the property, relocating the vehicles for storage
within a completely enclosed structure, relocating to an adequately screened portion of the property,
or returning the vehicles to legal operating condition. — —
In accordance with Section 165-35H of the Frederick County Zoning Ordinance , sound levels at
the perimeter boundary of a property shall not exceed 75 decibels at any one time. In order to come
into compliance with this alleged complaint, it will be necessary for you to schedule an appointment
with our Department to read the decibel levels around your property.
My visit to the site also reveled the presence of illegal signage being displayed on the property.
Section 165-30A(5) prohibits all portable signs in every zoning district. These signs should be taken
down in order to comply with thisy�oltion.

This office will allow 30 days from receipt of this letter to resolve all of these violations. Failure to
comply with the Zoning Ordinance in this time period will result in an immediate criminal complaint
being filed against you.
You may have the right to appeal this notice of violation within 30 days of the date of this letter in
accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and
unappealable, if it is not appealed within 30 days. Should you choose to appeal, the appeal must be
filed with the Zoning Administrator and the Board of Zoning Appeals (BZA) in accordance with
Article XXI, Section 165-155A(1), of the Frederick County Zoning Ordinance. This provision
requires the submission of an application form, a written statement setting forth the decision being
appealed, the date of decision, the grounds for the appeal, how the appellant is an aggrieved party,
any other information you may want to submit, and a $250.00 filing fee. Once the appeal application
is accepted, it will be scheduled for public hearing and decision before the BZA.
